HUIZAR, CHIEF DEPUTY CITY CLERK SUBJECT: ORDINANCE ADOPTING CITY lOGO AND SEAL SUMMARY: The proposed ordinance will ensure that the logo and the Seal are attractively displayed and consistently used whenever they appear. RECOMMENDATION Introduce Ordinance No. 1312 related to the City of Tustin Seal and logo. FISCAL IMPACT None BACKGROUND: The proposed ordinance will standardize the use and appearance of the City Seal and logo. Use of the City Seal and City logo for purposes other than official business of the City requires prior approval. For-profit and political usage of the City Seal and City logo is prohibited. Non-profit usage requires approval. A written request stating the purpose for usage must be submitted to the City Council for consideration. The City Seal is adopted as the official corporate seal of the City. The City Clerk is authorized to use the City Seal on all official documents to which the law requires or allows the seal to be affixed as the City's corporate seal. The City Logo will be used for all printed materials, such as forms, stationery and business cards, publications, uniforms and Tustin promotional materials, such as shirts, hats, mugs, pens, etc. It also will be used on City vehicles, equipment and fixtures, such as water towers, signage, and all associated marketing for City sponsored events. Chief Deputy City Clerk ORDINANCE NO. 1312 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, ADDING PART 4 TO CHAPTER 2, ARTICLE 1 OF THE TUSTIN CITY CODE REGARDING THE CITY SEAL AND LOGO The City Council of the City of Tustin, California, ordains: SECTION 1. Part 4 is added to Chapter 2 of Article 1 of the Tustin City Code regarding City Seal and Logo, which shall read as follows: PART 4. CITY SEAL AND LOGO Sections: 1240 City Seal--Designation. 1241 City Seal Use. 1242 City Seal Omission, Effect.. 1243 City Seal Loss. 1244 City Logo--Designation. 1245 Use in Election Campaign Prohibited. 1246 Use by Person Other Than Officers and Employees. 1247 Use for Malicious or Financial Purposes Prohibited. 1248 Manufacture and Sale of Souvenirs and Decorative Items. 1249 Authority of City Clerk 1240. City Seal--Designation. The city seal is the impression made by that certain instrument retained and used by the City Clerk for the purpose of attesting documents as acts of the City Council. The general design and the details of the impression made by the city seal, shall correspond substantially with the one on file in the City Clerk's Office. 1241. City Seal Use. The city seal, or any facsimile thereof, shall not be affixed to any document or writing, except by the City Clerk or such assistants to the Clerk as may be authorized by the City Clerk, and except for the purpose of attesting the document to be an act of the City Council. 1242. City Seal Omission, Effect. No act of the City Council or document in evidence thereof shall be invalid by reason of the omission of the city seal. Ordinance No. 1312 Page 1 of 4 1243. City Seal Loss. In the event of loss of the instrument used for affixing the seal, the words "Seal, City of Tustin, California", written by the City Clerk in attestation of a document, shall constitute the city seal. 1244. City Logo--Designation. The City Logo is a design used for the purpose of symbolically representing the authority of the City of Tustin and the capacity of its officers, employees and agents as representatives of the City of Tustin. The general design and the details of the city logo, excluding colors, shall correspond substantially with the following representation thereof: 1245. Use in Election Campaign Prohibited. No person shall use the city logo, or any facsimile thereof, for purposes of supporting or opposing the nomination or election to any city or other public office of himself or herself or any other person, or for purposes of supporting or opposing any ballot measure, nor include such city logo on any writing distributed for purposes of influencing the action of the electorate, or any part thereof, in any election. This section shall not be applicable to writings issued by the City of Tustin or the City Council as a whole pursuant to law. 1246. Use by Person Other than Officers and Employees. No person, other than an officer or employee of the City of Tustin, shall use the city logo or any facsimile thereof for any purpose except to the extent such officer or employee may be authorized to do so by resolution of the City Council. 1247. Use for Malicious or Financial Purposes Prohibited. No person shall use the city logo, or any facsimile thereof, for any malicious purpose or for the purpose of personal financial gain. 1248. Manufacture and Sale of Souvenirs and Decorative Items. Ordinance No. 1312 Page 2 of 4 Nothing in this Part shall prevent a person from manufacturing or selling non- documentary objects, such as souvenirs or decorative items, bearing the city logo as part of the design, provided that such person undertakes such activity pursuant to agreement with the City, approved by the City Councilor by such officer as the City Council may designate, containing such requirements and limitations as the City Councilor such officer shall deem appropriate to assure that such use of the city logo is in good taste and in the best interests of the City of Tustin. 1249. Authority of City Clerk. The City Clerk or the City Clerk's representative shall be the custodian of the seal and logo of the City of Tustin. SECTION 2. The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be published and posted pursuant to the provisions of law and this Ordinance shall take effect thirty (30) days after passage. .
