CALL TO ORDER: 10:00 a.m. (via Zoom) ROLL CALL: Justina L. Willkom, Zoning Administrator PUBLIC CONCERNS: None CONSENT CALENDAR: None PUBLIC HEARING: Opened the Public Hearing at 10:03 a.m. 1. CONDITIONAL USE PERMIT (CUP) 2021-0004 APPLICANT: PROPERTY OWNER: Charles Bittle Tustin Market Place LLC Chevon USA, Inc. c/o The Irvine Company LLC PO Box 6003 550 Newport Center Drive San Ramon, CA 94583 Newport Beach, CA 92660 LOCATION: 2740 Bryan Avenue REQUEST: To authorize the sale of off-site alcoholic beverages in conjunction with an existing service station convenience store. ENVIRONMENTAL STATUS: This project is Categorically Exempt (Class 1) pursuant to Section 15301 of the California Environmental Quality Act. RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action (ZAA) 21-003 approving CUP 2021-0004 to authorize the sale of off-site alcoholic beverages in conjunction with an existing service station convenience store. The Zoning Administrator asked all Zoom attendees to identify themselves for the record. Charles Bittle (applicant), Steve Rawlings (Chevron representative), Elia Ruth Abonasser (Chevron Business Consultant), Brie Gallagher (Chevron Operations Manager), Irma Huitron (Assistant Director), Scott Reekstin (Principal ZA Action Minutes May 6, 2021 Page 2 Planner), Jessica Aguilar (Associate Planner), and Vera Hurtado (Recording Secretary) were all in attendance. The Zoning Administrator opened the Public Comments section at 10:03 a.m. Hurtado confirmed there were no phone calls or emails received, from the public, for this item. The Zoning Administrator stated she had reviewed the staff report and did not need a presentation. She also summarized what was being proposed during the meeting. She asked the applicant if he had an opportunity to review the Conditions of Approval. Mr. Rawlings confirmed he did review the Conditions of Approval, but he requested language be added to Section F7 of the Conditions of Approval with regards to the public convenience or necessity. He proposed a sentence be added to Section F7 stating "therefore a public convenience or necessity would be served" or something similar, in order to abide by the ABC Guidelines. Justina referred to Section F7 of the Conditions of Approval and asked Mr. Rawlings if the language was not clear enough. She agreed with Mr. Rawlings proposal, therefore she proposed adding language to Section F7 of the Conditions of Approval as follows, "the City is making the findings and will serve a public convenience or necessity." Mr. Rawlings did agree the finding was clear, but he did not have a chance to review with ABC so he wanted to make sure the language follows the ABC Guidelines. He also wanted to ensure the language was clearer. Mr. Rawlings added that "the City of Tustin is a pleasure to do business with". Hurtado confirmed at 10:11 a.m.that there were no phone calls or emails received from the public for this item. The Zoning Administrator provided the recommended action, for the record. The Zoning Administrator adopted ZAA 21-003. The Zoning Administrator closed the Public Comments section at 10:11 a.m. The Public Hearing item was closed at 10:11 a.m. REGULAR BUSINESS: None ADJOURNMENT: The date of the next meeting of the Zoning Administrator will be scheduled when items are set for hearing.
