RESOLUTION NO. 86-15
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR THE
COLUMBUS TUSTIN ATHLETIC FIELD RENOVATION PROJECT AND
DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS.
WHEREAS, ~ ~s ~he ~ntent~on of [he C~y Council of [he C~ty of
Tus[~n, Ca~foffn~a ~o construct Backstop, dugouts and s~de fencing loft
f~e~d #4 of Columbus TusCan Paffk, [7952 Beneta ~ay, and;
WHEREAS, the Communtty Servtces staff has presented spectficati OhS
for the construction of said work;
NOW, THEREFORE, BE IT RESOLVED that the specifications presented by
the Community Services staff be and are hereby approved as the
specifications for:
Backstop, dugouts, and side fencing for athletic field #4

BE IT FURTHER RESOLVED that the City Clerk is hereby authort, zed and
directed to advertise as required by law for the receipt of sealed bids or
proposal s for the provision of such services as specified tn the aforesaid
specifications which said advertisement shall be substantially in the
foll owing words and fi gures to wi t:
NOTICE TO VENDORS
Sealed proposals will be received at the office of the City Clerk,
Tustin City Hall, 300 Centennial Way, Tusttn, California until 10:00 a.m.
on the 25th of February at which time they will be publicly opened and
read fo'F Performance as follows:
Construction of Athletic Field #4 Backstop, dugouts, and side
fencing.
Bids are required for the entire work described herein:
The work to be done generally consists of furnishing all material,
labor, machinery, supervision, and services necessary to complete the
project. The work involves:
Install Backstop, dugouts, and side fencing for field #4 and other
work as described in the drawings and specifications.
Contractors shall secure all necessary permtts and licenses
required for completion of this project.

The foregoing quantities are approximate only betng gtven as a
basts for the comparison of btds, and the Ctty of Tus~tn does not,,
expressly or by Implication, agree .that the actual amount, of work w~11
correspond the~ewt[h, but, reserves .the rtght to t ncrease or decrease the
amoun~ of any class or point on of the work or ~o omt t porttons of ~he work
as may be deemed necessary or advisable by the Engineer.
Plans, specifications and proposal forms to be used for bfdd~ng on
th~s pro~ect can only be obta.~ned by p~ospect~ve b~dders at the off~ce of
the C~ty Clerk, TustJn Ctty Ha~, 300 Centennial Way, Tusttn, Ca~Jforn~a,
92680, upon payment of $5.00 per set, which amount shall be non-~efundable.
Plans and speclftcat~ons wt~1 be ma~led out upon payment of
$7.00 per set, whtch amount sha~ be non-refundable.
Zn confo~aance w~th Section 3793;l of the Government Code, a33 bids
shall be presented under sealed cover on the propsal form provided and
accompanied by one of the followtng forms of b~dder' s secur~ ty:
a. Cash.
Cashier's check made payable to the C~ty of Tust~n.
c. Certified check made payable to the Ctty of Tust~n.
d. B~dder's bond executed by an accredited surety ~nsurer, made
payable to the C~ty of Tust~n.
The security shall be ~n an amount equal to at least ten percent
(10~) of the amount of the b~d. A b~d sha~ not be considered unless one
of the forms of b~dder' s security ~s enclosed therewith.
A Security Bond for payment of la'hot and materials ~tll be required
in the amount of fifty percent (50%) of the estimated total contract price
and a Faithful Performance Bond in the amount of one hundred percent (100[)
of the estimated total contract price in the form attached to the contract
documents. Said bonds shall be issued by a Surety Company rated grade A or
better and Class IX or better by the latest edition of Best's Key Rating
Guide.
The-City of Tusttn reserves the right to reject any or all bids,
and/or waive any informality on a bid. No bidder may withdraw his bid for
a period of thirty (30) days after the date set for the opening thereof.
The contract will be awarded to the lowest qualified bidder.
All work to be done under the direct supervision of the City
Engineer, City of Tustin.

The City Council of the City of Tusttn has obtained from the
Director of Industrial Relations the general prevailing rate of per diem
wages and the general prevailing rate for lega~ holiday and overtime work
in the locality in which the work is to be performed for each craft or type
of work needed and a copy of the same is on file in the office of the City
Clerk.
Not less than said prevailing rates Shall be paid to workers
employed on this public works-contract as required by Labor Code Sections
1771 and 1774 of the State of California.
The Contractor shall diligently prosecute the work required by this
contract to completion before the expiration of one hundred fifty (150)
calendar days from the date of of contract approval, including project
maintenance for a minimum period of ninety {90) calendar days following
installation of said improvements.
PASSED AND ADOPTED by the' City Council of the City of Tustin,
California, this 3rd day of February, 1986.
