The Zoning Administrator of the City of Tustin does

The Zoning Administrator finds and determines as
follows:
A. That a proper application, Design Review 96-
049, was filed by Associated Arts to authorize
the conversion of 116 carport spaces into
fully e,nclosed garage spaces at Newpoint
Apartments, located at 14831-14921 Newport
Avenue.
B. That the project is located within the South
Central Redevelopment area. Pursuant to City
Code Section 9299(b) (3) (c), the Zoning
Administrator has the authority to approve
Design Review applications within the City's
Redevelopment Areas.
C. Pursuant to Section 9272 of the Tustin
Municipal Code, the Zoning Administrator finds
that the architectural features, materials and
colors will not impair the orderly and
harmonious development of the area, the
present or future development therein, or the
occupancy as a whole. In making such
findings, . the Zoning Administrator has
considered at least the following items:
1. Exterior materials and colors.
2 . Physical relationship of proposed
structures to existing structures in
the neighborhood.
3 . Appearance and design relationship
of proposed structures to existing
structures and possible future
structures in the neighborhood and
public thoroughfares.
4. Development Guidelines and criteria
as adopted by the City Council.
D. That the proposed proj ect is categorically
exempt (Class 1) pursuant to the California
Environmental Quality Act 15301.

EXHIBIT A
CONDITIONS OF APPROVAL
DESIGN REVIEW 95-033
NOVEMBER 12, 1996
General
(1) 1.1 The proposed proj ect shall substantially conform wi th the
submitted plans date stamped November 12, 1996 on file
with the Community Development Department or as modified
by the Director of Community Development in accordance
with this Exhibit.
(1) 1.2 Unless otherwise specified, the conditions contained in
the Exhibit shall be complied with prior to the issuance
of any building permi ts for the proj ect, subj ect to
review and approval by the Community Development
Department.
(1) 1.3 Design Review approval shall become null and void unless
all building permits are issued wi thin eighteen (18)
months of the date of this Exhibit.
(1) 1.4 The applicant shall sign and return an Agreement to
Conditions Imposed form prior to issuance of building
permits.
(1) 1.5 The applicant and property owner shall hold harmless and
defend the City of Tustin from all claims and liabilities
arising out of the City's approval of the entitlement
process for this project.
Planninq Division
(1) 2.1 Tenants of the subject property only shall be permitted
use of the garage spaces, as assigned by the complex
management. Tenants shall use the garage spaces solely
for the purpose of parking operable vehicles currently
registered by the Department of Motor Vehicles for use on
public streets, roads and highways. 'Storage of personal
items may occur in the garages only to the extent that
vehicles may still be able to be parked within the
required garage spaces.

(1) 2.2 Garage doors shall remain closed whenever garages are
unattended.
Buildina Division
(3) 3.1 At building plan check, provide three (3) complete sets
of plans, including the manufacturer's brochure/
installation manual for the garage doors, complying with
the Uniform Building Code I other related Codes I Ci ty
Ordinances and state and federal laws and regulations.
(3) 3.2 Ceilings and walls at garages connected to residential
units shall be protected by materials approved for one-
hour fire rating.
Fees
(1) 4 .1 Prior to the issuance of any building permi ts, payment of
all Building plan check and permit fees shall be made to
the Community Development Department based upon the most
current fee schedule. Payment will be required based upon
those rates in effect at the time of payment and are
subject to change.
(1) 4.2 Within forty-eight (48) hours of approval of the subject
project, the applicant shall deliver to the Community
Development Department, a cashier's check payable to the
COUNTY CLERK in the amount of $38.00 (thirty-eight
dollars) to enable the City to file the appropriate
environmental documentation for the project. If within
such forty-eight (48) hour period that applicant has not
delivered to the Community Development Department the
above-noted check, the st~tute of limitations for any
interested party to challenge the environmental
determination under the provisions of the California
Environmental Quality Act could be significantly
lengthened.
