SUBJECT: SB 1431 - DESIGN BUILD CONTRACTING BY CITIES, COUNTIES AND
SPECIAL DISTRICTS
SUMMARY:
Many California cities are currently precluded by the Public Contracts Code from
utilizing the design-build process to construct public projects. SB 1431 by State Senator
David Cox would revise the code to allow a City Council to authorize the use of the
process for building projects.
RECOMMENDATION:
Staff recommends that the City Council support SB 1431 as proposed by Senator David
Cox and authorize the Mayor to submit a letter of support.
DISCUSSION:
The California Public Contract Code currently requires that a city prepare all
construction documents and then release the documents for sealed bids. A
construction contract is then awarded to the lowest qualified bidder. The process can be
time consuming, inflexible and costly.
Senator David Cox has proposed Senate Bill 1431 which would allow cities to use the
design build process for building projects valued at over $2.5 million. The design-build
process has been demonstrated to effectively lower project costs and expedite project
completion by combining the design and construction phases into one bid process with
one contractor responsible for the project completion. The proposed bill would not
apply to street, road and bridge projects.
Staff is recommending that the City Council support this revision to the Public Contracts
Code due to potential cost and time saving benefits in the development of various future
public facilities in Tustin.

Dear Senator Murray;
The City of Tustin supports SB 1431 to allow cities, upon approval of the city council, to
utilize design-build contracting until January 1,2017. Currently, this method of
contracting is available only to some cities in California.
The City of Tustin supports allowing cities options to use design-build contracting in
order to bring efficiency to public contracting. Design-build contracting has shown it is
effective in reducing project cost and expediting project completion.
This bill would allow cities to use design-build if a local agency desired, allowing cities
the option of a more efficient process.
For these reasons, the City of Tustin supports SB 1431.
