RECOMMENDATION: That the Planning Commission adopt Resolution No. 4424 determining that the proposed location for lease of approximately 120,000 square feet of industrial office space for the County of Orange, Sheriff-Coroner's Technology Division and Emergency Call Center, located at 1382 Bell Avenue, is in conformance with the City of Tustin's (the City) General Plan. DocuSign Envelope ID: BB7C4AC1-B763-4545-966C-79202E78606D Planning Commission Report GPC 2021-0003 April 13, 2021 Page 2 APPROVAL AUTHORITY: Pursuant to Section 65402(b) of the Government Code, the Planning Commission is authorized to determine whether the location, purpose, and extent of the proposed acquisition or disposition of real property or authorization of a public building by a county is consistent with the General Plan. BACKGROUND AND DISCUSSION: Section 65402(b) of the California Government Code (State Planning and Development Law) requires counties to inform and obtain general plan conformity from the local planning agencies prior to acquisition or disposition of real property or authorization of a public building. The County of Orange, Sheriff-Coroner (OC Sheriff) is proposing to enter into a lease agreement for approximately 120,000 square feet located 1382 Bell Avenue (Figure 1). a LL: •vim $ ` , s.: „� ' . •c 1382 Bell Avenue R4p t gyy -r. 21 '4 Figure 1- Location Map The OC Sheriff proposes to use the subject property for its Technology Division that includes Communications, and will house equipment and allow for specialized technical operations, repairs and servicing using various high technology equipment, Real-Time Crime-Center equipment and operations; and an Emergency Call Center with its equipment and operations; plus servicing communications equipment on motorcycles, DocuSign Envelope ID: BB7C4AC1-B763-4545-966C-79202E78606D Planning Commission Report GPC 2021-0003 April 13, 2021 Page 3 patrol cars, SUVs and fire engines for numerous law enforcement within the warehouse (Attachment C). The subject property would be operated 24 hours/7 days a week, with high security standards that would include a security fence and security gates at both front driveway areas; and no public access. The City's General Plan Land Use Map classifies the proposed site as "Industrial". The Industrial designation provides for a mix of industrial and office uses such as wholesale businesses, light manufacturing, storage, distribution and sales, research and development laboratories, and service commercial business. The proposed lease of the subject property by the OC Sheriff supports the City's General Plan Land Use and Public Safety Elements, including the following: 1. Land Use Element Goal 8: Ensure that necessary public facilities and services are available to accommodate development proposed on the Land Use Policy Map. 2. Public Safety Element Goal 8: Improve the City's ability to respond to natural and man-made emergencies. The leasing of the subject property by the OC Sheriff would enable critical and highly specialized equipment to be used in support of its operations to provide greater security for the City of Tustin and County of Orange. As such, the location, purpose, and extent of the proposed lease is in conformance with the City's General Plan and the Land Use Policy Map. CONCLUSION: Staff recommends that the Planning Commission adopt Resolution No. 4424 (Attachment D), making the determination that the location, purpose, and extent of the proposed use and lease of the property are in conformance with the City's General Plan. For Parking,the Staffing,Conference and Staging of Vehicles —"Occupancy/Staging Vehicle Count" is as follows: 88 Maximum staff(vehicles) onsite at any given time, including under emergencies circumstances 150 Trainees (vehicles)maximum at large conference room 100 Staging of vehicles for Technology, Communications. & Servicing 338 Total maximum vehicles as the Occupancy/Staging Vehicle Count Therefore, when comparing the maximum existing Parking Spaces of 362 to the maximum Occupancy/Staging Vehicle Count of 338, there is deemed to be sufficient parking spaces at this Industrial/Warehouse Facility to meet the needs of our use. Furthermore, use of this Facility by the OC Sheriff-Coroner will enable critical and highly specialized equipment to be used in support of its operations to be performed for potentially 20 to 30 years under the proposed Lease providing greater security for the City of Tustin, County of Orange, State of California and the United States. Therefore, respectfully, the OC Sheriff-Coroner requests that you please review this proposal in accordance with Government Code Section 65402 to determine if the Technical and Servicing uses conform with the City's General Plan. To simplify processing of this General Plan Conformity request for our proposed Lease, you may complete the bottom portion of this letter and return it to my attention. Additionally, in order to help streamline our transactional processing time, we ask that the City please waive the Forty-Five days' Notice period for General Plan Conformity. The Planning Commission does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A. That the County of Orange, Sheriff-Coroner proposes to enter into a lease agreement for the use of approximately 120,000 square foot of industrial office space for its Technology Division and Emergency Call Center at 1382 Bell Avenue within the Planned Community Industrial (PC-IND) zoning district. B. That California Government Code Section 65402(b) provides that a county shall not acquire or dispose of any real property or authorize a public building within the corporate limits of a city until the location, purpose, and extent of the project has been reported by the local planning agency as to the conformity with the applicable, adopted general plan. C. That the proposed lease of the subject property is consistent with Land Use Goal 8, and would ensure that necessary public facilities and services are available to accommodate development proposed on the Land Use Policy Map. D. That the proposed lease of the subject property is consistent with Public Safety Element Goal 8, and would improve the City's ability to respond to natural and man-made emergencies. E. That General Plan Conformity determinations required by Government Code Section 65402 are not "projects" requiring environmental review pursuant to the California Environmental Quality Act. II. The Planning Commission hereby determines that that the location, purpose, and extent of the proposed lease for use of approximately 120,000 square feet of industrial office space by the County of Orange, Sheriff-Coroner for its Technology Division and Emergency Call Center at 1382 Bell Avenue is in conformance with the Tustin General Plan.
