The Zoning Administrator of the City of Tustin does
4 hereby resolve as follows:

The Zoning Administrator finds and determines as
follows:
A. That a proper application, Design Review 94-
031, was filed by Everett Martinez on behalf
of First Interstate Bank to authorize the
installation of a drive up automated teller
machine (ATM) within an existing drive up
teller area at an existing bank located at
1140 Irvine Boulevard.
B. That the proj.ect is located within the Town
Center Redevelopment area. Pursuant to City
Code section 9299(b) (3) (c), the Zoning
Administrator has the authority to approve
Design Review applications within the City's
Redevelopment Areas.
c. Pursuant to section 9272 of the Tustin
Municipal Code, the Zoning Administrator finds
that the architectural features, materials and
colors will not impair the orderly and
harmonious development of the area, the
present or future development therein, or the
occupancy as a whole. In making such
findings, the Zoning Administrator has
considered at least the following items:
1. Setbacks and site planning.
2. Exterior materials and colors.
3. Landscaping, parking area design and
traffic circulation
4 . Location, height and standards of
exterior illumination.
5. Physical relationship of proposed
structures to existing structures in the
neighborhood.
6. Appearance and design relationship of
proposed structures to existing
structures and possible future structures
in the neighborhood and public
thoroughfares.
7. Proposed signing.
8. Development Guidelines and criteria as
adopted by the City Council.

D.
That the proposed project is categorically
exempt (Class 1) pursuant to the California
Environmental Quality Act section 15301.

II. The Zoning Administrator approves Design Review 94-
5 031 to authorize the installation of a drive up
automated teller machine (ATM) within an existing
6 drive up teller area at an existing bank located at
1140 Irvine Boulevard, subject to the conditions
7 contained in Exhibit A, attached hereto.

EXHIBIT A
CONDITIONS OF APPROVAL
DESIGN REVIEW 94-031
NOVEMBER 7, 1994
GENERAL
(1) 1.1 The proposed project shall substantially conform with the
submitted plans dated stamped November 7, 1994 on file
with the Community Development Department as herein
modified or as modified by the Director of Community
Development in accordance with this Exhibit.
(1) 1.2 Unless otherwise specified, the conditions contained in
the Exhibit shall be complied with prior to the issuance
of any building permits for the project, subject to
review and approval by the Community Development
Department.
(1) 1.3 Design review approval shall become null and void unless
all building permits are issued within eighteen (18)
months of the date of this Exhibit.
(1) 1.4 The applicant shall sign and return an Agreement to
Conditions Imposed form prior to issuance of building
permits.
(1) 1.5 The applicant and property owner shall hold harmless and
defend the City of Tustin for all claims and liabilities
arising out of the City's approval of the entitlement
process for this project.
SITE CONDITIONS
*** 2.1 A stop sign or pavement marking shall be installed and
maintained at the east end of the drive thru lane for
motorists exiting the ATM area.
(1) 2.2 Any sign advertising specific brand names or pricing
shall be prohibited unless incorporated into the business
name for the purpose of city business licenses and filing
of fictitious business name as required by the state
Board of Equalization. The proposed automated teller
machine may contain decals or other signs which advertise
the name or names of systems which are accepted by the
automated teller machine, provided the total area of
these decals does not exceed six (6) square feet.

(1) 2.3 Proposed directional signs shall comply with the
requirements of the Tustin Sign Code, which permits
directional/information signs not exceeding six (6)
square feet per face nor four (4) feet in height.
(4) 2.4 No exterior lighting shall be permitted which may create
any glare or have a negative impact on adjoining
properties or the adjacent streets. The location and
types of lighting shall be subject to approval by the
Community Development Department.
(4) 2.5 The new brick shall match the existing exterior walls of
the building.
PLAN SUBMITTAL
(1) 3.1 At plan check submit three (3) sets of construction plans
and two (2) sets of structural calculations.
Requirements of the Uniform Building Code shall be
complied with as approved by the Building Official. No
field changes shal.l be made wi thout corrections submi tted
to and approved by the Community Development Department.
FEES
(1) 4.1 Payment of all Building plan check and permit fees shall
be made prior to the issuance of any building permits in
accordance with the Tustin City Code.
(1) 4.2 Within forty-eight (48) hours of approval of the subject
project, the applicant shall deliver to the Community
Development Department, a cashier's check payable to the
COUNTY CLERK in the amount of $25.00 (twenty five
dollars) pursuant to AB 3158, Chapter 1706, statutes of
1990, to enable the City to file the appropriate
environmental determination required under Public
Resources Code Section 21152 and 14 Cal. Code of
Regulations 15075. If within such forty-eight (48) hour
period that applicant has not delivered to the Community
Development Department the above-noted check, the
approval for the project granted herein shall be
considered automatically null and void.
