Kendig, City Attorney MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL AND TUSTIN HOUSING AUTHORITY 5:30 P.M. CALL TO ORDER — #2488 at 5:33 p.m. INVOCATION AND PLEDGE OF ALLEGIANCE — Mayor Dr. Allan Bernstein ROLL CALL — The City Clerk stated for the record that all members were in attendance. PUBLIC INPUT— None PRESENTATIONS — Mayor Pro Tem Clark introduced the presentations recognizing Council Member Puckett and Mayor Dr. Allan Bernstein. A video recognizing both was shown. Recognition of Council Member Puckett for Years of Service to the Tustin Community Mayor Bernstein, on behalf of the City Council, presented a proclamation and commemorative gavel to Council Member Puckett in honor of his years of service to the Tustin community. Mayor Bernstein noted that Council Member Puckett received a "Standing O" award from the Tustin Unified School District, a Proclamation from Senator Moorlach, a Proclamation from the East Orange County Water District, a Resolution from Assemblyman Choi, a City Council December 1, 2020 Meeting Minutes Page 1 of 6 DocuSign Envelope ID: 16FD1 DFB-742A-4F90-905D-6BD9E99E45EE Resolution from Supervisor Wagner and farewell comments from the Orange County Sanitation District Board Chairman David Shawver. Recognition of Mayor Dr. Allan Bernstein for Years of Service to the Tustin Community Mayor Pro Tem Clark, on behalf of the City Council, presented a proclamation and commemorative gavel to Mayor Dr. Allan Bernstein in honor of his years of service to the Tustin community. CONSENT CALENDAR ITEMS 1-5 — It was moved by Mayor Bernstein and seconded by Council Member Lumbard to approve the Consent Calendar as recommended by staff. Roll call — City Clerk Motion carried: 5-0 1. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA Motion: The City Council waived reading in full of all ordinances and resolutions on the agenda and declared that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. APPROVAL OF MINUTES — THE REGULAR MEETING OF THE CITY COUNCIL HELD ON NOVEMBER 17, 2020. Motion: The City Council approved the Action Minutes of the Regular Meeting of the City Council held on November 17, 2020. 3. RATIFICATION OF PAYROLL AND DEMANDS The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Motion: The City Council approved Payroll in the amount of $862,945.99, and Demands in the amount of $2,963,432.13. THIRD AMENDMENT TO THE TUSTIN LEGACY DISPOSITION AND DEVELOPMENT AGREEMENT CORNERSTONE I (DDA) WITH FLIGHT PHASE I OWNER LLC Request for authorization to approve the Third Amendment to the Disposition and Development Agreement Cornerstone I (DDA)with Flight Phase I Owner LLC, successor in interest to Flight Venture LLC (formed by the affiliates of Lincoln Property Company Commercial, Inc. (LPCC) and Alcion Capital Strategic III, LLC (Alcion) (Developer) for the FLIGHT office development at Tustin Legacy. This amendment would reduce the remaining Option term and facilitate conveyance of the FLIGHT Phase 2 property by December 30, 2022, in compliance with the State Surplus Land Act (SLA). The purchase price schedule for Phase 2 will remain unchanged. Motion: Authorized the City Manager to execute the Third Amendment to the DDA between Flight Phase I Owner LLC and the City, and any related implementing documents, subject to non-substantive modifications as may be deemed necessary and/or recommended by the City's special real estate counsel or the City Attorney. 5. HOUSING SUCCESSOR AGENCY ANNUAL REPORT FOR FISCAL YEAR 2019- 2020 In accordance with Senate Bill 341's amendments to Health & Safety Code Section ("HSC") 34176.1(f), the Tustin Housing Authority, serving as the Housing Successor Agency to the former Tustin Community Redevelopment Agency, has prepared an annual report for filing with the Tustin Housing Authority Commission and the Tustin City Council. Motion: The Tustin Housing Authority Commissioners: 1 . Received and filed the Housing Successor Agency Annual Report for Fiscal Year ("FY") 2019-2020 and transmit such report to the Tustin City Council. The City Council: 1 . Received and filed the Housing Successor's Annual Report for FY 2019-2020. 2. Directed that a copy of the Housing Successor Agency Annual Report be posted on the City of Tustin's website at www.tustinca.org REGULAR BUSINESS ITEMS 6-7 6. DECLARING RESULTS OF NOVEMBER 3, 2020 GENERAL MUNICIPAL ELECTION On November 3, 2020, the City's General Municipal Election was held to elect three Members of the City Council and to cast ballots regarding Measure CC. Adopt Resolution No. 20-77 declaring the results and other such matters as provided by law for the November 3, 2020 General Municipal Election, and 2. To implement the voters' approval of Measure CC at the General Municipal Election on November 3, 2020, adopt Ordinance 1511 . Roll call — City Clerk Motion carried: 5-0 RESOLUTION NO. 20-77 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DECLARING THE RESULTS OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 3, 2020, AND OTHER SUCH MATTERS AS PROVIDED BY LAW ORDINANCE NO. 1511 AN ORDINANCE OF THE PEOPLE OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SECTION 1303 OF CHAPTER 3 OF ARTICLE 1 OF THE TUSTIN CITY CODE CONCERNING LIMITED COUNCIL COMPENSATION Recessed at 6:10 p.m. Reconvened at 6:35 p.m. Oaths of Office Congresswoman Katie Porter administered the Oath of Office to Letitia Clark Congresswoman Katie Porter administered the Oath of Office to Rebecca Gomez Council Member Lumbard administered the Oath of Office to Ryan Gallagher 7. MAYOR AND MAYOR PRO TEM SELECTION The City Council selects those members of the Council who will serve as Mayor and Mayor Pro Tem for the following year. Mayor Pro Tem Clark opened the nominations for Mayor. Council Member Lumbard nominated Letitia Clark. The nomination was seconded by Council Member Gomez. Mayor Clark nominated Council Member Gomez. The nomination was seconded by Council Member Gomez. Council Member declined the nomination and nominated Council Member Lumbard. The nomination was seconded by Mayor Clark. Roll call — City Clerk Motion carried: 5-0 OTHER BUSINESS/CITY MANAGER REPORT City Manager Matthew S. West Congratulated the incoming and re-elected City Council Members; excited to work with all City Council Members; congratulated Mayor Clark and Mayor Pro Tem Lumbard; thanked outgoing Mayor Bernstein and outgoing Council Member Puckett for their many years of service to the Tustin community. COUNCILMEMBER COMMENTS AND REPORTS Council Member Cooper Commented on a classy move by Council Member Gomez. Congratulated Mayor Pro Tem Lumbard on his new position and welcomed incoming Council Member Gallagher to the City Council. Mayor Pro Tem Lumbard Welcomed Council Member Gomez, Council Member Gallagher, and Mayor Clark; looks forward to working with city staff and City Council in the coming years; thanked everyone for their support. Council Member Gomez Congratulated Mayor Clark and Mayor Pro Tem Lumbard. Thanked outgoing Mayor Bernstein and outgoing Council Member Puckett for their public service and contributions to the City of Tustin; thanked outgoing Council Member Puckett, a very kind man, for all his work; thanked outgoing Mayor Bernstein for doing his best to try and educate the community this past year; wished them well in their retirement; looks forward to working with the seated City Council. Council Member Gallagher Thanked city staff for the warm welcome and smooth transition to the City Council; excited to work with the leadership team and City Council Members; looking forward to doing great things.
