SUBJECT: APPROVAL OF PLANS AND SPECIFICATIONS AND AWARD OF A
CONTRACT FOR ANNUAL ON-CALL STREET/ALLEY REPAIR
PROGRAM FOR FISCAL YEAR 2005-2006 TO 2008-2009

SUMMARY
This contract will provide for maintenance and repair of existing citywide streets and alleys
and other miscellaneous repairs within the City right-of-way for the 2005/2006 Fiscal Year
with the option of three (3) additional one-year extensions. The plans and specifications for
the program have been prepared and are ready for Council approval. Informal bids have
been received for the project and the contract is ready for award to Hardy and Harper, Inc.
as the lowest responsible bidder at $89,230.00.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 06-34 approving the plans and
specifications for the Annual On-Call Street/Alley Repair Program and award the contract to
Hardy and Harper, Inc. the lowest responsible bidder.
FISCAL IMPACT
Funds for this project are budgeted in the Public Works Department, Account No. 403-6245
in this Fiscal Year.
BACKGROUND
The City's Street/Alley Repair Program is an annual program that provides for repairs and
replacement of damaged infrastructure such as potholes, roadways, alleys, catch basins,
curbs and gutters, sidewalks and manhole adjustments. The program provides for these
repairs on a case-by-case basis and includes unforeseen and emergency repairs that are
typically isolated, single-occurrence items. City staff prepared plans and specifications for
this Annual Program for this Fiscal Year with an option for three (3) additional one-year
extensions based upon satisfactory performance by the contractor.

The project was advertised under the uniform accounting bid process. Bids were opened on
February 14, 2006 and the six (6) bids received are summarized as follows:

Hardy and Harper, Inc. bid is approximately 12% over the engineer's estimate of $79,700.
The bid seems to be reasonable due to the fluctuation in current oil prices. The references
and the Contractor's State License for Hardy and Harper, Inc. have been checked and are
appropriate for the subject program.
The City Council is requested to approve the plans and specifications and award the bid to
Hardy and Harper, Inc. in the amount of $89,230. This contract can be extended for an
additional three-years by the Director of Public Works based upon satisfactory performance
of the contractor. Future contract prices will be adjusted annually based upon the
Consumer Price Index (CPI) for this area.

RESOLUTION NO. 06-34
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA APPROVING PLANS AND SPECIFICATIONS FOR THE
ANNUAL ON-CALL STREET/ALLEY REPAIR PROGRAM (PROJECT NO.
403-6245)
WHEREAS, it is the intention of the City Council of the City of Tustin California to
maintain existing streets and alleys and infrastructure in an acceptable condition as
needed at various locations within the City; and
WHEREAS, the City Engineer has presented plans and specifications for the
construction of said works;
NOW, THEREFORE, BE IT RESOLVED that the plans and specifications
presented by the City Engineer are hereby approved as the plans and specifications for
ANNUAL ON-CALL STREET/ALLEY REPAIR PROGRAM
FISCAL YEAR 2006-2007

BE IT FURTHER RESOLVED that this project is categorically exempt from the
requirements of the California Environmental Quality Act; Class I: Existing Facilities
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 20lh day of March 2006.
