APPEAL OF TUP 2020-0077 at 355 El Camino Real
(Swinging Door/American Grubb)
August 18, 2020
Richard J. Rengel, Owner
333 El Camino Real, Tustin, CA 92780
On behalf of the immediately adjacent retail spaces and residences, we Appeal the decision to approve
TUP 2020-0077.
This appeal is based on the following:
1. Removal of Off-Street Parking. The TUP has removed ALL off-street parking in the area behind
355 El Camino. The removal of ALL parking is not necessary and creates a hardship on the
adjacent properties. 3 off-street standard stalls and an accessible stall are EASILY
accommodated while allowing the use of the requested patio space. A schematic plan is
attached for reference. I doubt that the required compliance with the ADA is sufficient, since
there is plenty of room for a temporary accessible parking stall.
2. Failure to comply with Condition 22: “A method of controlling parked cars shall be maintained
to keep a 20’ clearance from exterior patios.” The patio shares the property line with our
parking at 333 El Camino Real.
3. Failure to comply with Condition #28: “When operating within a parking lot, temporary patio
areas shall not be located within 20’ of parked cars or internal combustion engines. Area must
provide adequate separation to nearby buildings and adjacent properties.” The patio is located
directly against our building and parking lot at 333 El Camino Real.
4. Concerns over Condition #36: “…is found to be a nuisance, or negative impacts are affecting
the surrounding tenants or neighborhood…” This location is a constant on ongoing nuisance
with parking (patrons block our parking and use neighbors parking), delivery trucks blocking the
ally/fire lane and blocking our tandem parking at 333 El Camino Real, trash (now adding to-go
containers to the daily mess) and failure to clean-up on a daily basis, and general drunk, load
and unruly behavior. (NOTE: complaint filed in May of this year concerning a fire started in our
parking lot by patrons of Swinging Door -security camera video available)
5. TUP Operational Requirements: Design Criteria
x “Compatibility” Owner has constructed a 6’ high chain-link fence which is not
compatible with the immediately adjacent business and residential buildings.
x “Enclosures and Furniture: All fences and/or enclosures should be…aesthetically
pleasing and compatible with adjoining improvements or structures.” See attached
photograph: this looks more like an ICE detention center vs. an “aesthetically pleasing
and compatible design.” Attached is a reasonable schematic of a temporary patio
which meets these criteria.
The purpose of this Appeal:
a. Maintain the exceptional quality of the historic downtown. Our block is a beautiful example of
a renovated portion of an historical city center and even a temporary use which utilizes ‘chain
link’ is not acceptable.
b. Temporary Use typically refers to a weekend event, similar to the Chili Cook-off. Although
chain link is still highly questionable, the current TUP has no ending date and allows two weeks
beyond a hypothetical ending date. This will range from 6 weeks at minimum and probably
longer.
c. Maintain the ‘park-let’ design philosophy already considered by the City.
d. Failure to Notify. Although a CUP requires 300’ radius notification, the TUP requires NO
notification. Please consider a TUP process that, at the very least, requires signatures from the
adjacent neighbors.
e. The relative cost of a ‘compatible and aesthetically pleasing’ design is not a barrier, the solutions
suggested are at a minimal cost or effort, but the return is substantial. Restaurants permitted
along the street parklets have created fun mini-environments, but this TUP proposal is horrible.

APPEAL OF TUP 2020-0077 at 355 El Camino Real
(Swinging Door/American Grubb)
Date: __________________________
Name: _____________________________________________________________________

On behalf of the immediately adjacent retail spaces and residences, we support the Appeal for TUP
2020-0077.
Our support is based on the following:
1. Removal of Off-Street Parking. The TUP has removed ALL off-street parking in the area behind

adjacent properties. 3 off-street standard stalls and an accessible stall are EASILY

of room for a temporary accessible parking stall.
2. Failure to comply with Condition 22: “A method of controlling parked cars shall be maintained
to keep a 20’ clearance from exterior patios.” The patio shares the property line with the
parking lot at 333 El Camino Real.
3. Failure to comply with Condition #28: “When operating within a parking lot, temporary patio
areas shall not be located within 20’ of parked cars or internal combustion engines. Area must
provide adequate separation to nearby buildings and adjacent properties.” The patio is located
directly against the building and parking lot at 333 El Camino Real and the Knights of Pythias
building.
4. Concerns over Condition #36: “…is found to be a nuisance, or negative impacts are affecting
the surrounding tenants or neighborhood…” This location is a constant on ongoing nuisance
with parking (patrons block parking and use neighbors parking), delivery trucks blocking the
ally/fire lane and blocking parking, trash (now adding to-go containers to the daily mess) and

Dear Neighbor:
Attached is an Appeal to the temporary use permit (TUP) for the installation of the
outdoor patio behind the Swinging Door and American Grubb. We ask for your
support.
You can read the reason for the Appeal in the attachment. The Owner of these
businesses can do better than a 6’ chain link fence. To be clear, we support the
loosening of restrictions due to the pandemic, but the Owner can create a much better
(and cost-effective) environment with a little design thought. It is an insult to all of us
who work hard to keep our properties beautiful.
If you agree with this Appeal, please complete your name and address in the heading
and sign at the bottom. If you would like the Word file to create your own version of
support for the Appeal OR you would like to review the Owner’s application for the
TUP, please email me at rrengel@rengelarch.com.
Mail this to:
Tustin City Clerk
300 Centennial Way, Tustin, CA 92780
You can also scan the Appeal and email it to Jessica, the City Planner at
JAguilar@tustinca.org. She is available for questions or concerns 714-573-3149.
Thanks for your consideration.
