HomeMy WebLinkAboutCC RES 97-501 RESOLUTION NO. 97-50 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 TUSTIN, CALIFORNIA, AUTHORIZING THE IMPLEMENTATION OF A MILLS ACT PROGRAM IN THE CITY OF TUSTIN AND 4 ESTABLISHING A POLICY FOR HISTORIC PROPERTY PRESERVATION AGREEMENTS (MILLS ACT CONTRACTS). 5 The City Council of the City of Tustin does hereby resolve as 6 follows: 7 WHEREAS, the State of California enacted the Mills Act (California Government Code section 50820 et seq.), which 8 authorizes cities ~o enter into contracts with the owners of qualified historic properties to provide for the use, 9 maintenance, and restoration of such-historical properties so as to retain their characteristics as properties of historical 10 significance; and 11 WHEREAS, the Tustin General Plan identifies the following issues related to the preservation of historic properties: 12 1) Tustin contains numerous historically and architecturally 13 significant structure whose maintenance and preservation is important to the heritage of the community. 14 2) Revitalizati©n of older residential and non-residential 15 development through rehabilitation, preservation, and redevelopment of the existing stock of land, landscaping, 16 buildings and public infrastructure is necessary to maintain the quality of an urban environment; and 17 WHEREAS, the Tustin General Plan identifies the following 18 policies related to the preservation Of historic propertieS: 19 1) Encourage the restoration and rehabilitation of properties in Tustin eligible for inclusion on the 20 National Register of Historic Places according to the rehabilitation guidelines and ~ax incentives of the 21 National Trust for Historic Preservation. 22 2) Preserve historically significant structures and sites, and encourage the conservation and rehabilitation of 23 older buildings, sites and neighborhoods that contribute to the City's historic character. 24 3) Preserve historic and architecturally significant 25 residential properties. 26 4) Retain and protect significant areas of archaeological, paleontological, or historical value for education and 27 scient'ific purposes; and 28 Resolution No. 97-50 Page 2 1 2 WHEREAS, the use of historic property preservation 3 agreements in Tustin will be limited to residential properties that are not exempt from property taxation and have an "A" 4 "B", or "C" rating in the City of Tustin Historical Resource~ Survey; and 5 WHEREAS, commercial properties in Tustin will not be 6 eligible for historic property preservation agreements because other financial assistance programs are available for 7 commercial properties; and 8 W[EREAS, properties located in Tustin redevelopment areas will not be eligible for historic property preservation 9 agreements because there would be financial impacts to the City of Tustin RedevelOpment Agency; and 10 WHEREAS, the City Council has the discretion to limit the 11 total number of historic property preservation agreemenEs or to discontinue the City's Mills Act program at any time; and WHEREAS, the City Council may establish a reasonable 13 application fee to recover the City's cost for processing historic property preservation agreements; and 14 WHEREAS, the City of Tustin Cultural Resources 'Advisory 15 Committee supports the implementation of a Mills Act program in the City of Tustin; and 16 WHEREAS, the preservation of individual historic 17 properties through the implementation of a Mills Act program in Tustin would serve the maintain the hisnorical integrity of 18 individual structures citywide, including those within the Tustin Cultural Resource District; and 19 WHEREAS, the preservation of important resources and 20 neighborhoods would have beneficial indirect effects on local businesses, economic stability and community pride. 21 NOW, THEREFORE, BE IT RESOLVED, that the'City Council of 22 the City of Tustin: 23 1o Authorizes the implementation Of a Mills Act program in the City of Tustin'and the establishment of a policy (as 24 described herein) for historic property preservation agreements (Mills Act contracts); and 25 2.
