That a proper application for a Temporary Use Permit was filed by Simply Scrumptious Confections to authorize the use of a mobile mini-storage unit to temporarily accommodate an increase in business, with the unit being located in the back of 13882 Newport Avenue, Suite G. B. That a public hearing was duly called, noticed and held on said application on October 6, 1997 by the Zoning Administrator. C. That establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the heal th, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1) The manner of siting the unit will not invite transients seeking shelter. 2) There is adequate space on site to accommodate the use. 3) The design, color and materials of the unit are complimentary to the style and character of the Center. D. That the establishment, maintenance, and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin for the reasons stated in Section C above. E. It has been determined that this proj ect alteration to an existing facility and is, Categorically Exempt (Class 1) from the Environmental Quality Act. is a minor therefore, California Zoning Administrator Action 97-009 October 6, 1997 1 Page 2 2 II. The Zoning Administrator hereby approves the Temporary Use Permit to authorize the use of a mobile mini-storage unit to 3 be located behind the tenant space located at 13882 Newport Avenue, Suite G, subject to the conditions contained in 4 Exhibit A attached hereto. 5 PASSED AND ADOPTED by the Zoning Administrator of the City of 6 Tustin at a regular meeting held on the 6th day of October, 1997. 7 8 ~~~.~cl:: Zoning Administrator 9 10 11 BARBARA RE~ Recording Secretary 12 13 14 STATE OF CALIFORNIA COUNTY OF ORANGE 15 CITY OF TUSTIN 16 I, BARBARA REYES, the undersigned, hereby certify that I am the 1 7 Recording Secretary of the Zoning Administrator of the Ci ty of Tustin, California; that Zoning Administrator Action No. 97-009 was 18 duly passed and adopted at a regular meeting of the Tustin Zoning Administrator, held on the 6th day of October, 1997. 19 20 21 BARBARA REY~ Recording Secretary 22 23 24 25 26 27 28 EXHIBIT A ZONING ADMINISTRATOR ACTION 97-009 CONDITIONS OF APPROVAL TEMPORARY USE PERMIT 13882 NEWPORT AVENUE, SUITE G GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped October 6, 1997 on file with the Community Development Department, as herein modified, or as modified by the Community Development Director in accordance with this Exhibit. The Director may also approve subsequent minor modifications to plans during plan check if such modifications are consistent with provisions of the Tustin City Code or other applicable regulations. (1) 1.2 The temporary use permit will expire six months from the date of this Exhibit, or when Simply Scrumptious Confections ceases conducting business at 13882-G Newport Avenue, whichever comes first. (1) 1.3 Approval of the Temporary Use Permit is contingent upon the applicant and property owner signing and returning an "Agreement to Conditions Imposed" form as established by the Community Development Department. (1) 1.4 The applicant shall hold harmless and defend the City of Tustin from all claims and liabilities arising out of a challenge of the City's approval of this project. USE RESTRICTIONS (8) 2.1 The unit must be maintained in accordance with City of Tustin Building Maintenance Guidelines. Any graffiti must be removed wi thin twenty- four hours of the incident. (8) 2 · 2 Lighting shall be provided to illuminate the area as required by the Tustin Security Code. (8) 2.3 The mini-storage unit may not be utilized for uses not pertaining to the applicant's daily operations. Requirements of the Uniform Building Codes shall be complied wi th as approved by the Building Official. Additionally, a note on plans shall be included stating that no field changes shall be made without corrections submitted to and approved by the Building Official. FEES (1) 4.1 Prior to issuance of any building permits, payment shall (5) be made of all applicable fees, including but not limited to the following. Payment shall be required based upon those rates in effect at the time of payment and are subject to change. A. Building plan check and permit fees to the Community Development Department based on the most current schedule. (1) 4.2 Within forty-eight (48) hours of approval of the subject (5) project, the applicant shall deliver to the Community Devel.opment Department, a cashier's check payable to the COUNTY CLERK in the amount of $38.00 (thirty eight dollars) to enable the City to file the appropriate environmental documentation for the project. If within such forty-eight (48) hour period that applicant has not delivered to the Community Development Department the above-noted check, the statute of limitations for any interested party to challenge the environmental determination under the provisions of the California Environmental Quality Act could be significantly lengthened.
