HomeMy WebLinkAbout03 GPC AGENDA REPORT revised pgs 5 and 6 DocuSign Envelope ID:OF5C5E58-427D-44OD-AF8F-961C304E8A3D AGENDA REPORT ITEM #3 MEETING DATE: MAY 25, 2021 TO: PLANNING COMMISSION FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: FISCAL YEAR 2021-2022 CAPITAL IMPROVEMENT PROGRAM FINDING OF CONFORMANCE WITH THE GENERAL PLAN RECOMMENDATION: That the Planning Commission adopt Resolution No. 4431 finding the proposed Fiscal Year (FY) 2021-2022 Capital Improvement Program (CIP) in conformance with the General Plan pursuant to Section 65401 of the California Government Code. BACKGROUND: The Planning Commission is required to review the projects in the CIP and verify their conformance with the General Plan. The City Council will soon be adopting the FY 2021- 2022 budget and appropriate funding for the ensuing year CIP projects. There are new projects proposed in this year's CIP, as well as carry-over projects from prior years. ENVIRONMENTAL CONSIDERATION: Environmental documentation and/or clearance for most projects have been completed. Environmental documentation for the other projects will be prepared or initiated prior to start of construction. DISCUSSION: Under Section 65401 of the California Government Code, the Planning Commission is to review the list of proposed public works projects recommended for planning, initiation or construction during the ensuing year and report to the City Council as to conformity with the General Plan. Exhibit A of the attached resolution provides the capital project description, the facility and/or improvement proposed; and the General Plan Element implemented. All facilities and improvements implement one or more goals, policies and objectives of each element of the General Plan, except for the Growth Management element, which primarily amplifies and supports the goals and policies that are included in other General Plan elements. The Planning Commission finds and determines as follows: A. The Planning Commission of the City of Tustin has reviewed, as required by Section 65401 of the Government Code, a list of projects being planned or constructed in the 2021-2022 Fiscal Year (FY) by the Capital Improvement Program (CIP) for conformity with the General Plan. B. All projects, as listed in Exhibit A — General Plan Conformance Matrix, are located in the City of Tustin or within the City of Tustin Water Service area and are consistent with policies of the City. C. All legal prerequisites to the adoption of this Resolution have occurred. D. The 2021-2022 FY CIP as contained in the Draft Seven-Year CIP has been reviewed with particular regard to its conformity with the General Plan. E. Said 2021-2022 FY CIP is in conformity with the General Plan, pursuant to Section 65401 of the Government Code. The proposed CIP has been found to serve the implementation of various goals and policies of the General Plan as specifically outlined within Exhibit A. F. This Resolution shall constitute this Commission's report and recommendation to the City Council as required by the Government Code. G. The Secretary of this Commission shall certify to the adoption of this Resolution and forthwith transmit a certified copy to the City Council, as the report required to meet California Government Code 65401. II. The Planning Commission hereby finds the proposed FY 2021-2022 CIP, the projects that are referenced herein as Exhibit A, in conformance with the General Plan pursuant to Section 65401 of the Government Code.
