DocuSign Envelope ID:9FB19988-C376-47EC-8601-C10E7A475C94 Planning Commission Report July 13, 2020 Page 2 RECOMMENDATION That the Planning Commission adopt Resolution No. 4406 approving CUP 2020-0004 to allow professional, general, and medical office uses, trade schools, martial arts instruction, and massage establishments in Buildings A and B within the Tustin Freeway Center located at 14051-14061 Newport Avenue. APPROVAL AUTHORITY Pursuant to Condition No. 1.1 of Resolution 2731, modifications to the approved development plan require an amendment to the CUP. Pursuant to Tustin City Code (TCC) Section 9291c, the Planning Commission has the authority to review and take action on cups. BACKGROUND On January 8, 1990, the Planning Commission approved CUP 89-47 and DR 89-68 for the construction of the subject 45,376 square foot retail center. Phase One of the center was constructed in the early 1990s and includes Building A (10,551 square feet), Building B (21,370 square feet), and Building C (3,516 square feet). Phase Two of the center was constructed later at the south end of the site (14071 -14081 Newport Avenue) with an approximately 10,000 square foot retail sales building. Condition No. 1.4 of Resolution 2731 for CUP 89-47 and DR 89-68 allows all uses authorized in the C1 and C2 zoning districts but prohibits medical, dental and/or chiropractic offices, auto repair or retail auto parts sales or installation, schools ortrain ing facilities, Laundromats, convenience or liquor stores, arcades or other gaming establishments, adult bookstores and massage establishments. On October 24, 2005, the Planning Commission approved CUP 04-025 authorizing a modification to Condition No. 1.4 of CUP 89-47 and DR 89-68 to allow professional, general, and medical office uses, trade schools, and martial arts instruction in the commercial center located at 14051-14061 Newport Avenue. This CUP allowed for a modified list of uses for tenants in Building A and those in Building B that do not face Newport Avenue. On May 2, 2016, the Zoning Administrator approved CUP 2015-32 authorizing the operation of an animal clinic in a 2,730 sq. ft. tenant space located at 14051 Newport Avenue, Units A2 & B. The animal clinic provides an array of services including: medical, surgical, dental, diagnostic, and acupuncture services for dogs and cats, and pet grooming and pet-related products for retail sale. On November 3, 2016, the Community Development Director approved Use Determination (UD) 2016-004, determining massage establishments to be a permitted use in Planned Community Commercial (PC C & PC COMM), where service commercial uses are permitted. In alignment with Ordinance No. 1462, the massage establishment use appears to be consistent and compatible with other permitted uses and supportive to the commercial district. Massage services and other similar personal services have been allowed in other commercially designated zones (C1, C2, and CG) throughout the City as a permitted use and in other Professional designated zones (PR) subject to a CUP. Parking requirements for massage establishments shall be calculated at the medical office rate. UD 2016-004 addressed planned communities that do not specifically identify massage establishments to be permitted or conditional permitted uses only. Site Location The Tustin Freeway Center is located southwesterly of the Interstate 5 Freeway and Newport Avenue intersection at 14041-14081 Newport Avenue (Attachment A) and was constructed in multiple phases. The Interstate 5 Freeway is located to the north of the site. Single-family residential and Mitchell Avenue are south of the site. A mobile home park in addition to single and multi-family dwellings exist southwesterly of the site while retail commercial uses are established across Newport Avenue to the east. The property is zoned Planned Community Commercial and designated Community Commercial by the Tustin General Plan. The applicant operates a dental office in Building B of the Tustin Freeway Center and is proposing an expansion of his business into the adjacent retail space. As the retail space faces onto Newport Avenue, Condition No. 1.4 of Resolution No. 2731 for CUP 89- 47 and DR 89-68 would prohibit an office use at this location. The applicant requests that Condition No. 1.4 be modified to allow professional, general, and medical office uses, trade schools, and martial arts instruction for the entirety of Building A and B, regardless whether the use is facing Newport Avenue. This would be an expansion of what was previously approved by the Planning Commission in conjunction with CUP 04-025. In addition, staff recommends identifying massage establishments as a permitted use in alignment with UD 2016-004 approved in 2016 by the Director of Community Development Department. This would result in additional modifications to Condition No. 1.4 for CUP 89-47 and DR 89-68 to include the removal of massage establishments from the list of prohibited uses. DocuSign Envelope ID:9FB19988-C376-47EC-8601-C10E7A475C94 Planning Commission Report July 13, 2020 Page 5 Staff proposes Condition No. 2.1 for CUP 2020-0004 which would accommodate the proposed use modifications while maintaining sensitivity to neighboring residential uses. Restrictions would continue to prohibit auto repair or retail auto parts sales or installation, laundromats, convenience or liquor stores, arcades/gaming establishments, and adult entertainment uses in this planned community district and continue to maintain retail- oriented street facing tenants within Building C and Phase Two of the development along Newport Avenue. All conditions of approval from CUP 89-47, DR 89-68, and CUP 04- 025, remain effective for the Planned Community Commercial Zoning District which includes all odd addresses between 14051 and 14081 Newport Avenue Parking Phase One of the Tustin Freeway Center was constructed with approximately 45,376 square feet in building area and is leased for a variety of retail, office, and service uses, in addition to the drive-through restaurant in Building C. Granting the additional requested uses would not authorize any reduction to parking requirements for the center. Each proposed use would continue to be reviewed with respect to required and available parking. Based upon the proposed mix of uses for this center, a total of 145 parking spaces are required to be provided on-site. A total of 149 parking spaces are provided resulting in a surplus of four (4) parking spaces. Amendment to Conditions of Approval Condition No. 1.4 of Resolution No. 2731 is proposed to be modified as follows (deleted text shown with strikethre g ): The uses authorized by the approval of UP 89-47 are as follows: a. The type of uses allowed in the project shall substantially conform to those uses authorized in the C-1 and C-2 Zoning District except for those uses specifically prohibited in this Resolution. All uses which require a CUP as listed in the C-2Zoning District will also require a CUP for this site. b. DocuSign Envelope ID:9FB19988-C376-47EC-8601-C10E7A475C94 Planning Commission Report July 13, 2020 Page 6 Environmental Review This project has been determined to be Categorically Exempt pursuant to Section 15301 (Class 1) of the CEQA in that the subject project involves no physical modifications to an existing structure and results in negligible expansion of an existing use. FINDINGS In determining whether to approve the CUP, the Planning Commission must determine whether or not the proposed use will be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood, nor be injurious or detrimental to the property and improvements in the neighborhood of the subject property, or to the general welfare of the City of Tustin. A decision to approve this request may be supported by the following findings: 1. The proposed uses comply with the General Plan Land Use Element in that office and service uses such as instructional uses are included under the Community Commercial Land Use Designation. 2. The uses would otherwise be permitted or conditionally permitted in the C1 or C2 Zoning Districts subject to Community Development Staff verification of available on-site parking to support the use. 3. Allowance of the additional uses may encourage additional economic activity for the center and adjacent commercial properties in that a lesser vacancy rate forthe center could result from the additional uses and employees and customers from those uses may utilize goods and services offered within the center. 4. The additional uses will not conflict with adjacent uses in that office uses are generally non-disruptive in nature; all uses would occur indoors; on-site parking would be required to support all proposed uses prior to business license issuance; and, hours of operation for the additional uses would be consistent with the general business hours of other businesses within the surrounding vicinity. 5. The City's Public Works Department, Police Department and Building Division have reviewed and support the proposed project, as conditioned. CONCLUSION Accordingly, Staff recommends that that the Planning Commission adopt Resolution No. 4406 (Attachment D)approving the modification to Condition No. 1.4 of CUP 89-47 and DR 89-68 to allow professional, general, and medical office uses, trade schools, martial arts instruction, and massage establishments in the commercial center. SOURCE CODES (1) STANDARD CONDITION (5) RESPONSIBLE AGENCY (2) CEQA MITIGATION REQUIREMENTS (3) UNIFORM BUILDING CODE/S (6) LANDSCAPING GUIDELINES (4) DESIGN REVIEW (7) PC/CC POLICY EXCEPTIONS DocuSign Envelope ID:9FB19988-C376-47EC-8601-ClOE7A475C94 (1) 1.7 As a condition of approval of CUP 2020-0004, the applicant shall agree, at its sole cost and expense, to defend, indemnify, and hold harmless the City, its officers, employees, agents, and consultants, from any claim, action, or proceeding brought by a third-party against the City, its officers, agents, and employees, which seeks to attack, set aside, challenge, void, or annul an approval of the City Council, the Planning Commission, or any other decision-making body, including staff, concerning this project. The City agrees to promptly notify the applicants of any such claim or action filed against the City and to fully cooperate in the defense of any such action. The City may, at its sole cost and expense, elect to participate in defense of any such action under this condition. 1.8 CUP 2020-0004 may be reviewed on an annual basis, or more often if necessary, by the Community Development Director. The Community Development Director shall review the use to ascertain compliance with conditions of approval. If the use is not operated in accordance with CUP 2020-0004, or is found to be a nuisance or negative impacts are affecting the surrounding tenants or neighborhood, the Community Development Director shall impose additional conditions to eliminate the nuisance or negative impacts, or may initiate proceedings to revoke CUP 2020-0004. USE RESTRICTIONS (1) 2.1 All conditions of approval from Conditional Use Permit 89-47, Design Review 89-68, and CUP 04-025, remain effective for the Planned Community Commercial Zoning District which includes all odd addresses between 14051 and 14081 Newport Avenue with the exception that Condition 1.4 of CUP 89-47 and DR 89-68 is modified for Building A and Building B as follows: a. The type of uses allowed in the project shall substantially conform to those uses authorized in the C-1 and C-2 Zoning District except for those uses specifically prohibited in this Resolution. All uses which require a Conditional Use Permit as listed in the C-2 Zoning District will also require a Conditional Use Permit for this site. b. Prohibited Uses- auto repair or retail auto parts sales or installation, laundromats, convenience or liquor stores, arcades or other gaming establishments, and adult bookstores. These uses are prohibited to ensure compatibility of land uses with the adjacent residential properties, ensure compliance with the parking requirements listed herein and to comply with the requirements of Planning Commission Resolution 2411. DocuSign Envelope ID:9FB19988-C376-47EC-8601-ClOE7A475C94 2.2 Prior to issuance of a business license or a building permit(s), each use for the center must be verified by the Community Development Department to have on-site parking as required by the CUP 89-47 and the Tustin City Code. (1) 2.3 Any reduction of on-site parking, change of tenant spaces/uses, parking lot and/or circulation shall be reviewed and approved by the Community Development Department. PLAN SUBMITTAL (3) 3.1 At the time of building permit application, the plans shall comply with the latest edition of the codes (building codes, Green Building Code), City Ordinances, State, Federal laws, and regulations as adopted by the City Council of the City of Tustin. (1) 3.2 Construction and Demolition Waste Recycling and Reduction Plan (WRRP). a. The applicant/contractor is required to submit a WRRP to the Public Works Department. The WRRP must indicate how the applicant will comply with the City's requirement (City Code Section 4351 , et al) to recycle at least 65% of the project waste material or the amount required by the California Green Building Standards Code. b. The applicant will be required to submit a $50.00 application fee and a cash security deposit in the amount of five (5) percent of the project's valuation as determined by the Building Official, rounded to the nearest thousand, or $2,500, whichever is greater. In no event shall a deposit exceed $25,000. C. Prior to issuance of a permit, the applicant shall submit the required security deposit in the form of cash, cashier's check, personal check, or money order made payable to the "City of Tustin". FEES 4.1 Prior to issuance of any permits, payment shall be made of all applicable fees, including but not limited to, the following: 0 Building and Planning plan check and permit fees (1) 4.2 Within forty-eight (48) hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a cashier's check payable to the COUNTY CLERK in the amount of fifty dollars ($50.00) to enable the City to file the appropriate environmental DocuSign Envelope ID:9FB19988-C376-47EC-8601-ClOE7A475C94 documentation for the project. If within such forty-eight (48) hour period the applicant has not delivered to the Community Development Department the above-noted check, the statute of limitations for any interested party to challenge the environmental determination under the provisions of the California Environmental Quality Act could be significantly lengthened.
