A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, APPROVING PLANS AND
SPECIFICATIONS FOR NEWPORT AVENUE FAU PROJECT
M-MO16(OO2)
WHEREAS, it is the intention of the City Council of the City of Tustin,
California to construct certain traffic signal improvements on Newport Avenue
between Main Street and Sycamore Avenue, and;
WHEREAS, the City Engineer has presented plans and specifications for the
construction of said work;
NOW THEREFORE, BE IT RESOLVED that the plans and specifications
presented by the City Engineer be and are hereby approved as the plans and
specifications for:
Newport Avenue FAU Project P~-MO16(OO2)
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and
directed to advertise as required by law for the receipt of sealed bids or
proposals for the doing of the work specified in the aforesaid plans and
specifications which said advertisement shall be substantially in the following
words and figures to-wit:
"NOTICE TO CONTRACTORS"
SEALED PROPOSALS will be received at the office of the City Clerk,
Tustin City Hall, 300 Centennial Way, Tustin, California, until 10:00 A.M. on
the 21st day of March, 1986 at which time they will be public-"fy opened and
reacf~ for performing wort as ollows:

Bids are required for the entire work described herein:

1 The foregoing quantities are approximate only being given as a basis
for the comparison of bids, and the City of Tustin does not, expressly or by
2 implication, agree that the actual amount of work will correspond therewith,
but reserves the right to increase or decrease the amount of any class or
3 portion of the work or to omit portions of the work as may be deemed
necessary or advisable by the Engineer.

Plans, specifications and proposal forms to be used for bidding on
5 this project can only be obtained by prospective bidders at the office of the
City Clerk, Tustin City Hall, 300 Centennial Way, Tustin, California, 92680,
6 upon payment of $15.00 per set, which amount shall be non-refundable.
~ Plans and specifications will only be mailed out upon payment of
$25.00 per set, which amount shall be non-refundable.

In conformance with Section 37931 of the Government Code, all bids
g shall be presented under sealed cover on the proposal form provided and
accompanied by one of the following forms of bidder's security:

a. Cash
11 b. Cashier's check made payable to the City of Tustin.
c. Certified check made payable to the City of Tustin.
12 d. Bidder's bond executed by an accredited surety insurer, made
payable to the City of Tustin.

The security shall be in an amount equal to at least ten percent
14 (10~) of the amount of the bid. A bid shall not be considered unless one of
the forms of bidders security is enclosed therewith.

A Security Bond for payment of labor and materials will be required
16 in the amount of fifty percent (50~) of the estimated total contract price
and a Faithful Performance Bond in the amount of one hundred percent (100)
1~ of the estimated total contract price in the form attached to the contract
documents. Said bonds shall be issued by a Surety Company rated grade A or
18 better and Class IX or better by the latest edition of Best's Key Rating
Guide.

City of Tustin reserves the right to reject any or all bids, and/or
20 waive any informality on a bid. No bidder may withdraw his bid for a
period of thirty (30) days after the date set for the opening thereof. Prior
21 to bid opening, bidder may withdraw his bid. Bids received after the bid
opening time and date herein will be returned to bidder unopened.

The contract will be awarded to the lowest qualified bidder.

Provisions of the State Contract Act are not applicable, and
24 prospective bidders will not be required to be prequalified.
25 All work to be done under the direct supervision of the City
Engineer, City of Tustin.

All work to be paid for at the unit prices bid from appropriated
27 monies.

Pursuant to California Government Code Section 4590, the contractor will
be entitled to post approved securities with the City or an approved
financial institution in order to have the City release funds retained by the
City to insure performance of the contract.
Federal requirements and Federal minimum wages shall apply to this
project. Attention is directed to decision No. CA85-5035 of the Secretary of
Labor. Not less than said minimum wages shall be paid to workers employed on
this project.
Federal requirements for this project require that the Contractor shall
perform work with his own organization which equals not less than 30 percent
(30%) of the total contract price.
Minimum wage rates for this project as predetermined by the Secretary of
Labor are set forth in the special provisions. If there is a difference
between the minimum wage rates predetermined by the Secretary of Labor and
the prevailing wage rates determined by the State for similar classifications
of labor, the Contractor and his subcontractors shall pay not less than the
higher wage rates.
Pursuant to Section 1773 of the Labor Code, the general prevailing rate
of wages in the county in which the work is to be done has been determined
and the department has listed these wage rates in the Department of
Transportation publication entitled Equipment Rental Rates and General
Prevailing Wage Rates, dated February, 1977.
PASSED AND ADOPTED by the City Council of the City of Tustin, Califonia,
this 18th day of February 19~_.

Resolution No. 86-24 was duly and regularly introduced, passed and adopted at an
adjourned regular meeting of the City Council held on the 18th day of February,
