West provided an overview and introduced Jan Perkins Vice President of Management Partners who facilitated the workshop. VI. REVIEW BACKGROUND INFORMATION — Management Partners provided background information. VII. DISCUSS PRIORITIES IDENTIFIED BY COUNCIL MEMBERS — Management Partners facilitated the discussion of priorites of the Council Members. VIII. DETERMINE PRIORITIES FOR FEASIBILITY ANALYSES — Management Partners facilitated the discussion to determine priorities for the feasibility analyses. Recessed at 6:25 p.m. Reconvened at 6:46 p.m. Management Partners provided the City Council with a link to Mentimeter to poll their interest in determining which items will be priorities for the feasibility analyses. It was moved by Mayor Pro Tem Lumbard and seconded by Mayor Clark to move forward with the feasibility analyses for all items in the poll which received three or more members' interest: #1 Make Further Progress on Tustin Legacy Project, #2 Enhance Old Town, #3 Improve Red Hill Corridor, #4 Update Housing Element, #5 Support Development of Housing, #7 Streamline Development Process, #10 Initiate General Plan Amendment Process, and #11 Advance the Neighborhood Parking Permit Program. REVIEW SCHEDULE — Management Partners reviewed the schedule regarding next steps. X. WRAP UP/CLOSING COMMENTS Mayor Clark Thanked Jan Perkins and Jarrod Burguan of Management Partners for their time and expertise; thanked city staff for their support; the Strategic Plan needed to be reviewed and revised due to the changes in the world; appreciated everyone's transparency and honesty; announced although the Council has set these items as priorities, there are opportunities for the Council to work on other highlighted items in workshop over time; thanked everyone for their time and commitment; announced the second Strategic Plan Workshop will be held on May 12, 2021 . Mayor Pro Tem Lumbard Appreciated hearing the different perspectives from Council colleagues; new ideas were discussed with the new Council; the use of the Mentimeter tool was helpful to see the direction Council Members agree on with certain priorities; appreciated the candor and honesty on their priorities; announced Council wants to hear ideas from the community; will pay attention to the needs of community especially with the big-ticket items. Council Member Cooper Was hopeful for a civil conversation to agree or disagree; the discussion was handled respectfully and appreciated the process. Council Member Gallagher Stated at the beginning of the Strategic Plan Workshop meeting, each Council Member started with three different words to describe their vision of Tustin; during the meeting all five Council Members agreed the vision of Tustin can be accomplished by the three items highlighted during the meeting; found the process effective and a great use of time; great to hear from fellow Council Members; thanked City Manager Matthew S. West for his leadership; thanked Management Partners for helping the Council with this process. Council Member Gomez Thanked city staff and Management Partners for helping the Council with the process; was difficult to have a robust dialogue through Zoom, but great options and priorities were achieved; informed the public there are more workshops occurring in the future; dates for the upcoming workshops can be found on the informational post card that was mailed out; encourages everyone to participate in these activities; announced Council does hear Tustin residents and wants to continue to hear from the public to help make decisions. West Expressed that the Strategic Plan Workshop was extremely helpful in setting priorities on what needs to get done; happy to have a consensus with the Council; is prepared to look at the priorities highlighted in the workshop and bring them back to the City Council for advancement; thanked Jan Perkins, Jarrod Burguan and Ashley Garcia of Management Partners and thanked Assistant City Manager Nicole Bernard. CONSENT CALENDAR ITEMS 1-10 — Mayor Clark stated for the record that the Council received two revised resolutions for Items 5 and 7 (Resolution No. 21-25 and 21-27) to reflect the new 6:00 p.m. start time of the Regular Meetings provided Item 10 is approved. It was moved by Mayor Pro Tem Lumbard and seconded by Council Member Gomez to pull Items 5 and 7 and approve the balance as recommended by staff. Roll Call — City Clerk Motion carried: 5-0 1. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA Motion: The City Council waived reading in full of all ordinances and resolutions on the agenda and declared that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. APPROVAL OF MINUTES — THE REGULAR MEETING OF THE CITY COUNCIL HELD ON APRIL 6, 2021. Motion: The City Council approved the Action Minutes of the Regular Meeting of the City Council held on April 6, 2021 . 3. RATIFICATION OF PAYROLL AND DEMANDS The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Motion: The City Council approved Payroll in the amount of $827,860.81 and $825,734.99; and Demands in the amount of $2,516,197.46. 4. POLICE DEPARTMENT VEHICLE PURCHASE One (1) Police Department motorcycle, and one (1) Police Department unmarked vehicle need replacement. Additionally, there will be a need to award a contract for police equipment conversion work for the newly purchased police units. Motion: The City Council authorized: 1 . The purchase of one (1) 2021 BMW R1250RT-P police motorcycle from Iry Seaver Motorcycles in Orange, California in the amount of $28,623.89 (including tax, license fees, delivery, and police equipment installation). 2. The purchase of one (1) 2021 Jeep Grand Cherokee vehicle from Elk Grove Automotive in Elk Grove, California in the amount of$56,645.00 (including tax, license, fees, and delivery). 3. The purchase of police equipment conversion package for one (1) Jeep Grand Cherokee from Hi-Standard Automotive in the City of Orange, California in the amount of $5,711 .45. 4. The Public Works Department will dispose of the retired surplus vehicles at the next public auction, and credit the net proceeds to the applicable City Revenue Fund. 5. ADOPT RESOLUTION NO. 21-25 DECLARING THE INTENTION TO FORM THE TUSTIN LANDSCAPE AND LIGHTING REASSESSMENT DISTRICT 2021 REPLACING THE EXISTING TUSTIN LANDSCAPE AND LIGHTING DISTRICT The Tustin Landscape and Lighting District was formed in 1985 to fund the maintenance of perimeter landscaping on the arterial highways and for the operation and maintenance of street lighting on public streets within the Tustin Ranch area. Assessments for the benefiting properties were first confirmed for Fiscal Year 1985- 1986 and each fiscal year thereafter. Assessments collected through the District do not cover the cost of maintenance. Surplus bond funds have been used since Fiscal Year 2009-2010, as allowed by the California Streets and Highways Code, to fully fund annual maintenance needs within the District boundaries. The surplus funds are nearly exhausted and a new Tustin Landscape and Lighting Reassessment District 2021 will need to be formed to ensure annual revenue is not less than expenses. At the April 6, 2021 meeting, the City Council ordered the preparation of an Engineer's Report for the Levy of Annual Assessments for the Tustin Landscape and Lighting Reassessment District 2021 . Council Member Gomez recused herself from Items 5 and 7 due to a conflict of interest. It was moved by Mayor Pro Tem Lumbard and seconded by Council Member Gallagher to adopt Resolution No. 21-25 declaring the intention to form Tustin Landscape & Lighting Reassessment District 2021 replacing the existing district as of Fiscal Year 2021-2022 and to levy assessments commencing with Fiscal Year 2021-2022, accepting and approving the Engineer's Report, ordering a property owner official assessment ballot proceeding, and setting a Public Hearing for June 15, 2021 . AUTHORIZATION TO ABANDON AND DESTROY TUSTIN AVENUE WELL The Water Enterprise owns and operates the Tustin Avenue Well site located at 1822 N. Tustin Avenue, Santa Ana, California. The well was drilled in 1952 and has consistently and reliably served the Tustin Water Service customers for the last 70 years. In October 2020, the well was taken out of service for water quality concerns associated with groundwater basin impacts related to Pre- and Polyfluoroalkyl (PFAS). Wellhead treatment and centralized well treatment have been determined to be infeasible and it is recommended the well be properly abandoned. Motion: The City Council authorized the abandonment of the Tustin Avenue Well. 7. APPROVE THE ENGINEER'S REPORT FOR THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT AND SET A PUBLIC HEARING TO CONSIDER LEVYING FISCAL YEAR 2021-2022 ASSESSMENTS At the April 6, 2021 meeting, the City Council ordered the preparation of an Engineer's Report for the Levy of Annual Assessments for the Tustin Landscape and Lighting District. The Engineer's Report has now been completed and is ready for City Council approval. Additionally, it is requested that the City Council declare its intention to levy annual assessments and set a public hearing for June 15, 2021 . Council Member Gomez recused herself from Items 5 and 7 due to a conflict of interest. It was moved by Mayor Pro Tem Lumbard and seconded by Council Member Gallagher to approve the following: 1 . Adopt Resolution No. 21-26 approving the Engineer's Report for the Tustin Landscape and Lighting District for Fiscal Year 2021-2022; and 2. A RESOLUTION WAIVING NOTIFICATION REQUIREMENTS OF GOVERNMENT CODE SECTION 25351 FOR A PROPOSED OC SHERIFF FACILITY AT 1382 BELLAVENUE The County of Orange, Sheriff-Coroner, (OC Sheriff), has requested that the City Council waive the 60-day notification period required by California Government Code Section 25351 related to the County's proposed lease of the building at 1382 Bell Avenue for its Technology Division and Emergency Call Center. On April 13, 2021 , the Planning Commission adopted Resolution No. 4424 determining that the proposed location for lease of approximately 120,000 square feet of industrial office space for the County of Orange, Sheriff-Coroner's Technology Division and Emergency Call Center, located at 1382 Bell Avenue, is in conformance with the City of Tustin (the City) General Plan. APPLICANT: COUNTY OF ORANGE, SHERIFF-CORONER PROPERTY OWNER: GVI-SW BELL AVE OWNER, LLC, A DELAWARE LIMITED LIABILITY COMPANY Motion: The City Council adopted Resolution No. 21-28, waiving the notification requirements of California Government Code Section 25351 regarding the proposed lease of property by the County of Orange, Sheriff-Coroner, and finding the lease consistent with the City's General Plan. ADJUST START TIME OF REGULAR CITY COUNCIL MEETINGS Consider adopting Resolution 21-29 to adjust the start time of regular meetings of the Tustin City Council from 5:30 p.m. to 6:00 p.m. Motion: The City Council adopted Resolution 21-29 to establish a 6:00 p.m. start time for the open session regular meetings of the City Council. PUBLIC HEARING ITEM 11 11. COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) ONE YEAR ACTION PLAN FOR PROGRAM YEAR 2021-22 AND AMENDMENT TO 2020-21 ACTION PLAN Assistant Director of Community Development Irma Huitron provided a PowerPoint presentation. The Housing and Community Development Act of 1974, as amended, established the Community Development Block Grant (CDBG) program to return federal funds to local communities for the purpose of developing viable urban communities by providing decent housing, suitable living environments, and by expanding economic opportunities, specifically for low and moderate-income persons. To participate in the CDBG program, the City is required to prepare a Consolidated Plan that identifies needs for affordable and supportive housing, community development, public services, and economic opportunities. The Consolidated Plan is required every five years, and was most recently adopted on April 21 , 2020. Annually, the City is also required to prepare a one year Action Plan that implements the goals and objectives contained in the Consolidated Plan. The proposed 2021-22 Action Plan set forth in Resolution No. 21-22 (Attachment A) fulfills this annual requirement. On February 16, 2021 , the Tustin City Council held a public hearing for the 2021-22 Action Plan preparation process. The purpose of the hearing was to inform interested citizens about the CDBG program, obtain citizens' views on CDBG priorities, and receive a report on the performance of the current public service CDBG fund recipients (also known as non-profit subrecipients). During this meeting, the City Council recommended continued funding to all twelve (12) existing non-profit subrecipients. The City of Tustin is also proposing to amend its current 2020-21 Action Plan, reallocating CDBG funds from an activity which is now complete, and no longer being funded by CDBG (Peppertree Park Improvements project), to an existing activity which would allow the City to utilize these funds to prevent, prepare for, or respond to COVID-19 (Emergency Response Funding project). April 12 Attended the Orange County Sanitation District (OCSD) Groundwater Replenishment System Steering Committee meeting; 300-million-dollar project about half way complete; set to be completed by March 2023; is a vital water resource for Tustin; the project is expanding the plant from 100 Million Gallons per Day (MGD) to 130 MGD; the largest plant of its kind in the world. Council Member Gomez April 7 Attended the Peppertree Park Re-opening Ribbon Cutting; was good to see everyone in the park; the park looks great, great to have it open for the neighborhood; within minutes of opening, children were eager to see the park. April 15 Attended the Orange County Mosquito and Vector Control District meeting; a presentation on the summer campaign was given; announced this week is California Mosquito Awareness week, everyday they are highlighting a different activity that prevents mosquitoes; announced National Mosquito Awareness week starts on June 21St; announced Tustin will be participating in the summer campaign posts on the City's social media and webpages; will connect with the City's public information office to discuss further; discussed during Closed Session the facility expansion; thanked the Orange County Mosquito and Vector Control District for participating in Tustin's Hoppy Easter event; announced the upcoming budget presentation will be held in May. Attended the Tustin Police Department's promotional ceremony; congratulated Tustin's new Police Officers, Officer Tyler Wackerman, Officer Gabriel Santos, and Officer Joseph Sanchez who were sworn in over the past couple of weeks. Council Member Cooper Visited Families Together of Orange County Clinic this past week; COVID-19 vaccines were distributed to the public; announced the wait time was roughly twenty minutes per person; they educate you as they walk you through the process; thanked Families Together of Orange County Clinic and Soledad Rivera, Director of Business Development for Families Together of Orange County. Council Member Gomez Announced received the COVID-19 vaccine at the Families Together of Orange County Clinic; thanked them for their smooth process; thanked Council Member Cooper for his praise on the Families Together of Orange County Clinic. Mayor Pro Tem Lumbard April 7 Attended the Peppertree Park Re-opening Ribbon Cutting; happy to have the public be able to utilize and enjoy the new equipment; thanked city staff and contractors for the fantastic job on the Peppertree Park project. April 14 Attended the City Council Strategic Plan Workshop; was the first of two workshops; had a welcome discussion; good collaboration; Tustin stands out among many cities in the County and State; appreciates the friendships and collegiality on the City Council, as well as being able to disagree and still maintain a respectable dialog among each other. West and the Public Works staff for their hard work on the project; was a collaborative effort; a job well done. April 15 Attended the weekly Meals on Wheels program distribution at the Tustin Senior Center; cars received three days worth of meals; is an important program that brings not only food, but community to the senior citizens; announced the Tustin Senior Center is an important aspect for the community; senior citizens in the Tustin community are eagerly waiting to be back in-person to enjoy the facility. April 17 Attended the Parks and Recreation Department and the Orange County Heritage Council's food distribution with Council Member Gomez; over 1 ,000 boxes of food were distributed; thanked the Tustin Community Foundation for their volunteer support, the public was thankful; provided a great need to the community. April 14 Attended the City Council Strategic Plan Workshop; was a smooth meeting; the public was happy to participate; welcomes comments on how to advertise these public forums; the postcard distribution went well; asked the public to please let the Council know if they can conduct outreach in a different way.
