HomeMy WebLinkAboutPC RES 4411 DocuSign Envelope ID:09A01 F9A-5863-4517-A951-EB7E099C22E2 RESOLUTION NO. 4411 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING THE MITIGATED NEGATIVE DECLARATION FOR DESIGN REVIEW 2020-0005 AND SUBDIVISION 2020- 0002/TENTATIVE PARCEL MAP 2020-149 AUTHORIZING THE MERGER OF TWO ADJACENT LOTS INTO ONE 9.9- ACRE PARCEL AND THE DEVELOPMENT OF A NEW 220,331-SQUARE-FOOT INDUSTRIAL WAREHOUSE FACILITY LOCATED AT 14451 MYFORD ROAD. The Planning Commission does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A. That the proposed amendment is considered a"project" subject to the terms of the California Environmental Quality Act ("CEQA") (Public Resources Code §21000 et. seq.); B. That the City of Tustin prepared an Initial Study to evaluate the potential environmental impacts associated with Design Review(DR)2020-0005 and Subdivision (SUB) 2020-0002/Tentative Parcel Map (TPM) 2020-149 that concluded that potential impacts are at a level of insignificance and a Draft Mitigated Negative Declaration was prepared. The Draft Mitigated Negative Declaration was made available for public review; C. That a Notice of Intent to Adopt a Mitigated Negative Declaration was filed with the Clerk for the County of Orange for posting, and provided to members of the public using a method permitted under CEQA Guidelines Section 15072(b). The Initial Study and Draft Mitigated Negative Declaration were made available for a 20-day public review and comment period from November 17, 2020, to December 7, 2020, in compliance with Sections 15072 and 15105 of the State CEQA Guidelines; and D. That the Planning Commission conducted a duly noticed public hearing on December 8, 2020, to consider the Initial Study, proposed Mitigated Negative Declaration along with its Mitigation Monitoring and Reporting Program, DR 2020-0005, and SUB 2020-0002/TPM 2020-149 at which hearing members of the public were afforded an opportunity to comment upon the project. II. The Planning Commission hereby adopts the Mitigated Negative Declaration attached hereto as Exhibit A and its Mitigation Monitoring and Reporting Program attached hereto as Exhibit B for DR 2020-0005, and SUB 2020-0002/TPM 2020- 149 relating to a new industrial warehouse facility located at 14451 Myford Road.
