HomeMy WebLinkAboutITEM 9 - APPEAL OF REGIONAL HOUSING NEEDS ASSESSMENTS ALLOCATION APPEAL OF REGIONAL HOUSING NEEDS ASSESSMENT ALLOCATION TUSTIN CITY COUNCIL OCTOBER 20, 2020 TUSTIN ' S COMMITMENT TO ADDRESSING HOUSING NEEDS • THE CITY OF TUSTIN: • HAS SHOWN ITS COMMITMENT TO ADDRESSING ITS SHARE OF THE REGION 'S CRITICAL HOUSING NEEDS • IS A LEADER IN BUILDING AFFORDABLE WORKFORCE HOUSING AND HOUSING FOR THOSE OF ALL SOCIOECONOMIC LEVELS. • WITH HOUSING IN THE MASTER-PLANNED COMMUNITIES OF TUSTIN RANCH AND TUSTIN LEGACY, OVER 8,000 SINGLE AND MULTIPLE FAMILY HOMES HAVE BEEN BUILT HERE OVER THE PAST 30 YEARS WHAT IS " RHNA" AND WHY DOES IT MATTER ? • THE " REGIONAL HOUSING NEEDS ASSESSMENT IS A PERIODIC STATE-MANDATED PROCESS • IT QUANTIFIES THE NEED FOR HOUSING STATE-WIDE AND THEN ALLOCATES THAT NEED TO CITIES AND COUNTIES TO ADDRESS IN THE HOUSING ELEMENTS OF THEIR GENERAL PLANS. • LARGE RHNA ALLOCATIONS CAN REQUIRE CITIES TO PLAN FOR AND ALLOW DEVELOPMENT OF FAR GREATER RESIDENTIAL DENSITIES THAN THEIR CONSTITUENTS WANT. HOW DOES THE RHNA PROCESS WORK? • STEP 1 : THE STATE ESTIMATES THE HOUSING NEED OVER THE NEXT EIGHT (8) YEARS FOR EACH REGION OF THE STATE. • THE STATE HAS DETERMINED THE HOUSING NEED IN SOUTHERN CALIFORNIA is 1 ,341 ,827 • STEP 2: THE HOUSING NEED IS BROKEN DOWN BY INCOME GROUPS (E.G., VERY-LOW INCOME, LOW INCOME, MODERATE INCOME, AND ABOVE-MODERATE.) HOW DOES THE RHNA PROCESS WORK? • STEP 3: `SOUTHERN CALIFORNIA ASSOCIATION OF GOVERNMENTS" (SCAG) THEN ALLOCATES THAT OVERALL NUMBER TO INDIVIDUAL CITIES AND COUNTIES. • OUTCOME: ON SEPTEMBER 4, 2019 . SCAG ISSUED ITS DRAFT ALLOCATION FOR TUSTIN : 6,765 NEW HOUSING UNITS BETWEEN NOW AND 2028. WHAT IS TUSTIN ' S DRAFT RHNA ALLOCATION ? • TUSTIN 'S DRAFT HOUSING ALLOCATION : 6,765 UNITS INCLUDES: • VERY-LOW INCOME UNITS: 1 .720 • LOW INCOME UNITS: 1 .,043 • MODERATE INCOME UNITS: 1 , 129 • ABOVE-MODERATE INCOME UNITS: 2,873 WHAT IS TUSTIN ' S DRAFT RHNA ALLOCATION ? • THOSE FIGURES: • IF NOT REDUCED, WILL SIGNIFICANTLY INCREASE THE NUMBER OF RESIDENTIAL UNITS THAT THE CITY MUST PLAN AND ZONE FOR IN ITS NEXT HOUSING ELEMENT UPDATE. • WOULD LIKELY RESULT IN SUBSTANTIALLY LARGER GENERATION OF RESIDENTIAL HOUSING OVER THE NEXT H YEARS. • WOULD REPRESENT A DRAMATIC INCREASE IN THE NUMBER OF RESIDENTIAL UNITS IN TUSTIN. IS TUSTIN ALONE IN BEING ALLOCATED A LARGE RHNA REQUIREMENT? • NO. MANY OTHER JURISDICTIONS IN SOUTHERN CALIFORNIA ALSO RECEIVED LARGE DRAFT ALLOCATIONS. • UNDER STATE LAW, SCAG HAD TO ALLOCATE OVER 1 .3 MILLION UNITS THROUGHOUT SOUTHERN CALIFORNIA. • HOWEVER, TUSTIN AND MANY ORANGE COUNTY CITIES BELIEVE THEY WERE ALLOCATED A DISPROPORTIONATELY LARGE PROPORTION OF THE ALLOCATION. POTENTIAL IMPACTS OF THE ALLOCATION • INCREASE IN THE NUMBER OF ALLOWED RESIDENTIAL UNITS IN THE CITY. • INCREASES IN MAXIMUM ALLOWED DENSITIES OF RESIDENTIAL DEVELOPMENT IN SOME AREAS OF THE CITY. • CHANGES IN TUSTIN 'S ZONING CODE TO ALLOW RESIDENTIAL DEVELOPMENT IN AREAS WHERE IT IS NOT CURRENTLY PERMITTED, PERHAPS INCLUDING MIXED USE DEVELOPMENTS IN SOME AREAS. • INCREASES IN THE NUMBER OF VEHICLES AND TRAFFIC. POTENTIAL IMPACTS OF THE ALLOCATION • INCREASES IN THE UTILIZATION OF PUBLIC RESOURCES SUCH AS PARKS AND RECREATION FACILITIES. • INCREASES IN DEMAND FOR UTILITIES LIKE WATER, WASTEWATER, ELECTRICITY, GAS, ETC. • INCREASES IN THE DEMAND FOR PUBLIC SERVICES, I.E. POLICE, FIRE, CITY SERVICES, ETC. AND • IMPACTS TO THE CITY 'S SCHOOL SYSTEM. THE CITY ' S OPPOSITION TO THE DRAFT ALLOCATION SO FAR : • CITY STAFF AND THE CITY COUNCIL HAVE ACTIVELY AND REPEATEDLY URGED SCAG: • TO ENSURE LOCAL INPUT ON THE ALLOCATION PROCESS; • TO REVISIT THE LAST-MINUTE CHANGES MADE IN ADOPTING THE ALLOCATIONS; • TO BE FAIR AND EQUITABLE IN THE ALLOCATIONS. • NEVERTHELESS, SCAG APPROVED THE DRAFT ALLOCATIONS. APPEAL PERIOD • CITY STAFF HAS BEEN WORKING WITH HARRIS & ASSOCIATES TO PREPARE AN APPEAL OF THE DRAFT ALLOCATION TO TUSTIN. • THE DEADLINE TO APPEAL IS NEXT MONDAY, OCTOBER 26. • THE SCAG APPEAL APPEARS TO BE THE ONLY AVAILABLE APPEAL. • COURTS HAVE DECLINED TO CONSIDER LAWSUITS ABOUT THESE ALLOCATIONS. APPEAL PERIOD • IF OTHER CITIES AND COUNTIES IN SOUTHERN CALIFORNIA ARE SUCCESSFUL IN THEIR APPEALS, THE CITY 'S RHNA ALLOCATION COULD ACTUALLY INCREASE. • SCAG IS REQUIRED TO ALLOCATE ALL 1 .3 MILLION UNITS, SO A REDUCTION IN ONE CITY WILL RESULT IN INCREASES ELSEWHERE. RECOMMENDED ACTION : 1 . AUTHORIZE THE APPEAL OF TUSTIN 'S RHNA ALLOCATION; AND 2. AUTHORIZE STAFF TO RESPOND TO ANY APPEAL OF ANOTHER AGENCY ' S RHNA ALLOCATION THAT COULD RESULT IN AN INCREASE IN THE RHNA ALLOCATION TO TUSTIN; AND 3. AUTHORIZE THE CITY MANAGER TO EXECUTE ALL FORMS AND DOCUMENTS REQUIRED OR APPROPRIATE TO SUPPORT THE APPEAL AND RESPONSE(S) . QUESTIONS ?
