HomeMy WebLinkAboutCC RES 21-54DocuSign Envelope ID: 3DDCD2D9-EE56-4040-B33C-70708A3ABADC RESOLUTION NO. 21-54 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING AND ADOPTING UPDATED DEVELOPMENT PROCESSING FEES AND OTHER CITY RATES, CHARGES, AND USER FEES FOR VARIOUS GOVERNMENT SERVICES The City Council of the City of Tustin, California, hereby finds, determines, declares, and resolves as follows: WHEREAS, pursuant to the provisions of the California Constitution and the laws of the State of California, the City of Tustin is authorized to adopt and implement fees, rates, and charges for municipal services; provided that such fees, rates, and charges do not exceed the estimated reasonable cost of providing such services; and WHEREAS, the City retained Willdan Financial Services to review and conduct an independent, detailed analysis of City services, the cost reasonably borne by providing those services, the beneficiaries of those services, and the revenues produced by those paying fees for those services, and to prepare a study and report setting forth the specific amount of user fees, rates, and charges; and WHEREAS, Willdan Financial Services prepared the study and report, listing the applicable direct and indirect costs for certain services provided by the City, describing the reasonable relationship between fees, rates, and charges and the services provided by the City, and setting forth the time and method for payment of the fees, rates, and charges, which is identified as the "Comprehensive User Fee Study Report", dated May 24, 2021, copies of which are on file in the City Clerk's office; and WHEREAS, the City Council conducted a study session on the Comprehensive User Fee Study Report on May 24, 2021. WHEREAS, pursuant to Government Code Section 66014, 66017, and 66018, the specific user fees to be charged for certain services must be adopted by Resolution, following notice and Public Hearing; and WHEREAS, notice of Public Hearing has been given pursuant to Government Code Section 6062a, oral and written presentations have been made and received, and the required Public Hearing has been held; and WHEREAS, the City of Tustin desires to implement new development processing fees and other user fees, rates, and charges for various governmental services provided by the City of Tustin as set forth herein; and WHEREAS, all legal prerequisites to the adoption of this Resolution have occurred. Resolution 21-54 Page 1 of 4 DocuSign Envelope ID: 3DDCD2D9-EE56-4040-B33C-70708A3ABADC NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. Adoption and Incorporation of Recitals. The recitals set forth above are true and correct and are incorporated by reference herein. SECTION 2. Approval of Fee Study. The City Council hereby approves the Comprehensive User Fee Study Report dated May 24, 2021, prepared by Willdan Financial Services, and approves the methodology for calculating and collecting the user fees and charges established therein (collectively, the "Fee Study"). A copy of the Fee Study shall be maintained on file with the City Clerk and available during regular City business hours for public inspection. SECTION 3. Adoption of User Fees. The City Council hereby approves and adopts the development processing fees and other user rates, charges, and fees set forth in the Comprehensive Fee Schedule, which is attached hereto as Exhibit "A" and incorporated herein by reference; the City Council finds that the user fees and charges established herein do not exceed the estimated reasonable cost of providing the service for which the fee is levied. SECTION 4. Subsidized Fees. The City Council finds and determines that in order to promote the public health, safety, and welfare, and to encourage members of the public to obtain required permits and inspections and to avail themselves of certain services, it is desirable and necessary to provide a general fund subsidy of certain user fees and charges. In furtherance of the policy, the City Council approves and adopts the subsidized user fees and charges set forth in the Fee Study. SECTION 5. Repeal of Conflicting Resolutions. Any and all provisions of prior Resolutions of the City Council establishing, adopting, or modifying user fees and charges for the specific services, programs, or products set forth in Exhibit "A" attached hereto, including, but not limited to, Resolution No. 08-60, are hereby repealed and replaced as of the effective date of the user fees and charges established herein; provided, however, that such repeal shall not excuse or affect the failure of any person or entity to pay any fee heretofore imposed upon such person or entity. SECTION 6. Effective Date. The user fees and charges established pursuant to this Resolution shall take effect and shall be implemented on October 1, 2021. SECTION 7. Annual Update. The City Council hereby authorizes and directs the City's Finance Director to annually review and, as appropriate, recommend to the City Council approval of an increase of the fees set forth in the Comprehensive Fee Schedule in accordance with the Consumer Price Index (CPI) reported in the month of March for the corresponding year for the Los Angeles -Long Beach -Anaheim area for all Urban Consumers. The City Council hereby directs the City Manager to submit an updated user fee study and report to the City Council at least every five (5) years following the adoption of this Resolution. SECTION 9. Environmental Exemption. The adoption of this Resolution is exempt from the California Environmental Quality Act ("CEQA") pursuant to Section 15273 of CEQA Guidelines and Section 21080(b)(8) of the Public Resources Code; and in accordance with such determination, City staff is hereby directed to file a Notice of Exemption upon adoption of this Resolution. SECTION 10. Severability. If any user fee, rate, or charge adopted or increased by this Resolution is for any reason held to the invalid or unconstitutional by the decision of any court of competent jurisdiction, such fee, rate, or charge shall be deemed a separate, distinct, and independent provision of this Resolution, and such holding shall not affect the validity of the remaining user fees, rate, and charges adopted or revised herein. The City Council hereby declares that it would have adopted the Resolution and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional. DocuSign Envelope ID: 3DDCD2D9-EE56-4040-B33C-70708A3ABADC FINANCE BUSINESS LICENSE TAX FEES (Ordinance No. 1270; 2003) Every person who engages in business within the City of Tustin and/or has an established place of business within the City limits shall pay a license tax based upon the gross receipts of business done within the City, unless otherwise specified in the City Code) see enumerated business below). Gross receipts shall be based on the prior years' receipts, or in the case of a new business, calculated on current year's estimates. Payment of business license fee and/or approval of business license does not waive or preclude any other licenses or permits required by Tustin City Code. The license tax period is calendar year January 1 through December 31. Pro -rated fees for new businesses are effective April 1, July 1 and October 1. For failure to pay the license tax when due, a penalty will be added of twenty-five percent (25%) of such license tax on the last day of each month after the due date thereof, provided that the amount of such penalty shall not exceed one hundred percent (100%) of the amount of the license tax due. STATE FEE (SB 1186) Per California Government Code Section 4467, all business license applications or renewals submitted or paid after December 31, 2012 will be subject to a state mandated $1.00 State of California Disability Access and Education Fee. STATE FEE (AB 1379) This bill would extend the operation of this fee indefinitely and, on and after January 1, 2018, and until December 31, 2023, increase the amount from $1 to $4. The bill would revert the amount of the fee back to $1 on and after January 1, 2024. The bill, in any city, county, or city and county that does not issue a business license or an equivalent instrument or permit, would require an applicant for a building permit to pay an additional fee of $4 on and after January 1, 2018, and until December 31, 2023, and an additional fee of $1 on and after January 1, 2024, for the building permit, to be collected by the city, county, or city and county that issued the building permit.
