A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP 15475

5 The City Council of the City of Tustin does hereby resolve as
follows:

Io The City Council finds and determines as follows:

A. That Final Tract Map 15475 has been submitted by
8 Baywood Development Group ("the Subdivider");
9 -B. That a public hearing was held by the Planning
.Commission on April 28, 1997. At this hearing, the
10 Planning Commission recommended that the City
Council approve Tentative Tract Map 15427.
11 Subsequently, the City Council approved Tentative
Tract Map 15427 on May 5, 1997;

C. That, pursuant to Section 66456.1 of the
13 Subdivision Map Act, the Subdivider intends to file
multiple final maps in relation to approved
14 Tentative Tract Map 15427. Final Tract Map 15475
is the first such final map;

Do Pursuant to Section 15268(b) (Ministerial Projects)
16 of the California Environmental Quality Act (CEQA),
the Final Map is considered statutorily exempt from
17 the requirements of CEQA.
18 E. That the proposed subdivision is in substantial-
conformance with the Tustin General Plan, the
19 Tustin Zoning Code and Subdivision Map Act;
20 F. The 0.4452 acres of parkland required for this
development were previously dedicated with
21 recordation of Tract 15055;
22 G. That the City has reviewed the status of the School
Facilities Agreements between the Irvine Company
23 and the Tustin Unified School District for the
impact of Tentative Tract 15427 on School District
24 facilities, and changes in state law. Impacts
associated with this approval on School District
25 facilities are adequately addressed;
26 H. That the site is physically suitable for the type
of development proposed;

I. That the site is physically suitable for the
28 proposed density of development;

Jo That the design of the subdivision or the proposed
3 improvements are not likely to cause substantial
environmental damage or substantially and avoidably
4 injure fish or wildlife in their habitat;
5 Ko That the design of the subdivision or the type of
improvements proposed will not conflict with
6 easements acquired by the public-at-large, for
access through or use of the property within the
7 proposed subdivision;
8 L. That the design of the subdivision or the types of
improvements proposed are not likely to cause
9 serious public health problems; and,
10 Mo That the Final Map is in substantial conformance
with the Vesting Tentative Tract Map.

IIo The City Council hereby approves Final Tract Map 15475,
12 subject to the posting of all required bonds and
agreements pursuant to Exhibit A of Planning Commission
13 Resolution No. 3522 and final approval by the City
Attorney and City Engineer.

PASSED AND ADOPTED at a regular meeting of the Tustin City

24 Resolution No. 97-68 was duly passed and adopted at a regular
meeting of the Tustin City Council, held on the 7th day of
