SUBJECT: ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO
FILE THE NOTICE OF COMPLETION FOR THE NEWPORT AVENUE
REHABILITATION PROJECT (CIP NO. 7165), THE SYCAMORE AVENUE
SIDEWALK ENHANCEMENT PROJECT (CIP NO. 7185), AND THE
WALNUT AVENUE SIDEWALK ENHANCEMENT PROJECT
(CIP NO. 7186)
SUMMARY
Construction of the Newport Avenue Rehabilitation Project between Sycamore Avenue and
McFadden Avenue (CIP No. 7165), the Sycamore Avenue Sidewalk Enhancement Project
(CIP No. 7185), and the Walnut Avenue Sidewalk Enhancement Project (CIP No. 7186) have
been completed to the satisfaction of the City Engineer and are now ready for City Council
acceptance.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 06-46 accepting the Newport
Avenue Rehabilitation Project between Sycamore Avenue and McFadden Avenue (CIP No.
7165), the Sycamore Avenue Sidewalk Enhancement Project (CIP No. 7185), and the
Walnut Avenue Sidewalk Enhancement Project (CIP No. 7186), and authorizing the
recordation of the Notice of Completion, and direct the City Clerk to:
1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the
date of recordation of the Notice of Completion; and
2. Release the Faithful Performance Bond not sooner than one year after the date of
recordation of the Notice of Completion; and
Assuming to claims or stop payment notices are filed, it is further recommended that thirty-five (35)
days after the date of recordation of the Notice of Completion, the City Council authorize payment
of the final 10% retention in the amount of $51,730.12 to Silvia Construction, Inc. The total final
construction contract cost for the project is $517,301.17
Acceptance of Public Improvements and Authorization to File the Notice of Completion for the
Newport Avenue Rehabilitation Project (CIP No. 7165), the Sycamore Avenue Sidewalk
Enhancement Project (CIP No. 7185), and the Walnut Avenue Sidewalk Enhancement Project
(CIP No. 7186)

FISCAL IMPACT
The final construction contract cost for the combined Newport Avenue Rehabilitation Project,
the Sycamore Avenue Sidewalk Enhancement Project, and the Walnut Avenue Sidewalk
Enhancement Project is $517,301.17. The project was funded by a combination of Measure
"M" Turnback funds, Gas Tax funds, and Community Development Block Grant (CDBG)
funds.
Project construction, along with design and construction management, has increased the City's
infrastructure assets by $588,263. The increased infrastructure valuation will be added to the
City's infrastructure inventory as required by Statement 34 of the Governmental Accounting
Standards Board (GASB 34). Detailed cost information is shown on the attached GASB 34
Infrastructure Inventory Valuation Forms.
BACKGROUND AND DISCUSSION
The Newport Avenue Rehabilitation Project (CIP No. 7165), the Sycamore Avenue Sidewalk
Enhancement Project (CIP No. 7185), and the Walnut Avenue Sidewalk Enhancement Project
(CIP No. 7186) were completed on March 31,2006.
All of the work for these projects has been completed to the satisfaction of the City Engineer and is
now ready for City Council acceptance.

RESOLUTION NO. 06-46
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING THE RECORDATION OF THE NOTICE OF
COMPLETION FOR THE CONSTRUCTION OF THE NEWPORT
AVENUE REHABILITATION PROJECT (CIP NO. 7165), THE
SYCAMORE AVENUE SIDEWALK ENHANCEMENT PROJECT (CIP NO.
7185), AND THE WALNUT AVENUE SIDEWALK ENHANCEMENT
PROJECT (CIP NO. 7186)
WHEREAS, Silvia Construction, Inc., having a contract with the City of Tustin to
construct the hereinafter described public works and improvement; and
WHEREAS, the City Engineer has duly certified to the construction and
completion of said public improvement hereinafter mentioned in a manner satisfactory
to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions
of the contract documents and the Notice of Completion, and acceptance of said public
works and improvement should be filed and payment of the balance due said contract
authorized in accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin
that said public works and improvement is found to be complete, and the same is
hereby accepted. Said public works and improvement is more particularly described as
follows:
Newport Avenue Rehabilitation Project between Sycamore Avenue and
McFadden Avenue (CIP No. 7165), the Sycamore Avenue Sidewalk
Enhancement Project (CIP No. 7185), and the Walnut Avenue Sidewalk
Enhancement Project (CIP No. 7186)
BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is
hereby authorized to execute and file a Notice of Completion for the acceptance of said
public works and improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 15111 day of May 2006.
