3 The Zoning Administrator of the city of Tustin does
hereby resolve as follows:

I.
The Zoning Administrator finds and determines as
follows:

A.
That a proper application, Conditional Use
Permit 95-020, was filed by Edward J. Putnam
to establish a veterinary office in a vacant
tenant space located at 13115 Jamboree Road in
the Tustin Ranch Plaza.

B.
That a public hearing was duly called, noticed
and held on said application on September 18
and 27, 1995 by the Zoning Administrator.
That a veterinary office is allowed within the
Neighborhood Commercial Land Use designation
of the Eas~ Tustin Specific Plan with approval
of a Conditional Use Permit.

D.
That establishment, maintenance, and operation
of the use applied for will not, under the
circumstances of this case, be detrimental to
the health, safety, morals, comfo~t or general
welfare of the persons residing or working in
the neighborhood of such proposed use,
evidenced by the following findings:

1)
The establishment of a veterinary office
within the Center will enhance the
variety of commercial services offered by
providing a needed community service for
the East Tustin area.

2)
The proposed hours of operation will be 7
am to 6 pm Monday through Friday and 8 am
to 2 pm on Saturday. The proposed hours
are compatible with the other in-line
retail tenants in Tustin Ranch Plaza and
in some instances less intensive than
larger tenants such as Ralphs,
restaurants, and future service station.

3) The proposal will be conducted entirely
within an enclosed building so as to
minimize any potential impacts on
adjacent tenants such as noises, odors or
activities.

E. That the establishment, maintenance, and
operation of the use applied for will not be
injurious or detrimental to the property and
improvements in the neighborhood of the
subject property, nor to the general welfare
of the City of Tustin for the reasons stated
in section D, above.
F. It has been determined that this project is a
minor alteration to an existing facility and
is, therefore, Categorically Exempt (Class 1)
from the California Environmental Quality Act.

The Zoning Administrator hereby approves
Conditional Use Permit No. 95-020 to authorize the
establishment of a veterinary office within a
vacant tenant space located at 13115 Jamboree Road,
subject to the conditions contained in Exhibit A
attached hereto.

PASSED AND ADOPTED by the zoning Administrator of the
City of Tustin at a regular meeting held on the 27th day
of September, 1995.

CONDITIONS OF APPROVAL

GENERAL
(1) 1.1 The proposed project shall substantially conform with the
submitted plans for the project date stamped September
27, 1995 on file with the Community Development
Department, as herein modified, or as modified by the
Director of Community Development Department in
accordance with this Exhibit. The Director of Community
Development may also approve subsequent minor
modifications to plans during plan check if such
modifications are to be consistent with provisions of the
Tustin City Code.
(1) 1.2 Unless otherwise specified, the conditions contained in
this Exhibit shall be complied with prior to the issuance
of any building permits for the project, subject to
review and approval by the Community Development
Department.
(1) 1.3 The subject Conditional Use Permit 95-020 shall become
null and void unless permits for the proposed project are
issued within 12 months of the date of this exhibit and
substantial construction' is underway. Time Extensions
may be granted if a written request is received by the
Community Development Department within thirty days prior
to expiration.
(1) 1.4 Approval of Conditional Use Permit 95-020 is contingent
upon the applicant and property owner signing and
returning an "Agreement to Conditions Imposed" form as
established by the Director of Community Development.
(1) 1.5 The applicant shall hold and defend the City of Tustin
harmless for all claims and liabilities arising out of
the City'S approval of the entitlement process for this
project.

(6) 1.6 Prior to the issuance of a Certificate of Occupancy for
the veterinary office, the applicant shall provide a copy
of the "Premise Permit" to the Community Development
Department issued by the state of California Veterinary
Medical Board, to operate a veterinary office at the
subject location.
(6) 1.' Prior to the issuance of a Building Permit for the
veterinary office, the applicant shall submit to the
Orange County Health Care Agency for review and approval
of plans and specifications for any X-Ray equipment.
USE RESTRICTIONS
(6) 2.1 The applicant shall maintain on-site at all times, a
rigid leak proof container for the disposal of all sharp
objects and bio-hazardous waste material which shall be
removed from the office and be disposed of by a qualified
commercial vendor. Any violations of this condi tion may
be cause for revocation of this Conditional Use Permit by
the City of Tustin.
*** 2.2 The applicant shall be responsible for the removal all
animal waste matter deposited outside the tenant space
caused by animals seen at his office.
*** 2.3 The applicant shall wash down the pedestrian area/arcade
and arcade columns in the immediate vicinity of the
tenant space daily, to remove any animal urine or feces
that may accumulate during the day.
*** 2.4 The applicant shall'secure commercial disposal services
to remove any dead animal remains, tissue and organs and
Bio-Hazardous Material from the premises.
*** 2.5 All animal remains shall be kept frozen within a
commercial freezer and removed from the premises no later
than 14 days after expiration.
*** 2.6 The applicant shall be prohibited from disposing of any
animal remains, body parts, waste matter, or medical
supplies in anyon-site trash bin/receptacle. No sharp
objects or bio-hazardous material shall be disposed of in
any trash dumpster/bin within the Center. Any violations
of this condition may be cause for revocation of this
Conditional Use Permit by the City of Tustin.

*** 2.7 The applicant shall identify on the plan check submittal
the location of the freezer where animal remains will be
stored until removed by the commercial disposal company.
*** 2.8 The premises shall be maintained in a healthy and
sanitary condition at all times. Any violations as
determined by the Orange County Health Care Agency, state
of California Veterinary Medical Board or the City of
Tustin, may be grounds for revocation of this Conditional
Use Permit by the City of Tustin.
*** 2. 9 The applicant shall comply with all applicable provisions
of the City's Noise Ordinance which in part limits noise
generation to 60dba within commercial land uses.
*** 2.10 The applicant shall notify all customers and post a sign
in the waiting room that. all animals brought to this
office shall be on a leash or caged at all times when not
being seen in the examining room.
*** 2.11 The applicant shall limit the veterinary care to small
animals only. No large animals such as horses or bovines
shall be permitted on-site.
*** 2.12 The post operative and/or observational care of animals
shall be limited to a maximum of 48 hours of on-site
boarding. The boarding of animals receiving no medical
care shall be prohibited..
PLAN SUBMITTAL
(1) 3.1 At building plan check submit three sets of construction
plans and structural calculation information.
Requirements of the Uniform Building Codes, and state
Handicap Code Requirements shall be complied with as
approved by the Building Official, including all
provisions of UBC Section 715 related to the construction .
of veterinarian offices. Additionally, a note on plans
shall be included stating that no field changes shall be
made without corrections submitted to and approved by the
Building Official.

FEES
(1) 4.1 Payment of, but not limited to, building plan check and
permit fees to the Community Development Department shall
be made prior to issuance of any building permits in
accordance with the Tustin City Code. Payment shall be
made based upon those rates in effect at the time of
permit issuance and are subject to change.
(1) 4.2 within forty-eight (48) hours of approval of the subject
project, the applicant shall deliver to the Community
Development Department, a cashier's check payable to the
COUNTY CLERK in the amount of $25.00 (twenty-five
dollars) to enable the City to file the appropriate
environmental documentation for the project. If within
such forty-eight (48) hour period that applicant has not
delivered to the Community Development Department the
above-noted check, the statute of limitations for any
interested party to challenge the environmental
determination under the provisions of the California
Environmental Quality Act could be significantly
lengthened.
