The proposed project is considered a major wireless facility, which is defined in TCC Section 9276b as "ground-mounted on property not within the public right of way." Pursuant to TCC Section 9276e, DR is also required for the establishment or modification of any wireless communication facility in the City and when a CUP is required, the DR authority shall be deferred to the Planning Commission. BACKGROUND: Site and Surrounding Properties The subject wireless facility is proposed on the property located at 14861 Franklin Avenue at the knuckle of Franklin and Dow Avenues (Figure 2), which currently operates as a self- storage facility under the business name "Public Storage". The property is located in the Irvine Industrial Complex Planned Community within the Planned Community Industrial (PC- IND) Zoning District and the Planned Community Commercial/Business General Plan Land Use Designation. Adjacent uses to the north and east are also industrial/commercial facilities located within the Irvine Industrial Complex and zoned PC-IND. Directly south of the property is the Orange County Flood Control District (OCFCD) Santa Ana - Santa Fe Channel, which is adjacent to the Southern California Regional Rail Authority (OCTA/SCRRA) right of way. Directly to the south across Edinger Avenue is the area planned for Neighborhood G at Tustin Legacy, which is planned to function as a transit- oriented community. .- k It y4 f1 rt ,r f�• • - •fix„ -� Figure 2 Proposed Mono-Eucalyptus Location DISCUSSION: Project Description The mono-eucalyptus wireless facility is proposed to be located at the end of a row of storage units and would occupy approximately 220 square feet of space on a concrete foundation. The applicant is proposing to establish a major wireless communications facility consisting of a sixty (60) foot tall mono-eucalyptus structure with twelve (12), eight (8) foot panel antennas, thirty-six (36) Remote Radio Units (RRUs) at antenna level, one (1) GPS antenna, one (1) microwave antenna, utility cabinets and other equipment that would be enclosed within a self-storage space immediately adjacent to the proposed mono- eucalyptus. In addition, the applicant proposes a diesel generator that would be located on a concrete foundation, next to the proposed mono-eucalyptus. As proposed and DocuSign Envelope ID:D58CCEA3-3966-497A-87C6-5E30BFE9E5F8 PC Report June 8,2021 CUP 2021-0008; DR 2021-0006 Page 4 conditioned, the outdoor diesel generator would be enclosed within a metal cabinet to dampen sound and would comply with the City of Tustin Noise Ordinance. The mono- eucalyptus "trunk" would be clad with a faux bark finish on the first twenty-five (25) feet of the pole. As conditioned, the remaining unclad pole would be painted to match the color of the faux bark. The "branches" would serve to conceal the panels and other pole-mounted appurtenances. STORAGE BLDG."T� Figure 5 Elevations DocuSign Envelope ID:D58CCEA3-3966-497A-87C6-5E30BFE9E5F8 PC Report June 8,2021 CUP 2021-0008; DR 2021-0006 Page 6 Site Selection and Height The City's Wireless Community Facility Regulations and Guidelines (TCC Section 9276 et seq.) specifies development criteria for all wireless communications facilities, such as site selection, locational criteria and guidelines, height standards, and screening criteria, etc. Section 9276f(1)states that wireless communications facilities shall be located in areas that will minimize their aesthetic intrusion into the community and that ground-mounted facilities should be located in close proximity to existing above-ground utilities or trees of comparable heights. In addition, site selection preference includes locations where existing topography, vegetation, buildings or other structures provide the greatest amount of screening. The proposed siting of the facility meets the above criteria because existing topography, vegetation, separation and the stealth design will screen the facility and minimize visual intrusion. Further, TCC 9276h encourages major wireless communications facilities to locate and/or co-locate on properties which are located within the Industrial (M)and Planned Community Industrial (PC-IND) zoning district. The proposed facility will be located within the PC-IND zoning district and is designed to allow for future colocation by another carrier on the proposed mono-eucalyptus pole. The TCC specifies distance separation requirements from a major wireless facility to a City of Tustin residential zone or land use (300 feet)and to any existing, legally established major wireless communications facility (100 feet). As proposed, the nearest residential development (Peppertree residential community) is over 450 feet away and is separated by Tustin Ranch Road and the facility would be located approximately 140 feet from an existing wireless facility (mono-palm). As proposed, the wireless communications facility will be in compliance with distance separations for both residential uses and a major wireless facility. The proposed location of the wireless communications facility provides adequate screening for the Peppertree residential community to the west and the motorists along Tustin Ranch Road and Edinger Avenue due to various topography changes and an existing hedgerow of approximately forty (40)foot trees along the southern property line. The subject property is contiguous to, but lower in elevation than, Tustin Ranch Road, which is approximately thirty-four (34) feet above the existing grade along the shared property line and approximately thirty (30) feet at the proposed facility location. As such, the elevated roadway will provide visual screening of the facility from the Peppertree and Tustin Meadows communities which are west of Tustin Ranch Road. Also, due to the elevation of the road, the speed at which vehicles are traveling, the onsite landscape buffer and stealth design, it is not likely that motorists on Tustin Ranch Road would easily discern the proposed mono- eucalyptus. The Public Works Department has reviewed the project and does not have concerns with the proposed facility's proximity to the right of way. In addition to screening from the Tustin Ranch Road overpass, the aforementioned hedgerow of approximately 40-foot (40') tall pine trees and palm trees along the southern Public Storage property line will provide sufficient screening of the proposed wireless facility along Edinger Avenue (Figure 6 & 7). The proposed maximum height of sixty (60) feet for the mono- eucalyptus is expected to be clear of the airspace easement for John Wayne Airport. Per proposed Condition of Approval No. 1.10, the applicant is responsible for obtaining any required approvals or clearances for work in any easement areas. DocuSign Envelope ID:D58CCEA3-3966-497A-87C6-5E30BFE9E5F8 PC Report June 8,2021 CUP 2021-0008; DR 2021-0006 Page 8 The applicant has provided coverage information showing AT&T signal coverage under existing conditions with and without the proposed new facility for indoor, in-vehicle and outdoor signals. (Attachment E). The maps indicate that the signals for each will improve for the area south of Edinger Avenue, where there are significant coverage gaps. Co-location on Existing Mono-Palm Facility Co-location on existing facilities is the most desired location as it reduces number of new wireless communications facilities in the community while providing the wireless communications needs of the community (TCC 9276f2). The applicant indicates that it cannot co-locate on the existing mono-palm operated by Nextel that is located approximately 140 feet from the proposed mono-eucalyptus location because: (1)AT&T and Nextel do not currently have a Master Lease Agreement with which to negotiate subleases and were therefore unable to agree to terms for colocation; (2) the mono-palm itself is not co-locatable from a structural perspective; (3) the branches of the palm only cover the top antenna array and AT&T would not be able to screen their antennas with this design; and, (4) the height that would be available to AT&T would not be sufficient to fill the significant gap in coverage in the area. In 2001, the mono-palm was designed to be lower in height, while still ensuring coverage within one and a half(1.5) miles service area, to ensure a more stealth design. At the time, the applicant acknowledged that the height would need to be taller to provide room for colocation. In addition, a future co-location would require a second carrier to be capable to flush mount antennas to the trunk, which most carriers are reluctant to do because it limits the number and type of antennas. The current applicant's request to install a new facility as opposed to co-locating on the existing mono-palm is valid as the coverage within the existing facility would be insufficient to meet its customers' needs as described herein and proper screening as a co-located facility could not be provided. Co-Location on Proposed Mono-Eucalyptus Facility by Future Providers Under Government Code Section 65850.6, a wireless co-location facility that complies with the requirements of the wireless facility ordinance and received a discretionary permit may install a future co-location on the facility without a City discretionary permit. Accordingly, if the proposed facility is approved as a co-location facility,future carrier's antennas installation at this facility would only require administrative approval through the issuance of building permits. This process allows future co-location wireless facilities to be processed more efficiently and expediently and would be in conformance with state law and TCC Section 9276f2, which identifies colocation as the first preference in determining site selection for wireless communication facilities within the City of Tustin. To ensure that co-location on the proposed facility is technically feasible in the future, staff has included Condition of Approval No.2.8 which requires the proposed pole be engineered to accommodate up to nine (9) additional antennas and conduit for a second facility to be installed, which will be verified at time of plan check and final inspection. CONCLUSION: Based on the findings within Resolution No. 4432, staff recommends that the Planning Commission adopt Resolution No. 4432 (Attachment F) approving CUP 2021-0008 and DR 2021-0006 to establish a sixty (60) foot high major wireless communication facility consisting of a stealth mono-eucalyptus and associated equipment contained within a self-storage unit adjacent to the mono-eucalyptus facility. ATTACHMENT F RESOLUTION NO. 4432 RESOLUTION NO. 4432 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING CONDITIONAL USE PERMIT 2021-0008 AND DESIGN REVIEW 2021-0006 AUTHORIZING THE CONSTRUCTION AND OPERATION OF A WIRELESS COMMUNICATIONS FACILITY CONSISTING OF A SIXTY (60) FOOT TALL MONO-EUCALYPTUS POLE AND ASSOCIATED EQUIPMENT LOCATED AT 14861 FRANKLIN AVENUE. The Planning Commission does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A. That a proper application for Conditional Use Permit (CUP) 2021-0008 and Design Review (DR) 2021-0006 was filed by Smartlink LLC on behalf of AT&T requesting authorization to construct and operate a wireless communications facility consisting of a sixty (60) foot tall mono- eucalyptus pole, twelve (12) panel antennas, thirty-six (36) remote radio units (RRUs), one (1) GPS antenna and associated equipment at 14861 Franklin Avenue. B. That the Irvine Industrial Complex Planned Community District Regulations and the Planned Community Commercial/Business (PCCB) General Plan land use designation provide for a variety of commercial and industrial uses. In addition, the project has been reviewed for consistency with the Air Quality Sub-element of the City of Tustin General Plan and has been determined to be consistent with the Air Quality Sub-element. C. That Sections 9276d and 9276e of the Tustin City Code (TCC) require approval a CUP and DR prior to the establishment of a major wireless facility. D. That a public hearing was duly called, noticed, and held for CUP 2021- 0008 and DR 2021-0006 on June 8, 2021 by the Planning Commission. E. That the establishment, maintenance, and operation of the proposed use will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, and be injurious or detrimental to the property and improvements in the neighborhood of the subject property, or to the general welfare of the City of Tustin in that: 1 . The project is consistent with Section 9276 of the TCC pertaining to wireless communication facility regulations and guidelines in that the placement of major wireless communication facilities within the Planned Community Industrial (PC-IND) zoning districts is encouraged and the facility is proposed on a portion of a property with trees of comparable heights. The proposed facility meets all of the distancing requirements outlined in Section 9276h of the TCC in that it would be more than 300 feet from any residential uses and more than 100 feet away from any legally established major wireless communication facility. The project is not in the vicinity of any sensitive or residential uses where it would create a nuisance for the people residing or working in the area. 3. The location, size, and general appearance of the proposed project is compatible with the surrounding area in that the facility, as proposed and conditioned, has been designed to minimize visual impacts to the surrounding community. The proposed facility is designed as a stealth mono-eucalyptus and the elevated Tustin Ranch Road, the existing mature trees in the adjacent landscape area, the setback of over 400 feet from Franklin and Dow Avenues, over 200 feet from Edinger Avenue will all further screen the facility. All associated cabinet equipment would be located inside a fully enclosed self-storage unit on-site. 4. The overall height of sixty (60) feet for the mono-eucalyptus faux tree would not infringe upon the Federal Aviation Administration airspace easement for John Wayne Airport. 5. As conditioned, the applicant is required to comply with the Federal Communications Commission guidelines related to radio frequency emissions and shall submit a post-installation test to confirm that the "planning and frequency coordination" of the facility was successful in not interfering with the City of Tustin's Public and Safety Radio equipment. F. The proposal will not impair the orderly and harmonious development of the area, the present or future development therein, or the occupancy as a whole. In make such findings, the Planning Commission has considered the following items: 1 . Height, bulk, and area of the proposed structure: the sixty (60) foot height of the proposed faux mono-eucalyptus wireless facility is screened by mature landscaping along the southern property line and by the Tustin Ranch Road overpass to the west. 2. Setbacks and site plan: the proposed setback of approximately 400 feet from Franklin and Dow Avenues and its location to the rear of the existing buildings adequately screens the proposed facility from public view. 3. Exterior materials and colors: The use of faux tree materials and colors disguise the proposed wireless facility. Resolution No. 4432 Page 3 4. Co-location: The proposed facility has been conditioned to evaluate requests for co-location and determine the feasibility of additional carriers on the mono-eucalyptus facility. 5. Landscape: No trees would be removed as a result of the proposed facility. 6. Signage: Only signage related to certifications and warnings will be allowed at the facility in accordance with proposed Condition of Approval No. 2.4. No advertising would be permitted on the facility. 7. Physical relationship of proposed structures to existing structures in the neighborhood: The proposed facility is significantly taller than adjacent and surrounding buildings, but is compatible as a faux mono- eucalyptus facility. 8. Appearance and design relationship of proposed structures to existing structures and possible future structures in the neighborhood and public thoroughfares: The proposed facility may be partly visible from Franklin Avenue and Tustin Ranch Road, but is screened from view by existing live trees and its stealth design. 9. Development Guidelines and criteria as adopted by the City Council: the proposed facility complies with the guidelines and criteria in TCC Section 9276. G. (1) 1.10 Operation of the wireless facility shall be in compliance with the proposed methods of operation as proposed by the applicant and noted on the plans: a. The applicant shall provide a 24-hour phone number to which interference problems may be reported. To ensure continuity on all interference issues the name, telephone number, fax number, and e- mail address of a "single point of contact" in its Engineering and Maintenance Departments shall be provided to the City's designated representative upon activation of the facility. This condition will also apply to all existing facilities (AT&T) in the City of Tustin. The applicant shall file the accessory equipment identification number, company name, person responsible for maintenance of the accessory equipment, and the phone number with the Public Works Department. b. The applicant shall ensure that licensee or other users shall comply with the terms and conditions of CUP 2021-0008 and DR 2021-0006 and shall be responsible for the failure of any licensee or other users under the control of the applicant to comply. c. (1), 2.4 The equipment shall not bear any signs or advertising devices (other (4) than certification, warning or other required seals or signage. Exhibit A Resolution No. 4432 CUP 2021-0008; DR 2021-0006 Page 4 (1), 2.5 Utilities associated with the proposed facility, which are not contained (4) within the existing storage room, such as but not limited to telecommunication and power supplies, shall be located underground or within an enclosure. (1), 2.6 All exterior treatments shall be consistent with the submitted plans and (4) noted on all construction plans and elevations submitted for Building Permit Plan Check, subject to review and approval by the Community Development Department at final inspection. (1) 2.7 The applicant shall evaluate all requests for co-location on the facility by additional carrier(s) and make a good faith determination of each such requesting carrier's compatibility with the applicant at this location. If, in the good-faith determination of the applicant, the co-location is technically compatible, then the applicant shall accommodate such additional carrier if applicable business terms can be successfully negotiated. All requests for co-location shall be reviewed and approved by the City. (1) 2.8 The proposed monopole shall be engineered to accommodate at least nine (9) additional antennas and conduit for additional wireless facility(ies) to be installed on the monopole. (1) 2.9 Aboveground accessory equipment shall be constructed or treated with appropriate materials which discourage or repel graffiti and the applicant shall be responsible for removing graffiti from accessory equipment within forty-eight (48) hours following notification. The applicant shall be responsible for costs associated with any necessary enforcement action related to graffiti removal. (4) 2.10 The outdoor equipment shall be constructed of a material that will be rust resistant (i.e., stainless steel, etc.). The utility provider shall be responsible for treating any rust by either repainting or any other method recommended by the manufacturer that eliminates the rust. (1), 2.11 The proposed antenna panels shall be painted to match the mono- (4) eucalyptus. (1) 2.12 The applicant shall be responsible for obtaining any required approvals or clearances from the applicable easement holders for access or improvements in any easement areas. (1) 2.13 All construction operations including engine warm up, delivery, and loading/unloading of equipment and materials shall be subject to the provisions of the City of Tustin Noise Ordinance, as amended, and may take place only during the hours of 7:00 a.m. until 6:00 p.m., Monday Exhibit A Resolution No. 4432 CUP 2021-0008; DR 2021-0006 Page 5 through Friday and 9:00 a.m. until 5:00 p.m. on Saturday unless the Building Official determines that said activity will be in substantial conformance with the Noise Ordinance and the public health and safety will not be impaired subject to application being made at the time the permit for the work is awarded or during progress of the work. 2.14 The outdoor diesel generator shall be enclosed within a metal cabinet to dampen sound and noise emanating from the equipment, if any, shall not exceed the City's Nosie Ordinance standards. 2.15 The monopole shall be clad with faux bark from the base to a height of at least twenty-five (25) feet. BUILDING PLAN SUBMITTAL (1) 3.1 All construction shall comply with 2019 California Building Code, California Mechanical Code, California Electrical Code, California Plumbing Code, California Green Code, California Energy Codes, California Fire Code and City Ordinances, State and Federal laws, and other regulations as adopted by the City Council of the City of Tustin. (1) 3.2 All construction shall comply with 2019 California Energy Code, section 110.10 (a)4, mandatory requirements for solar ready buildings. (1) 3.3 Prior to issuance of a Building Permit(s), payment of the most current Major Thoroughfare and Bridge Fees (for the Foothill/Eastern Transportation Corridor Agency (TCA)) to the City of Tustin (through the Public Works Department) shall be required. The fee rate schedule automatically increases on July 1st of each year. (1) 3.4 Prior to the issuance of a construction permit, the applicant shall submit a materials board for the proposed mono-eucalyptus monopole, including faux bark. PUBLIC WORKS DEPARTMENT (1) 4.1 Construction and Demolition Waste Recycling and Reduction Plan (WRRP). a. The applicant/contractor is required to submit a WRRP to the Public Works Department. The WRRP must indicate how the applicant will comply with the City's requirement (City Code Section 4351 , et al) to recycle at least 65 percent of the project waste material. b. The applicant will be required to submit a fifty-dollar ($50.00) application fee and a cash security deposit. Based on the review of Exhibit A Resolution No. 4432 CUP 2021-0008; DR 2021-0006 Page 6 the submitted Waste Management Plan, the cash security deposit will be determined by the Public Works Department in an amount not to exceed five (5) percent of the project's valuation. c. Prior to issuance of any permit, the applicant shall submit the required security deposit in the form of cash, cashier's check, personal check, or money order made payable to the "City of Tustin" FEES (1) 5.1 Within forty-eight (48) hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a CASHIER'S CHECK payable to the COUNTY CLERK in the amount of fifty dollars ($50.00) to enable the City to file the appropriate environmental documentation for the project. If within such forty-eight (48) hour period the applicant has not delivered to the Community Development Department the above-noted check, the statute of limitations for any interested party to challenge the environmental determination under the provisions of the California Environmental Quality Act could be significantly lengthened. (1) 5.2 Prior to issuance of any building permits, payment shall be made of all applicable fees, including but not limited to the following. Payment shall be required based upon those rates in effect at the time of application submittal and/or permit issuance and are subject to change. A. Building plan check and permit fees to the Community Development Department based on the most current schedule at the time of permit issuance. B. Engineering plan check and permit fees to the Public Works Department based on the most current schedule at the time of permit issuance C. OCFA plan check and inspection fees to the Community Development Department based upon the most current schedule at the time of permit issuance.
