SUBJECT: FINAL PARCEL MAP 2005-175
SUMMARY
Final Parcel Map 2005-175 is a request to merge two parcels to create one 1.186 acre
parcel at 12741-12791 Newport Avenue for the development of a 20,000 square foot
medical office building. On September 19, 2005, the City Council approved Tentative
Parcel Map 2005-175 by adopting Resolution No. 05-100. All conditions associated with
the tentative map approval have been fulfilled and the final map may be approved and
recorded. (Owner/Applicant: Newport Medical Partners, LlC)
RECOMMENDATION:
That the City Council adopt Resolution No. 06-30 approving Final Parcel Map 2005-175.
FISCAL IMPACT:
Final Parcel Map 2005-175 is an applicant-initiated project. The applicant has paid
applicable fees for the processing of this map.
ENVIRONMENTAL:
Final Parcel Map 2005-175 is Categorically Exempt pursuant to Section 15315, Class 15
of Title 14, Chapter 3 of the California Code of Regulations (Guidelines for the California
Environmental Quality Act).
BACKGROUND:
The site is located west of Newport Avenue, zoned as Planned Community District, and
regulated by the Newport Warren Planned Community district regulations (Attachment A
- Location Map).

On September 12, 2005, the Planning Commission held a public hearing and adopted
Resolution No. 3996 recommending approval of Tentative Parcel Map 2005-175 to the
City Council, and on September 19, 2006, the City Council approved Tentative Parcel Map
2005-175 by adopting Resolution No. 05-100.
DISCUSSION:
The project site is comprised of two (2) parcels (Parcel A and B). Parcel A is located on
the south side of the project site and previously was improved with an existing office
building. Existing on Parcel A is also an easement for ingress, egress, and maintenance
of the City's water well located at the northeast corner of Parcel A. This easement will be
relocated to the north of the City's water well to accommodate the construction of the new
office building approved under Design Review 05-007. The City's Engineering/Public
Works Department has reviewed and approved the new location of the ingress, egress,
and maintenance easement. Parcel B is located on the north side of the project site and is
currently vacant.
Final Parcel Map 2005-175 would combine the two (2) parcels into one (1) parcel. The
new parcel complies with all the development standards under the Newport Warren
Planned Community District including building site area and lot width. City staff has
reviewed Final Parcel Map 2005-175 and has determined that the map is in substantial
conformance with the City Council's approval of Tentative Parcel Map 2005-175, the
City's Zoning Code and Subdivision Code, and the State Subdivision Map Act.
Staff recommends that the City Council approve Final Parcel Map 2005-175, subject to
final approval of the City Engineer prior to recordation.

RESOLUTION NO. 06-30
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN APPROVING FINAL PARCEL MAP 2005-175 TO
COMBINE TWO (2) PARCELS TO CREATE ONE (1) PARCEL
1.186 ACRES IN AREA LOCATED AT 12741 AND 12791
NEWPORT AVENUE (ASSESSOR PARCEL NUMBERS 401-
211-53,401-211-57, AND 401-211-71)
The City Council of the City of Tustin does hereby resolve as follows:
I. The City Council finds and determines as follows:
A. That a proper application for Final Parcel Map No. 2005-175 was submitted
by Newport Medical Partners, LLC. requesting approval to combine two (2)
existing parcels to create one (1) 1.186 acre parcel located at 12741 and
12791 Newport Avenue (Assessor Parcel Numbers 401-211-53, 401-211-
57, and 401-211-71);
B. That on September 12, 2005, the Planning Commission adopted
Resolution No. 3996 recommending that the City Council approve
Tentative Parcel Map 2005-175; and the City Council approved Tentative
Parcel Map 2005-175 on September 19, 2006, by adopting Resolution No.
05-100;
C. That the public easement within Book 10941, Page 214, of Official Records,
Records of Orange County, California is hereby abandoned;
D. That an easement for ingress, egress, and maintenance and pedestrian
easements as dedicated are hereby accepted;
E. That the proposed subdivision is in conformance with the Tustin General
Plan land use designation of Planned Community Commercial/Business
and Newport Warren Planned Community Zoning District in that these
designations provide for the development of offices;
F. That the site is physically suitable for the type and density of development
proposed;
G. That the design of the subdivision or the types of improvements proposed
are not likely to cause serious public health problems;
H. That the parcel map or the proposed improvements are not likely to cause
substantial environmental damage or substantially and avoidably injure fish
or wildlife in their habitat;
I. That the proposed subdivision is in conformance with Tentative Parcel
Map 2005-175, the Tustin Area General Plan, Tustin Zoning Code, State
Subdivision Map Act, the City's Subdivision Code, and has been
determined to be consistent with the Air Quality Sub-Element; and,
J. That Final Parcel Map 2005-175 is Categorically Exempt (Class 15) from
the provisions of the California Environmental Quality Act pursuant to
Section 15315 of Title 14, Chapter 3 of the California Code of Regulations
(Guidelines for the California Environmental Quality Act).
II. The City Council hereby approves Final Parcel Map 2005-175 to combine two
parcels to create one parcel 1.186 acres in area located at 12741 and 12791
Newport Avenue subject to final review and approval by the City Engineer and
the City Attorney prior to recordation.
PASSED AND ADOPTED at a regular meeting of the Tustin City Council held on the
6th day of March, 2006.
