The Zoning Administrator of the ci ty of Tustin does
4 hereby resolve as follows:

The Zoning Administrator finds and determines as
follows:
A. That a proper application, Administrative
Adjustment 94-001, was filed by California
Pacific Homes to authorize a ten percent (10%)
decrease of the required five (5) foot wide
side yard setback, to 4-feet, six-inches (4'-
6") for an existing structure located at 10854
Churchill Place.
B. That a public meeting was duly called, noticed
and held for said application on November 7,
1994 by the Zoning Administrator.
C. That pursuant to section 3 . 13 of the East
Tustin Specific Plan, the requested
administrative adjustment is intended for a
special circumstance of hardship, and is not
applicable to the entire subdivision site
development standards as evidenced by the
following:
1. The subject structure is existing as part
of a finished phase within the tract, and
is privately owned.
2. A hardship would be caused if the
building were required to be moved six-
inches to meet the five-foot side yard
setback as it would be costly and
disruptive to the neighborhood.
3 . At this time no other residential
structures in the Tract 14748 have been
reported to be encroaching into the five-
foot side yard setback, therefore, the
request does not apply to the site
development standards for the entire
tract.
D. That the proposed project is categorically
exempt (Class 5) pursuant to the California
Environmental Quality Act 15305.

am the Recording Secretary of the Zoning Administrator of

CONDITIONS OF APPROVAL
ADMINISTRATIVE ADJUSTMENT 94-001
NOVEMBER 7, 1994
GENERAL
(1) 1.1 The proposed project shall substantially conform with the
project as approved by the Zoning Administrator on
November 7, 1994, on file with the Community Development
Department as herein modif ied or as modif ied by the
Director of Community Development in accordance with this
Exhibit. The Community Development Department Director
may make minor modifications to the project if such
modifications are consistent with applicable Code
provisions.
(1) 1.2 The applicant shall sign and return an Agreement to
Conditions Imposed form within two weeks of Zoning
Administrator approval of the subject request.
(1) 1.3 The applicant and property owner shall hold harmless and
defend the City of Tustin for all claims and liabilities
arising out of the City's approval of the entitlement
process for this project.
(1) 1.4 All conditions contained in Resolution No. 2938 approving
Vesting Tentative Map 14381 and Resolution No. 2937
authorizing Conditional Use Permit 91-17, and all
development standards contained in the East Tustin
Specific Plan pertaining to the subject property shall
remain in effect unless an appropriate application is
made to the city for any variance to the development
standards.
PLAN SUBMITTAL
(1) 2.1 Applicant shall submit for plan check three (3) sets of
revised precise grading plans within two (2) weeks of
Zoning Administrator approval, or project shall become
null and void.

FEES
3.1 At plan check, applicant shall pay all applicable plan
check fees.
(1) 3.2 Within 48 hours of approval of the subject project, the
applicant shall deliver to the Community Development
Department, a cashiers check payable to the COUNTY CLERK,
in the amount of $25.00 to enable the City to file with
the County Clerk, the appropriate environmental
documentation pursuant to the California Environmental
Quality Act. If within such 48 hours period, the
applicant has not delivered to the Community Development
Department the above noted check, the approval for the
project granted herein shall be considered automatically
null and void.
