HUSTON, CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: AMENDMENTS TO THE 2002-03 AND 2003-04 ACTION PLANS FOR COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS AND CITIZEN PARTICIPATION COMMITTEE APPOINTMENTS FOR CDBG PROGRAM YEAR 2006-07 RECOMMENDATION That the City Council: 1) Adopt Resolution No. 06-21 amending the Action Plans for Fiscal Years 2002-03 and 2003-04 to transfer unused funds to CDGB projects that can be immediately implemented in 2006; and, 2) Reappoint Leslie Pontious and Tracy Worley Hagen as the at-large representatives on the 2006-07 Citizen Participation Committee. FISCAL IMPACT The proposal involves the reallocation or redistribution of CDBG funds from previously approved projects and the selection of volunteer community members. No impacts to the General Fund are anticipated. PROPOSED AMENDMENTS / FUNDS REAllOCATIONS The Community Development Department is proposing to amend the 2002-03 and 2003-04 CDGB Action Plans which described the activities the City were to undertake during the program years to address the priority needs of housing and Community Development. The proposed amendment would reallocate funds from slower moving activities to activities that can be immediately active. Federal law Section 573.902(a)(1)(i) related to CDBG programs indicates that HUD will consider an entitlement recipient (City) to be failing to carry out its CDBG activities in a timely manner if, sixty days prior to the end of current program year, the amount of entitlement grant funds available is more than 1.5 times the entitlement grant amount for the current City Council Report CDBG Reallocation Page 2 program year. The proposed reallocations, if approved by the City Council, would allow the City to expedite draw down of CDBG funds to meet the timeliness requirements. The proposed amendments are as follows: Plan Year 2002/03 and 2003/04 2003/04 From Old Town Zoning Studies ($17,799) Old Town Design Guidelines ($30,000) Tustin Family Youth Center Improvement ($14,420.50) Tustin Family Youth Center Improvement ($28,000) To Amount Peppertree Park for replacement of the existing backstop, perimeter fencing, refurbishing and restoring ball-field soil, installation of an additional 200 amp service for the restroom and picnic bandshell. $62,219.50 Pine Tree Park for design plans and specification for the renovation and replacement of a 13,000 square foot playground apparatus equipped tot lot. $28,000.00 In accordance with Federal Law, the City has published a notice in the local newspaper with regard to the proposed amendments. Staff recommends that the City Council support the amendments to the FY 2002-03 and 2003-04 Action Plans to transfer unused funds to CDGB projects that can be immediately implemented in 2006. CITIZEN PARTICIPATION COMMITTEE In January 2003, the City Council adopted the City's Citizen Participation Plan (the Plan) which provides a public participation process by a citizen participation committee in identifying needs, setting priorities, allocating funds to eligible activities, and overseeing the overall CDBG program implementation and performance. The Plan defines the roles, responsibilities, and composition of the Citizen Participation Committee as follows: 1. Citizen Participation Committee Membership The Citizen Participation Committee is an Ad Hoc Committee comprised of seven (7) members. Committee members should be active community leaders who are aware of the needs of the community and who will assist in obtaining citizen input concerning the CDBG Program. The composition of the Citizen Participation Committee is as follows: . One representative from the Planning Commission . One representative from the Parks and Recreation Commission City Council Report CDBG Reallocation Page 3 . One representative from the Cultural Resources Advisory Committee . One representative from the Senior Advisory Board . One representative from the Tustin Audit Committee . Two at large representatives appointed by the City Council 2. The Citizen Participation Committee duties and responsibilities are as follows: . To provide citizen and community input in an advisory fashion on the development, implementation, evaluation, and amendments to the CDBG Program. . To hold at least one public hearing during the development of the Action Plan and/or Consolidated Plan to obtain citizens views and to respond to citizen proposals and requests, to assist in the determination of the community development and housing needs and priorities, and to obtain comments on the City's CDBG program performance. . To encourage broad citizen and community participation on the CDGB Program. Pursuant to the CDBG Citizen Participation Plan, the City Council is requested to reappoint Leslie Pontious and Tracy Worley Hagen as the at-large representatives on the 2006-07 Citizen Participation Committee. Binsack Director of Community Development Attachment: Resolution No. 06-21 S:\Cdd\CDBGlO5-06\cc reallocation report.doc RESOLUTION NO. 06-21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING AMENDMENTS TO THE CITY'S 2002-03 AND 2003-04 ACTION PLANS FOR COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM AND AUTHORIZING SUBMISSION OF THE AMENDMENTS TO THE FEDERAL DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT. WHEREAS, under the Housing and Community Development Act of 1974, as amended, Federal assistance may be provided for the support of community development activities which are directed toward certain specific objectives as set forth in the Act as the Community Development Block Grant; and WHEREAS, previously funded programs and projects have not been initiated and remain inactive and funds remain unexpended; and WHEREAS, it is important that the City of Tustin expend CDBG funds expeditiously to meet the timeliness requirement; and WHEREAS, funds must be reallocated to other eligible activities prior to expenditure; and WHEREAS, citizens were notified of the proposed changes in use of CDBG funds through a legal notice published in the local newspaper; and WHEREAS, the City Council considered the amendments at the meeting on February 6, 2006. Section 3: The City Manager of the City of Tustin or his designated representative, such as the Director of Community Development, is authorized to execute documents, certifications, contracts, or other instruments as may be required to carry out the City's Community Development Block Grant (CDBG) Program. Section 4: The City Clerk shall certify to the adoption of this Resolution and shall file a copy of said application with the minutes of this City Council meeting.
