RESOLUTION NO. 86-59
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
SETTING A TIME AND PLACE OF A PUBLIC HEARING TO CONSIDER
THE DESIGNATION AND ADOPTION OF AN UNDERGROUND UTILITY
DISTRICT REQUIRING THE REMOVAL OF POLES, OVERHEAD WIRES
AND ASSOCIATED OVERHEAD STRUCTURES WITHIN THE AREA OF THE
CITY OF TUSTIN LOCATED ON NEWPORT AVENUE BETWEEN 325 FEET
NORTHERLY OF BRYAN AVENUE AND WASS STREET, WHICH AREA IS
MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" ATTACHED HERETO
AND ON THAT CERTAIN MAP ON FILE-IN THE OFFICE OF THE CITY
CLERK AND CITY ENGINEER OF THE CITY OF TUSTIN
WHEREAS, Ordinance No. 411 of the City of Tustin authorizes the Cit7
Council from time to time to call public hearings to ascertain whether the
public necessity, health, safety or welfare require the removal of poles,
overhead wires and associated.overhead structures within certain designated
areas of tlheI City and to consider the underground instal 1 ation of the
aforementioned appurtenances for supplying electric, communication, or similar
associated services to the residents of the City of Tustin, and
WHEREAS, by the aforementioned Ordinance No. 411, the City Clerk is
required to notify all affected property owners, if any, as shown on .the last
equalized assessment roll and also to notify ali concerned utilities by mail of'
the time and place of hearings to determine whether to form an Underground
Utility District and of the availability of the City Engineer's report of the
details of the District in the OffiCe of the City Clerk prior to said hearing,
and
WHEREAS, said notice is required to be given to the aforementioned
property owners and concerned utilities at least ten {10) days prior to the
date of the public hearing, and .
WHEREAS, the City Engineer has advised that this report is on file in
the office of the City Clerk, and
WHEREAS, the City Council has determined that a public hearing should
be set on June 2, 1986, at the hour of 7-00 P.M. in the City Council Chambers
at 300 Centennial Way in the City of Tustin.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Tustin that said Council hereby sets Monday, June 2, 1986, at 7-00 P.M. in the
City Council Chambers at 300 Centennial Way in the City' of Tustin, California,
as the time and place for a public hear. lng to ascertain whether the public
necessity, heal th, safety or wel fare requi re the removal of pol es, overhead
wires and associated overhead structures and the establishment of an
Underground Utility District within the area of the City of Tustin generally
located on Newport Avenue between 325 feet northerly of Bryan Avenue and Wass
Street, certain maps on file in the office of the City Clerk and the City
Engineer of the City of Tustin.

BE IT FURTHER RESOLVED.that the City Clerk is hereby authorized to
notify all affected property owners, if any, as shown on the last equalized
assessment roll and to lal$o notify all utilities affected by this proposal by a
notice through the United StatesI mail of the time and place of said hearing,
and of the availability of the City Engineer's report of the details of the
District in the office of the City Clerk prior to said hearing, ten (10) days
prior to the date thereof.

Beginning at the point of intersection of the centerlines of Newport Avenue
and Bryan Avenue;
Thence, northeasterly along said centerline of Newport Avenue a distance of
O0 feet to a point; ~aid point being the true point of beginning;
Thence, leaving said centerline of Newport Avenue, northwesterly at right
angles a distance of 62.00 feet to the point of intersection with a line parallel
to and 62.00 feet northwesterly of, as measured at right angles from, said
centerline of Newport Avenue, said point also being a point on the existing
northwesterly right-of-way 1 ine of Newport Avenue;
Thence, nort. heasterly along said parallel line and northwesterly right-of-way
line, a distance of 1,502 feet more or less to an angle point in said

Thence, leaving said parallel line, continuing northeasterly along said
northwesterly right-of-way line a distance of 195 feet more or less to the point
