HomeMy WebLinkAboutCC RES 97-49 RESOLUTION NO. 97-49 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE CITYMANAGER 3 TO CAST THE CITY'S ASSESSMENT BALLOTS FOR THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT IN FAVOR 4 OF THE PROPOSED ASSESSMENTS, BEGINNING FISCAL YEAR 1997/98 8 WHEREAS, Article XIIID of the California Constitution, requires that public properties within an Assessment District be assessed if 7 the property is specially benefited by the improvements to be installed or maintained. 8 WHEREAS, the Engineer's Report for the Tustin Landscaping and 9 Lighting District indicates that certain City owned properties are specially benefited by the Tustin Landscaping and Lighting District ~0 improvements; and WHEREAS, the City Council desires to authorize the City Manager to complete and timely submit the City's Assessment Ballots in the Assessment Ballot proceeding for the Tustin Landscape and Lighting District. ~3 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, finds, determines and orders as follows: ~5 SECTION 1: That the City Council approves the Assessments for City owned property for the Tustin Landscape and Lighting ~8 District, beginning with fiscal year 1997/98. ~7 SECTION 2: That the City Manager is hereby authorized to complete each of the City's Assessment District Ballots, to mark the ~8 ballots in favor of the proposed assessments, and to timely return them to the City Clerk on or before July 7, 1997. ~9 PASSED AND ADOPTED at a regular m eting of the City Council of 20 the City of Tustin on the 2nd day of June, 1997. 22 JE~~ M .~HOMAS, ~L~O~ 23 ATTEST: 24 PAMELA STOKER 28 CITY CLERK 27 28 City of Tustin RESOLUTION CERTIFICATION STATE OF CALIFORNIA ) COUNTY OF ORANGE ) ss CITY OF TUSTIN ) RESOLUTION NO. 97-49 Pamela Stoker, City Clerk and ex-officio Clerk of the City Council of the City of Tustin, California, does hereby certify that the whole number of the members of the City Council is five; that the above and foregoing resolution was passed and adopted at a regular meeting of the City Council held on the 2nd day of June, 1997, by the following vote: COUNCILMEMBER AYES: Thomas, Saltarelli, Doyle, Potts, Worley COUNCILMEMBER NOES: None COUNCILMEMBER ABSTAINED: None COUNCILMEMBER ABSENT: None Pamel~ Stoker,
