WEST, CITY MANAGER SUBJECT:RESOLUTION MODIFYING THE SCHEDULE OF THE REGULAR CITY COUNCIL MEETINGS AND PLANNING COMMISSION MEETINGS AND SETTING PUBLIC HEARINGS REGARDING THE TRANSITION FROM AT-LARGE TO DISTRICT ELECTIONS SUMMARY: Consider revising the schedule of the regular meetings of theTustin City Council and Planning Commission and setting public hearings regarding the transition from at-large to district elections. RECOMMENDATION: That the City Council adopt Resolution Number 21-84 approving a modified schedule of regular meetings of the City Council and Planning Commission, setting public hearings regarding the transition from at-large to district elections, and allowing in-person participation in City Council, Planning Commission and other City legislative body meetings. FISCAL IMPACT: There is no fiscal impact associated with this item. BACKGROUND: On September 7, 2021,the City Council adopted Resolution 21-78 confirmingits intention to transition from at-large to district-based elections. Tosupportthis process, the City will conduct two public workshops and the City Council will conduct five public hearingswithin a 90-day timeframe to ensure protection from Voting Rights Act.To complywith the 90-day timeframe, the City Council would need to adopt anordinance establishing district-based elections by Monday, November 1, 2021. In order to meet the November 1 deadline, theCity Council will need to conducttwo public hearings during regular meetingson Monday, October 25, 2021,and Monday, November 1, 2021. Those open session meetings would be scheduled to start at 6:30 with the public Modification of the City Council Regular Meeting Schedule and Setting Public Hearings Regarding the Transition From At-Large To District Elections September 21, 2021 Page 2 hearings on district- there will be a special meeting Public Hearing on the transition to district-based elections on October 9, 2021, at 10:00 a.m. Tustin City Code section 1301 provides that the time and location of one or more regular meetings of the City Council regular Council meetings may be approved by City Council Resolution approved at the least 14 calendar days prior to the meeting date. In addition, regular meetings of the City Council will be scheduled every first and third Tuesday of each month, commencing November 16, 2021, at the following times: Closed session: 5:00 p.m. Open Session: 6:30 p.m. Similarly, Resolution 21-84 would continue the regular meeting schedule for the Planning Commission. Regular Meetings of the Planning Commission will continue to occur on the second and fourth Tuesday of each month, commencing at 6:00 p.m. Finally, Resolution 21-84 would provide that the Council, the commissioners and the public may attend and participate in person at City Council, Planning Commission or other City legislative body meetings, and that any then-applicable measures imposed by State or County health officials for the protection of public health would be adhered to during such meetings.
