2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN APPROVING VESTING TENTATIVE TRACT MAP NO.
3 15380 LOCATED ON THE SOUTHWEST CORNER OF JAMBOREE
ROAD AND TUSTIN RANCH ROAD.

The City Council of the City of Tustin does hereby resolve
5 as follows:

I. The City Council finds and determines as follows:
7
A. That Vesting Tentative Tract Map No. 15380 was
8 submitted to the City Council by Richmond
American Homes, Inc. for consideration;
9
B. That a public hearing was duly called, noticed
10 and held for said map on July 14, 1997 by the
Planning Commission and on July 21, 1997 by the
11 City Council;
12 C. That Environmental Impact Report 85-2, as
modified by Addendum # 6 for the East Tustin
13 Specific Plan, has been certified in conformance
with the requirements of the California
14. Environmental Quality Act for the subject
project;
15
D. That General Plan Amendment 96-003, Zone Change
16 96-003 and third Amendment to the East Tustin
Development Agreement have been recommended for
17 approval so that the proposed subdivision will be
in conformance with the Tustin Area General Plan,
18 adopted East Tustin Specific Plan, Development
Agreement and Subdivision Map Act as it pertains
19 to the development of single-family dwellings;
20 E. The 1.6524 acres of parkland required for this
development was previously dedicated with
21 recordation of Tract 13627;
22 F. That the City has reviewed the status of the
School Facilities Agreement between The Irvine
23 Company and the Tustin Unified School District,
for the impact of Vesting Tentative Tract 15380
24 on School District facilities, and changes in
State law. The impacts associated with this
25 approval on School District Facilities are
adequately addressed;

G. That the site is physically suitable for the type
27 of development proposed;

H. That the site is physically suitable for the
3 proposed density of development;
4 Io That the design of the subdivision or the
proposed improvements are not likely to cause
5 substantial environmental damage or substantially
and avoidably injure fish or wildlife in their
6 habitat;
7 J. That the design of the subdivision or the type of
improvements proposed will not conflict with
8 easements acquired by the public, for access
through or use of the property within the
9 proposed subdivision;
10 K~ That t~e design of the subdivision or the types
of improvements proposed are not likely to cause
serious public health problems;
12 Lo The project has been determined to be exempt from
the provisions of Measure "M" because
13 entitlements specified in the East Tustin
Development Agreement entered into in 1985, and
14 the estimated project generated traffic does not
cause the roadway system to exceed established
15 levels of service standards; and,
16 M. That the proposed dedication of additional right-
of-way on Jamboree Road is necessary to satisfy
17 the mitigation measures included in EIR 85-2 as
it relates to the required circulation plan.

IIo- The City Council hereby.approves Vesting Tentative
19 Tract' Map No. 15380, located at the southwest corner
of Jamboree Road and Tustin Ranch Road, subject to the
20 conditions contained in Exhibit A of Planning
Commission ResolUtion No. 3529, incorporated herein by
21 reference.
22 PASSED AND ADOPTED at a regular meeting of the Tustin City
Council held on the 21st day of July, 1997.
