STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: ADOPT RESOLUTION NO. 20-56 TO ACCEPT IMPROVEMENTS FOR THE VETERANS SPORTS PARK AT TUSTIN LEGACY PARK IMPROVEMENTS PROJECT, CIP NO. 20043, AND AUTHORIZE THE CITY ENGINEER TO FILE A NOTICE OF COMPLETION SUMMARY Construction of the Veterans Sports Park at Tustin Legacy Park Improvements Project, CIP No. 20043, has been completed by Los Angeles Engineering, Inc. (LAE)to the satisfaction of the City Engineer and is now ready for City Council acceptance. RECOMMENDATION It is recommended that the City Council take the following actions: 1. Adopt Resolution No. 20-56 accepting the construction of the Veterans Sports Park at Tustin Legacy Park Improvements Project, CIP No. 20043; and 2. Authorize the City Engineer to execute and file the Notice of Completion with the Orange County Recorder's Office. FISCAL IMPACT The final construction cost for the Veterans Sports Park at Tustin Legacy Park Improvements Project, CIP No. 20043, is $21,196,847.29, including authorized contract change orders in the amount of $1,751,354.29. The contract change orders comprise of miscellaneous field modifications including facility installations for AT&T, final quantity adjustments, additional imported sand, electrical power modifications, planting sod in lieu of hydroseed, additional security to deal with skate park trespassers, and additional compensation due to an SCE delay with providing permanent power. Given these cost adjustments, change orders approved for LAE still totaled only 9.0% of the original bid amount. Sufficient funds were budgeted and appropriated in the Capital Improvement Program utilizing MCAS Backbone Fees (Fund 187), MCAS Tax Allocations Bonds (Fund 561), Park Development Fees (Fund 131 & 132), Community Facilities District 06-1 Proceeds (Fund 434) and a Land and Water Conservation Fund Grant (Fund 200). The City also received AT&T reimbursement for their share of the cell site equipment shelter and conduits in the amount of $339,942.63. Currently T-Mobile is in process of finalizing a license agreement to share the cell site and further reimburse the City in the amount of $312,016. CORRELATION TO THE STRATEGIC PLAN The park improvements of Veterans Sports Park at Tustin Legacy, CIP No. 20043 contributes to the fulfillment of the City's Strategic Plan Goal A: Economic and Neighborhood Development. Specifically, the project implementation of Strategy 1, which among other items is to complete the DocuSign Envelope ID:7CF56358-020E-44B1-B07A-1A1C1F2F9E33 Notice of Completion for Veterans Sports Park Improvements, CIP No. 20043 September 1, 2020 Page 2 Master Plan for Tustin Legacy and Strategy 6, which is to assess and to explore opportunities for expanded recreational activities. DISCUSSION Phase two of the Veterans Sports Park at Tustin Legacy park improvements project consists of construction of the Veteran's Memorial monument, sports fields, sports courts, restroom buildings, walkways and site amenities. The first phase of the project completed by Sukut Construction, Inc. consisted of demolition, grading and installation of storm drain, potable water, reclaimed water, and sanitary sewer facilities. This phase one work was completed in May of 2018. The final phase of the park improvements construction project was started by LAE in January of 2019 and recently completed in July, 2020. This project was delayed between August and November, 2019 due to the City's inability to provide an SCE utility easement through the park which is still owned by the Navy under a Lease In Furtherance Of Conveyance (LIFOC). The City managed to secure an agreement with SCE to provide electrical power to the park without the easement. As part of the agreement, the City will grant SCE the easement once the Navy relinquishes the LIFOC to the City. The Veterans Sports Park soft-opened on July 21, 2020. Dou s S Stack, P.E. Location Map SXnY COunCil Ilems12020 Council kems100-01-20201-Veterans Sports Park Improvements Project(CIP 20043)MC-Veterans Sports Park Improvements Project,CIP 20043.docx DocuSign Envelope ID:7CF56358-020E-44B1-B07A-1A1C1F2F9E33 RESOLUTION NO. 20-56 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR THE VETERANS SPORTS PARK AT TUSTIN LEGACY PARK IMPROVEMENTS PROJECT, CIP NO. 20043 WHEREAS, Los Angeles Engineering, Inc., having a contract with the City of Tustin to construct the hereinafter described public works and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvement hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public works and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public works and improvement is found to be complete, and the same is hereby accepted. Said public works and improvement is more particularly described as follows: Veterans Sports Park at Tustin Legacy Park Improvements Project, CIP No. 20043 BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works and improvement described herein as required by law.
