CALL TO ORDER: 10:01 a.m. (via Zoom) ROLL CALL: Justina L. Willkom, Zoning Administrator PUBLIC CONCERNS: None CONSENT CALENDAR: None PUBLIC HEARING: Opened the Public Hearing at 10:02 a.m. 1. CONDITIONAL USE PERMIT (CUP) 2021-0005 APPLICANT: PROPERTY OWNER: Devin Dugan Jonathan M. Povey ImprovCity on behalf of Celest Povey 560 EI Camino Real P.O. Box 985 Tustin, CA 92780 Verdi, NV 89437 LOCATION: 138 West Main Street REQUEST: To authorize accessory live entertainment performed by students and instructors of the instructional studio facility. ENVIRONMENTAL STATUS: This project is Categorically Exempt (Class 1) pursuant to Section 15301 of the California Environmental Quality Act. RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action (ZAA) 21-002 approving CUP 2021-0005 to establish accessory live entertainment performed by students and instructors of an instructional studio facility located at 138 West Main Street. The Zoning Administrator asked all Zoom attendees to identify themselves for the record. Devin Dugan, applicant, Irma Huitron, Assistant Director, Scott Reekstin, Principal Planner, Elaine Dove, Senior Planner and Vera Hurtado, Recording Secretary were all in attendance. Zoning Administrator Agenda April 29, 2021 Page 2 Hurtado confirmed, at 10:02 a.m., that there were no phone calls or emails received, from the public, for this item. The Zoning Administrator opened the Public Hearing at 10:03 a.m. The Zoning Administrator summarized the proposed project, for the record. She stated she had reviewed the staff report and did not need a presentation. The Zoning Administrator asked the applicant about the proposed instructional hours and the live entertainment hours overlapping. The Zoning Administrator did receive a revised condition from staff and asked to identify what was being proposed. The Zoning Administrator also asked staff if they provided the revised condition to the applicant for his review and approval, and if he agreed with the amendment. The Zoning Administrator also mentioned there being adequate parking to accommodate all of the uses that the applicant was proposing. Dove explained the proposal was to have a 15-minute intermission in between classes and that there would be no overlap between live entertainment and classes. Mr. Dugan confirmed he did receive the revised condition and he approved. He agreed with the amendment. He did not have any comments or concerns. Hurtado confirmed at 10:06 a.m. that no public input, via email and/or telephone, was received. The Zoning Administrator provided the recommended action, for the record. The Zoning Administrator adopted ZAA 21-002. The Zoning Administrator closed the Public Comments section at 10:07 a.m. The Public Hearing was closed at 10:07 a.m. REGULAR BUSINESS: None ADJOURNMENT: The date of the next meeting of the Zoning Administrator will be scheduled when items are set for hearing.
