RESOLUTION NO. 06-30
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN APPROVING FINAL PARCEL MAP 2005-175 TO
COMBINE TWO (2) PARCELS TO CREATE ONE (1)
PARCEL 1.186 ACRES IN AREA LOCATED AT 12741 AND
12791 NEWPORT AVENUE (ASSESSOR PARCEL
NUMBERS 401-211-53,401-211-57, AND 401-211-71)
The City Council of the City of Tustin does hereby resolve as follows:
I.
The City Council finds and determines as follows:
A.
That a proper application for Final Parcel Map No. 2005-175 was
submitted by Newport Medical Partners, LLC. requesting approval to
combine two (2) existing parcels to create one (1) 1.186 acre parcel
located at 12741 and 12791 Newport Avenue (Assessor Parcel Numbers
401-211-53, 401-211-57, and 401-211-71);
B.
That on September 12, 2005, the Planning Commission adopted
Resolution No. 3996 recommending that the City Council approve
Tentative Parcel Map 2005-175; and the City Council approved Tentative
Parcel Map 2005-175 on September 19, 2006, by adopting Resolution No.
05-100;
C.
That the public easement within Book 10941, Page 214, of Official
Records, Records of Orange County, California is hereby abandoned;
D.
That an easement for ingress, egress, and maintenance and pedestrian
easements as dedicated are hereby accepted;
E.
That the proposed subdivision is in conformance with the Tustin General
Plan land use designation of Planned Community Commercial/Business
and Newport Warren Planned Community Zoning District in that these
designations provide for the development of offices;
F.
That the site is physically suitable for the type and density of development
proposed;
G.
That the design of the subdivision or the types of improvements proposed
are not likely to cause serious public health problems;
H.
That the parcel map or the proposed improvements are not likely to cause
substantial environmental damage or substantially and avoidably injure
fish or wildlife in their habitat;

I.
That the proposed subdivision is in conformance with Tentative Parcel
Map 2005-175, the Tustin Area General Plan, Tustin Zoning Code, State
Subdivision Map Act, the City's Subdivision Code, and has been
determined to be consistent with the Air Quality Sub-Element; and,
J.
That Final Parcel Map 2005-175 is Categorically Exempt (Class 15) from
the provisions of the California Environmental Quality Act pursuant to
Section 15315 of Title 14, Chapter 3 of the California Code of Regulations
(Guidelines for the California Environmental Quality Act).
II. The City Council hereby approves Final Parcel Map 2005-175 to combine two
parcels to create one parcel 1.186 acres in area located at 12741 and 12791 Newport
Avenue subject to final review and approval by the City Engineer and the City Attorney
prior to recordation.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 6th day of March, 2006.
