SUBJECT: ADOPT RESOLUTION NO. 21-58 TO ACCEPT IMPROVEMENTS FOR THE
JOINT PROJECT WITH THE COUNTY OF ORANGE FOR STREET
MAINTENANCE AND CONCRETE REPAIRS WITHIN SHARED BOUNDARY
AREAS— PHASE 1, CIP NO. 70019 AND AUTHORIZE THE CITY ENGINEER TO
FILE A NOTICE OF COMPLETION
SUMMARY
Construction of the joint project with the County of Orange and City of Tustin for street maintenance
and concrete repairs located at shared boundaries - Phase 1 (CIP No. 70019) has been completed
to the satisfaction of the City Engineer and is now ready for City Council acceptance.
RECOMMENDATION
It is recommended that the City Council take the following actions:
1. Adopt Resolution No. 21-58 accepting the construction of the Joint Project with the County
of Orange and City of Tustin street maintenance and concrete repairs within shared boundary
areas - Phase 1, CIP No. 70019; and
2. Authorize the City Engineer to execute and file the Notice of Completion with the Orange
County Recorder's Office.
FISCAL IMPACT
The final construction cost for the Joint Project with the County of Orange and City of Tustin street
maintenance and concrete repairs within shared boundary areas — Phase 1, CIP No. 70019 is
$171,020.49. Sufficient funds were budgeted and appropriated in the Capital Improvement Program.
The project is part of the City's ongoing Maintenance of Effort (MOE) obligation to maintain eligibility
for Renewed Measure M (M2) funding and is funded through a combination of General Fund (Fund
200) and Measure M2 Fair Share (Fund 139).
CORRELATION TO THE STRATEGIC PLAN
Rehabilitation of roadways and repair of sidewalks contribute to the fulfillment of the City's Strategic
Plan Goal B: Public Safety and Protection of Assets. Specifically, the project implements Strategy
#5, which among other items, is to ensure continuous maintenance and improvement of public
facilities. Second is implementation of Goal D, Strategy#2 by working collaboratively with agencies
to address issues of mutual interest and concern.

DISCUSSION
On January 19, 2021, the City Council adopted Resolution No. 21-04 authorizing the use of
Ordinance No. 1438 and authorizing award of a construction contract. To more efficiently acquire
construction services, the City piggy-backed on the County of Orange's Cooperative Purchasing
Program which utilized their Job Order Contract (JOC) Master Agreement for Pavement
Maintenance. Phase 1 of the project was awarded to RJ Noble Company. The County took the lead
for the project and the joint work was aligned and coordinated with the annual maintenance plans
for both jurisdictions. The jurisdictions worked together to provide a cohesive rehabilitation project
for the residents within the shared boundary areas.
The project was planned to be constructed in 2 phases with 2 different contractors. The first phase
(CIP 70019) started in April 2021 and was completed in June 2021. It focused on localized street
repairs and concrete repair work. The second phase (CIP 70020) is anticipated to start construction
Fall 2021 and will focus on slurry and street rehabilitation work. The project is located on streets with
shared boundaries with the County of Orange: Wass Street, Irvine Boulevard, Red Hill Avenue,
Melvin Way, Woodland Drive, Riverford Road, Nixon Circle, Browning Avenue and Bryan Avenue.

RESOLUTION NO. 21-58
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING THE RECORDATION OF THE NOTICE OF
COMPLETION JOINT PROJECT WITH THE COUNTY OF ORANGE
AND CITY OF TUSTIN STREET MAINTENANCE AND CONCRETE
REPAIRS WITHIN SHARED BOUNDARY AREAS — PHASE 1 , CIP 70019
WHEREAS, RJ Noble Company., having a contract with the City of Tustin to
construct the hereinafter described public works and improvement; and
WHEREAS, the City Engineer has duly certified to the construction and
completion of said public improvement hereinafter mentioned in a manner satisfactory
to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions
of the contract documents and the Notice of Completion, and acceptance of said public
works and improvement should be filed and payment of the balance due said contract
authorized in accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin
that said public works and improvement is found to be complete, and the same is
hereby accepted. Said public works and improvement is more particularly described as
follows..

STREET MAINTENANCE AND CONCRETE REPAIRS WITHIN SHARED

BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is
hereby authorized to execute and file a Notice of Completion for the acceptance of said
public works and improvement described herein as required by law.
