YASUDA, CITY CLERK SUBJECT: SECOND READING AND ADOPTION OF ORDINANCE NO. 1514 SUMMARY: Adoption of Ordinance No. 1514 approves ZC 2020-0001 to rezone the property located at 1382 Bell Avenue from Planned Community Industrial (PC-IND) to Planned Community Industrial/Business (PC-IND/BUS) and applies Tustin City Code parking standards for offices exceeding 25,000 square feet to the PC-IND/BUS district. RECOMMENDATION: That the City Council have second reading by title only and adoption of Ordinance No. 1514. BACKGROUND: On July 20, 2021 , the City Council had first reading by title only of the following Ordinance: 1514: ORDINANCE NO. 1514 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN APPROVING ZONE CHANGE 2020-0001 TO CHANGE THE ZONING DESIGNATION OF 1382 BELL AVENUE FROM PLANNED COMMUNITY INDUSTRIAL (PC-IND) TO PLANNED COMMUNITY INDUSTRIAL/BUSINESS (PC-IND/BUS) AND TO APPLY CITY CODE PARKING STANDARDS FOR OFFICES EXCEEDING 25,000 SQUARE FEET Attachment: 1 . Ordinance No. 1514 DocuSign Envelope ID: E8CAAF1B-5DC4-4FB1-B79D-E9F13046CABF ORDINANCE NO. 1514 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN APPROVING ZONE CHANGE 2020-0001 TO CHANGE THE ZONING DESIGNATION OF 1382 BELL AVENUE FROM PLANNED COMMUNITY INDUSTRIAL (PC-IND) TO PLANNED COMMUNITY INDUSTRIAL/BUSINESS (PC-IND/BUS) AND TO APPLY CITY CODE PARKING STANDARDS FOR OFFICES EXCEEDING 25,000 SQUARE FEET. The City Council of the City of Tustin does hereby ordain as follows: SECTION 1. The City Council finds and determines as follows: A. That a proper application for Zone Change (ZC) 2020-0001 was filed by Seth Hiromura on behalf of SteelWave LLC requesting authorization to change the Zoning Designation of 1382 Bell Avenue from Planned Community Industrial (PC-IND) to Planned Community Industrial/Business (PC-IND/BUS) (APN 430-231-05) and to apply City Code parking standards for offices exceeding 25,000 square feet in the Planned Community Industrial/Business (PC- IND/BUS) District. B. That a public hearing was duly called, noticed, and held on said application on June 8, 2021 , by the Planning Commission. The Planning Commission adopted Resolution No. 4430 recommending that the City Council approve ZC 2020-0001 . C. That the proposed ZC to PC-IND/BUS District is consistent with the Tustin Area General Plan and, in particular, the Land Use Element which designates this property as industrial and accommodates a broad range of industrial/commercial uses and development. D. That the Tustin City Council approved similar zone changes from PC-IND to PC-IND/BUS in 1979, 1985, 1995, and 2008 for nearby properties located to the east, south, and southwest of the subject site. E. That the proposed ZC will not adversely impact the public health, safety, and welfare of the community; but benefit the community by increasing the marketability of the current project site and therefore, increase the future economic viability through employment opportunities and additional tax revenues. Moreover, the proposed project has been reviewed for compliance with all applicable provisions of the City of Tustin Zoning code. F. That an Initial Study was prepared to evaluate the potential environmental impacts associated with ZC 2021-0001 and concluded that there is no DocuSign Envelope ID: E8CAAF1 B-5DC4-4FB1-B79D-E9F1 3046CABF Ordinance No. 1514 Page 2 of 3 substantial evidence that the proposed project may have a significant effect on the environment and a draft Negative Declaration (ND) was prepared. SECTION 2. The City Council hereby approves ZC 2020-0001 to amend the Tustin Zoning Map to rezone the property located at 1382 Bell Avenue to Planned Community Industrial/Business (PC-IND/BUS)Zoning District, as identified in Exhibit A, and to apply City Code parking standards for offices exceeding 25,000 square feet as identified in Exhibit B, attached hereto. SECTION 3. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held out to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Tustin hereby declares that it would have adopted this ordinance and each section, subsection, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional.
