The Zoning Administrator of the ci ty of Tustin does

The Zoning Administrator finds and determines as
follows:
A. That a proper application, Conditional Use
Permit 94-021, was filed by Koll Management
Services to authorize the establishment of
uses that have more than 50% of their floor
area devoted to office use located at the
southeast corner of Edinger and Red Hill
Avenues and is more specifically described as
1541, 1562, 1571 and 1582 Parkway Loop; 15011,
15022, 15031 and 15042 Parkway Loop; 15012,
15032, 15052 and 15102 Red Hill Avenue and
1542, 1622 and 1652 Edinger Avenue.
B. That the proposed project will not have a
significant impact as conditioned and
therefore a Negative Declaration has been
prepared for this project in accordance with
the provisions of the California Environmental
Quality Act.
C. That the project. has been reviewed for
consistency with the Air Quality Sub-Element
of the ci ty of Tustin General Plan and has
been determined to be consistent or has been
conditioned to be consistent with the Air
Quality Sub-Element.
D. A public hearing was duly called, noticed and
held for said application on October 17, 1994
by the Zoning Administrator.

That establishment, maintenance, and operation
of the use applied for will not, under the
circumstances of this case, be detrimental to
the health, safety, morals, comfort, or
general welfare of the persons residing or
working in the neighborhood of such proposed
use, nor to the general welfare of the City of
Tustin as evidenced by the following findings:
1. The original intent of the current
Industrial (M) District regulations
permit 115,500 square feet of office
space for the entire project, provided no
single tenant has more than 50% of their
space devoted to office use. The total
amount of office area permitted with the
subj ect CUP would be restr icted to the
same maximum amount, however the space
may be redistributed so that some tenants
may have more than 50% office use. The
intent of the current zoning regulations
are satisfied.
2 · No new parking spaces are required to
accommodate approximately 100,000 square
feet of office use in existing tenant
spaces. If the maximum of 115,500 square
feet of office area is implemented, then
additional parking may be needed to
satisfy the parking requirements, or the
more intensive uses would need to be
replaced with warehouse uses that require
less parking.
3. The establishment of businesses that have
more than 50% office use will have no
adverse impact on the health, welfare or
safety of the persons residing or working
in the neighborhood of proposed use, as
office uses generally create less of a
negative impact than industrial uses
which are permitted within the project by
right.
4 · Some of the off ices uses permi tted as
part of the subject CUP are the same as
existing businesses that were established
in the Koll Tustin Business Center when
it was originally approved in 1975. The
proposed additional office uses would not
affect the orderly development of the
surrounding area, or the City at large.

II. The Zoning Administrator hereby approves Conditional Use
3 Permit 94-021 authorizing the establishment of uses that have
more than 50% office space within the Koll Business Center,
4 Tustin, located at 1541, 1562, 1571,1582, 15011, 15022, 15031
and 15042 Parkway Loop, 15012, 15032, 15052 and 15102 Red Hill
5 Avenue and 1542, 1622 and 1652 Edinger Avenue subject to the
conditions contained in Exhibit A, attached hereto.

7 PASSED AND ADOPTED at a regular meeting of the Tustin Zoning
Administrator, held on the 17th day of October, 1994.

CONDITIONAL USE PERMIT 94-021
OCTOBER 17, 1994
GENERAL
(1) 1.1 The proposed project shall substantially conform with the
project as approved by the Zoning Administrator on
October 17, 1994, on file with the Community Development
Department as herein modified or as modified by the
Director of Community Development in accordance wi th this
Exhibit. The Community Development Department Director
may make minor modifications to the project if such
modifications are consistent with applicable Code
provisions.
1. 2 The applicant and property owner shall sign and return an
Agreement to Conditions Imposed form prior to approval of
any new business license applications authorized by this
CUP.
(1) 1.3 The applicant and property owner shall hold harmless and
defend the City of Tustin for all claims and liabilities
arising out of the City's approval of the entitlement
process for this project.
SITE AND BUILDING CONDITIONS
(1) 2.1 Office uses permitted by CUP 94-021 in Koll Tustin
Business Center include general office, medical office,
professional, administrative and offices in conjunction
with permitted uses.
(1) 2.2 The maximum amount of office area permitted for the
entire Koll Tustin Business Center shall not exceed
115,500 square feet, provided there is adequate on-site
parking. Said office area may exceed 50% of the floor
area for an individual tenant space.

2.3 All uses permitted by the Industrial (M) District
regulations and the subject CUP shall meet the parking
requirements of the "M" District. In addition, medical
offices shall provide six (6) parking spaces for every
1,000 square feet of gross floor area.

2.4 Any new tenant business license application that is a
change in use or intensification of an exi~ting use and
all tenant improvement plans shall include an updated
Building Use and Parking Summary identifying size, type
of use and required parking for all current tenants and
vacant suites to ensure that adequate parking is
maintained for this project. Applicant shall provide the
City with a hard copy of the disc information of the
Business Use and Parking Summary for City internal use.
FEES
(1) 3.1 within 48 hours of approval of the subject project, the
applicant shall deliver to the Community Development
Department, a cashiers check payable to the COUNTY CLERK,
in the amount of $25.00 to enable the City to file with
the County Clerk, the appropriate environmental
documentation pursuant to the California Environmental
Quality Act. If within such 48 hours period, the
applicant has not delivered to the Community Development
Department the above noted check, the approval for the
project granted herein shall be considered automatically
null and void.
