HomeMy WebLinkAboutCC RES 85-110RESOLUTION NO. 85-110 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, UPHOLDING THE PLANNING COMMISSION'S DENIAL OF.'CONDITIONAL USE PERMIT NO. 85-20 FOR A SATELLITE DISH ANTENNA AT 13201 SILVER .BIRCH DRIVE. The Ctty Council of the City of Tustin does hereby resolve as fol lows- I. The City Council fi nds and determine$ as fol lows' A. That a proper application, (Use Permit No. 85-20) was filed by Mr. Lawrence Bente requesting authorization to retain a twelve (12) foot diameter satellite dish in the rear yard of 13201 Silver Birch Drive in the R-l, Single Family zone. B. That the Planning Commission held, noticed and called a public hearing on Use Permit Application No. 85-20 on September 9, 1985. C. That the Planning Commission denied Use Permit No. 85-20 for the fol 1 owl ng reasons' 1. That the establishment, maintenance, and operation of the .... use applied for would be injurious or detrimental to the property and improvements in the neighborhood Of the subject property, and the general welfare of the City of Tustin. 2. That the intent of TUstin Ordinance No. 926 was to obscure (till residential satellite dish antennae from public view. 3. That the use applied for would adversely impact the visual quality of the surrounding neighborhood by reason of its appearance, height and location. · D. On October 10, 1985 an appeal of the Commission's decision was fi led by Mr. Lawrence Bente requesting that the City Council reverse the deci si on of the Planning Commi ssi on. E. That a public hearing was duly called, noticed and held on said appeal. II. The City Council hereby upholds the decision of the Planning Commission denying Use Permit No. 85-20 for the following reasons' A. That the establishment, maintenance, and operation of the use applied for will be injurious or detrimental to the property and improvements in the neighborhood of the subject property, and the general welfare of the City of Tustin. B.
