The average noise level measured at Tustin's monitoring station (NMS 10N), located at Columbus Tustin Middle School on Beneta Way (Figure 1), remained fairly consistent with prior quarters during the second and third quarter reporting periods. Average noise levels during the second and third quarters continued to remain well below the City, County, and State criteria of 65 dB Community Noise Equivalent Level (CNEL) for residential uses. RECOMMENDATION: That the City Council receive and file this report. FISCAL IMPACT: No fiscal impact. J A W _ r � vim• 'Y v Figure 1 DocuSign Envelope ID:2012FBAC-OB3E-4283-95D1-FOD73087AC8A JWA Noise Report February 2, 2021 Page 2 CORRELATION TO THE STRATEGIC PLAN: Staff's analysis and report of the quarterly JWA Noise Abatement Report falls under Goal D of the Strategic Plan pertaining to strong community and regional relationships. The City of Tustin strives to work collaboratively with agencies both within and outside Tustin on issues of mutual interest and concern, and in this instance, on matters of airport traffic and noise. DISCUSSION: Following the conclusion of each calendar quarter, JWA staff prepares a Noise Abatement Program Quarterly Report and posts a copy of the report on their website. Attached are the quarterly reports for the second and third quarters of 2020, which includes the months of April through June and July through September. An overview of the information contained within the JWA Noise Reports includes measured noise levels and an analysis of noise complaints. Measured Noise Levels Aircraft noise is most noticeable during airplane takeoffs and landings, primarily due to engine noise. Although engines produce a significant amount of aircraft noise, many other factors may influence the perception of noise including: proximity; weather — in bad weather, engine noise is reflected off of the atmosphere making jets appear louder than on clear days; routes — non-scheduled operations which could include military or private aircraft and may be louder than commercial aircraft; emergencies; and, weight—a heavier load may affect an aircraft's rate of ascent. In addition, lower aircraft noise level measurements were noted during this reporting period, due to the decrease in travel as a result of the COVID-19 pandemic. During the second and third quarters of 2020, the average CNEL at Tustin's monitoring station on Beneta Way was 49.8 dB and 52.2dB. Each of these averages are lower than the average of the previous quarter (Q-1 : January — March 2020). Figure 2 (below) provides a visualization of Tustin's CNEL levels for each month during the second and third quarters of 2020. During the second and third quarters of 2020, there were fourteen (14) and twenty-six (26) Tustin area concerns submitted, respectively. Each of the concerns were submitted by one (1) Tustin resident through a new external noise reporting system, wherein residents may sign up to receive access to an app which contains a button that they may press each time they hear aircraft noise. There were zero complaints during either quarter submitted by Tustin residents directly to JWA through phone call, e-mail, or other reporting methods. The use of the mobile app/reporting button is the reason for the increase in noise concerns submitted during recent quarters. The mobile app/reporting system is operated independently from JWA, and does not require their follow-up or assistance to manage the complaints; however, JWA staff does track the data received from the system. Countywide, there has been significant increase in the number of noise complaints received by the Noise Office during recent reporting periods, which are also a result of the new reporting method that is available to residents. It has been discovered that a small number of residents utilized this service, through submitting complaints on a daily basis, as well as consistently throughout the day. To provide an understanding of the trend in Tustin area complaints throughout the years, a chart displaying the number of noise complaints for the past five (5) years is displayed below (Figure 3). The public are additionally welcome to participate in JWA's Quarterly meetings held by the Access and Noise Office. The next quarterly meeting will be held on March 23, 2021 , at 2:00 p.m. in the Eddie Martin Administration Building located at 3160 Airway Avenue in Costa Mesa. Effective January 1, 1986, the criteria for defining "Noise Impact Area" was changed from 70 dB to 65 dB Community Noise Equivalent Level (CNEL). Under this criteria, John Wayne Airport currently has a "Noise Impact Area." NOISE IMPACT SUMMARY Caltrans' Aeronautics Program has established guidelines in the California State Noise Standard to control residential area noise levels produced by aircraft operations using the State's airports. Under those guidelines, residential noise sensitive areas exposed to an average Community Noise Equivalent Level (CNEL) of more than 65 dB define the "Noise Impact Area." John Wayne Airport uses ten permanent remote noise monitoring stations (NMS) located in Newport Beach, Santa Ana, Tustin and Irvine to measure noise levels, at the following locations: MONITOR STATIONS NMS-1S: Golf Course, 3100 Irvine Ave., Newport Beach NMS-2S: 20162 S.W. Birch St., Newport Beach NMS-3S: 2139 Anniversary Lane, Newport Beach NMS-4S: 2338 Tustin Ave., Newport Beach NMS-5S: 324 ''/2 Vista Madera, Newport Beach NMS-6S: 1912 Santiago, Newport Beach NMS-7S: 1131 Back Bay Drive, Newport Beach NMS-8N: 17372 Eastman Street, Irvine NMS-9N: 1300 S. Grand Avenue, Santa Ana NMS-1 ON: 17952 Beneta Way, Tustin The map in Figure 1 shows the general location of each permanent remote monitor station. Figure 2 shows the Airport's "Noise Impact Area" for the previous year (July 1, 2019 - June 30, 2020). The Figure 2 information was developed by Landrum and Brown, in consultation with John Wayne Airport. CNEL values measured for the period and current digitized land use information were utilized to calculate the land area acreages, number of residences and estimated number of people within the "Noise Impact Area". COMMUNITY NOISE EQUIVALENT LEVELS The monthly, quarterly and twelve month Community Noise Equivalent Level (CNEL)average values for each monitor station are shown in Table 2, while daily CNEL values are shown in Tables 3 through 5. Insufficient data is indicated by VWX entries in each table. Also, "*#N/A" entries in each table indicate there were no aircraft related noise events. Average Single Event Noise Exposure Level (SENEL) values for Air Carrier and General Aviation Jet aircraft are shown in Tables 6 through 8. ACOUSTICAL INSULATION PROGRAM Four hundred eighteen residences in the Santa Ana Heights area have been sound attenuated and an avigation easement reserved through the County's Acoustical Insulation Program, which closed in December 2009. The County has also acquired 46 residences as part of the Purchase Assurance Program, many of which were acoustically insulated, an avigation easement reserved and then resold. Among these County acquired homes, those located within areas designated for Business Park uses were razed, avigation easements were reserved, and the land resold for compatible Business Park uses. A total of 464 residences in the Santa Ana Heights area have been purchased or otherwise made compatible through the County's Purchase Assurance and Acoustical Insulation Programs. Sixty-seven dwelling units in Santa Ana Heights remain in the "Noise Impacted Area" (within 65 dB CNEL contour). COMPLAINT TOTALS (April 1, 2020 - June 30, 2020) The Airport's Access and Noise Office receives and investigates noise complaints from local citizens and all other sources. During the April 1, 2020 through June 30, 2020, the Office received 19,018 complaints from local citizens. This is a 47.5% decrease from the 36,259 complaints received last quarter. It is a 56.6% decrease from the 43,772 complaints received during the same quarter last year. Figure 4 shows the distribution of the quarterly complaints from local communities. He discussed the new method of displaying reported noise event submissions on page 5 of the Quarterly Report, and announced that the allocation process was set to begin in July with a scheduled Board date in October. A summary of the JWA airport statistics for the month of April 2020 was provided by Mr. Cangey. Mr. Cangey presented analysis of COVID-19 impacts on passengers, load factors, operations, and CNEL values in comparison to 2019 figures. Due to these impacts, the Airport has waived all minimum requirements through the third quarter. Dr. Jim Mosher asked if carriers that previously could not receive allocations were receiving more, or if new entrants had received allocations. Mr. Cangey explained that Air Canada was due to begin service this year, however, due to the COVID related embargo, Air Canada, along with WestJet, have not operated. Furthermore, it was mentioned that carriers are generally being conservative with allocations. Dr. Mosher requested the Detailed Noise Reports have additional columns that would indicate a general aviation, commercial, or commuter aircraft operating, along with another column that would indicate the type of departure class. Beatrice Siercke provided the option of filtering the report by flight number to differentiate from commercial and general aviation operations. Joe August, on behalf of his community, inquired of the possibility to add a "Quiet flight" in the dropdown options in Viewpoint submissions. Mr. Cangey informed Mr. August that the Airport's intent was not to add too many fields for submissions. The aim was to keep it as general as possible where details can be provided in the comments sections. It was suggested that community members could utilize the `Other' option and comment on the quieter flights. Dr. Mosher asked if volume of complaints has decreased. Mr. Cangey stated that reported noise events submitted through the Airnoise button decreased due to lower flight frequencies. However, he also shared there is the possibility that more residents are working from home, and perhaps, are now attuned to the flights in their area, resulting in new points of contact reporting noise events. Mr. August asked if northern Anaheim has had an uptick in reporting noise events. Mr. Cangey explained the submissions in that area were Metroplex related and have been consistent since its implementation. Mr. August further, asked of the"Other' location. Ms. Siercke indicated that those submissions might have been submitted with an incomplete address and thus undeterminable if they were in regards to arrival or departure flights. Mr. August discussed the issue of general aviation departing at low altitudes with high velocities. His concern was that the operations were not over the monitors for the required time needed to register an event, thus skewing the noise data reported. He acknowledge that the Access and Noise Office did not have jurisdiction to intervene in these patterns. Mr. Cangey advised those flight numbers beginning in "N" or "PV" were general aviation. He further explained that tail numbers that start with "N" are registered in the U.S., whereas Canadian tail numbers start with "C". However, commercial flight numbers would not change based on the tail numbers. Dr. Mosher asked if it were possible to include a departure class column for the Detailed Noise Reports. Ms. Siercke explained that departure classes were submitted in a separate system than that of the Detailed Noise Reports. Therefore, it would be difficult to incorporate that information into the reports. Mr. August asked if Gross Take off Weights could be added to the report. NOISE IMPACT SUMMARY Caltrans' Aeronautics Program has established guidelines in the California State Noise Standard to control residential area noise levels produced by aircraft operations using the State's airports. Under those guidelines, residential noise sensitive areas exposed to an average Community Noise Equivalent Level (CNEL) of more than 65 dB define the "Noise Impact Area." ACOUSTICAL INSULATION PROGRAM Four hundred eighteen residences in the Santa Ana Heights area have been sound attenuated and an avigation easement reserved through the County's Acoustical Insulation Program, which closed in December 2009. The County has also acquired 46 residences as part of the Purchase Assurance Program, many of which were acoustically insulated, an avigation easement reserved and then resold. Among these County acquired homes, those located within areas designated for Business Park uses were razed, avigation easements were reserved, and the land resold for compatible Business Park uses. A total of 464 residences in the Santa Ana Heights area have been purchased or otherwise made compatible through the County's Purchase Assurance and Acoustical Insulation Programs. Three dwelling units in Santa Ana Heights remain in the "Noise Impacted Area" (within 65 dB CNEL contour). COMPLAINT TOTALS (July 1, 2020 - September 30, 2020) The Airport's Access and Noise Office receives and investigates noise complaints from local citizens and all other sources. During the July 1, 2020 through September 30, 2020, the Office received 27,792 complaints from local citizens. This is a 46.1% increase from the 19,018 complaints received last quarter. It is a 55.9% decrease from the 63,018 complaints received during the same quarter last year. Figure 4 shows the distribution of the quarterly complaints from local communities. Through July we were at 2.4 million passengers in comparison to 2019, we were at 6.2 million passengers (down by 60% due to pandemic). GA is slightly increasing compared to last year not by much. Cargo has increased but overall has decreased by 4% in the past year. Service to Canada and Mexico was cancelled due to travel restrictions. Mr. Gaskins introduced new carrier, Spirit Airlines. This decision to bring a new entrant was decided by the Airport Director. Spirit was allocated three Average Daily Departures (ADDs) and plan to operate the Airbus A320neo aircraft. Mr. Gaskins shared the Airport expects quieter aircraft to operate at JWA in future years as carriers shift to newer technology aircraft. Mr. Gaskins shared that the Access and Noise Office is currently working on capacity allocations for Plan Year 2021. He also mentioned the Million Annual Passenger (MAP) increase to 11.8 and the ten additional ADDs, effective January 1, 2021. Mr. Gaskins also explained that due to the pandemic, it does not appear that the Airport will near the 11.8 MAP in the next two to three years. Mr. Gaskins stated that Plan Year 2021 allocations will be submitted to the Airport Commission on October 21, 2020 and will then be going to the Board of Supervisors on November 3, 2020. Also, Mr. Gaskins mentioned that JetSuiteX did submit a capacity allocation request to operate from an FBO terminal. Per the new FBO lease agreements, Regularly Scheduled Air Service is not permitted to at an FBO terminal. Dr. Jim Mosher asked when changes would go into effect regarding FBO terminal service. Mr. Gaskins informed Mr. Mosher that changes would take place starting January 1, 2020. Dr. Mosher asked if the construction taking place at Jay's Maintenance was part of the FBO construction that is due to take place. Mr. Gaskins did not have specifics on the schedule for construction regarding Jay's Maintenance. Mr. Gaskins advised 4t" quarter would be waived, however in the upcoming year, carriers will be required to return capacity since minimums will not be waived. Dr. Mosher asked where load factors currently stand. Mr. Gaskins informed Dr. Mosher load factors are in the mid-sixties. Mr. Gaskins also mentioned that some carriers are blocking seats and other carriers do not have high load factors or have decreased in frequency. Dr. Mosher then asked if Delta was blocking seats. Anthony Cangey advised Mr. Mosher that he believes Delta is also blocking seats. Mr. Gaskins shared that Harris Miller Miller& Hanson, Inc. (HMMH) has been hired as the Airport's acoustical engineering consultant, effective September 2020. Dr. Mosher asked if they would be doing monitor calibrations. Mr. Gaskins informed Dr. Mosher, BridgeNet International completes annual calibrations for noise monitoring stations. Dr. Mosher mentioned that the current contour photo should be updated to show correct information regarding number of people, as well as correcting the quarterly noise report title page. Mr. Gaskins informed changes will be made in future quarterly noise reports. A discussion was held regarding current number of staff and Orange County hire freeze.
