RECOMMENDATION
That the Zoning Administrator adopt Zoning Administrator Action (ZAA) No. 21-008
approving Conditional Use Permit (CUP) 2021-0023 to allow on-site sales and
consumption of beer and wine (Type 41 ABC license) in conjunction with an existing
restaurant establishment (Nosh House) located at 678 EI Camino Real.
APPROVAL AUTHORITY
The project site is located within Development Area 6B of the DCCSP. Alcoholic
beverage establishments with on-site sales and consumption of alcohol are permitted in
Development Area 6B subject to the approval of a CUP. Pursuant to Section 9299b(3)(g)
of the Tustin City Code (TCC), the Zoning Administrator has the authority to review and
approve on-site alcoholic beverage sales establishments.
BACKGROUND
Location and Surrounding Properties
The project site is located within the southerly portion of an existing multi-tenant commercial
center located at the intersection of EI Camino Real and EI Camino Way (Figure 1). The site
is bounded by EI Camino Real and EI Camino Way to the east, the 1-5 Freeway and an
office building to the south, commercial buildings to the west, and the northerly portion of
the commercial center to the north. All surrounding properties are within Development Area

Nosh House occupies what was originally two (2) separate tenant spaces (676 and 678 EI
Camino Real), which were combined into one (1) tenant space in 2007, and retained the
678 EI Camino Real address. The restaurant has served food and non-alcoholic beverages
since it opened for business in 2020. The applicant seeks to obtain approval for a Type 41
ABC license, which would allow the sale and consumption of beer and wine in conjunction
with the restaurant.
PROJECT DESCRIPTION
Project Summary
The applicant is requesting authorization for on-site alcoholic beverage sales and
consumption of beer and wine (ABC License Type 41) in conjunction with a restaurant
located in a multi-tenant commercial center. The existing restaurant includes an interior
dining area of approximately 450 square feet with fourteen (14) seats and a temporary
outdoor seating area of about 225 square feet with sixteen (16) seats (Figure 2). The
outdoor seating area is approved as a temporary dining space pursuant to the regulatory
relief measures provided by the City in response to the COVID-19 pandemic. No
improvements to the tenant space are proposed as part of this application.

Alcoholic Beverage Sales
The sale of alcoholic beverages for on-site consumption can be authorized in conformance
with the City's Alcoholic Beverage Sales Establishment Guidelines as adopted by the
Planning Commission on March 13, 2018, and TCC Section 9271(dd). Pursuant to TCC
Section 9271(dd), on-site alcoholic beverage sales, which includes on-site sale of alcohol
at restaurants for on-site consumption, are exempt from distance separation requirements
to sensitive uses and other alcoholic beverage sales establishments. As proposed and
conditioned, food would continue to be sold during all hours the establishment is open for
business. The business currently also provides its patrons the option to dine within a
temporary outdoor dining area approved pursuant to the City's COVID-19 relief efforts.
Alcoholic beverages will be served in the temporary outdoor dining space in conformance
with the conditions of approval for Temporary Use Permit 2020-0104 and applicable
regulations from the State Alcoholic Beverage Control Department. Per City Council
Resolution 21-39, the temporary outdoor dining space is allowed to remain until December
31, 2021. The City is currently considering potential opportunities for facilitating the process
to transition a temporary outdoor dining space into a permanent operation. Under existing
regulations, the establishment of permanent outdoor dining spaces requires Design Review
approval.
As proposed, the indoor seating area would be used for food and drink consumption with no
proposed bar area. The application indicates that approximately 90 percent of sales are
estimated to be from food and ten (10) percent from alcoholic beverages. The applicant will
continue to offer a full food menu and proposes to have operating hours as described in the
table below. Proposed Condition No. 2.4 of ZAA No. 21-008 requires food to be available
on the premises during all hours of operation. The business will also continue to provide its
patrons the option to dine outdoors while the temporary outdoor dining permit remains valid.
In the event the operator wishes to operate an outdoor dining area with alcohol service
outdoors, past December 31, 2021, the applicant may submit an administrative modification
request for consideration by the Community Development Director.
Business Hours
The applicant proposes the following hours of operation for the restaurant:
Sunda -Thursda From 9:00 a.m. to 7:00 P.M.
Friday From 8.00 a.m. to 2:00 .m.
SaturdayClosed
Pursuant to TCC Section 9271(dd), establishment hours of operation may extend until 2:00
a.m. daily unless otherwise restricted. The Tustin Police Department has no concerns
regarding the proposed hours of operation.

Parking
The project site is within an existing multi-tenant commercial center. The existing tenant
space was previously approved for a restaurant use and no improvements nor
expansions are proposed as part of this application. No additional parking is required for
the sale of on-site alcoholic beverages of beer and wine. Therefore, all parking
requirements are satisfied.
CONCLUSION
Based on this report and the findings and conditions of approval contained in ZAA No. 21-
008, staff recommends that the Zoning Administrator adopt ZAA No. 21-008 approving CUP
2021-0023 to allow the on-site sales of beer and wine for on-site consumption in
conjunction with an existing restaurant establishment (Nosh House) located at 678 EI
Camino Real.

ZONING ADMINISTRATOR ACTION NO. 21-008
ZONING ADMINISTRATOR ACTION 21-008
CONDITIONAL USE PERMIT 2021-0023
678 EL CAMINO REAL
The Zoning Administrator of the City of Tustin does hereby resolve as follows:
I. The Zoning Administrator finds and determines as follows:
A. That a proper application for Conditional Use Permit (CUP) 2021-0023 was filed
by Clive Wolder of Orange County Kosher Market, requesting authorization to
allow the on-site sale and consumption of beer and wine in conjunction with an
existing bona fide restaurant (Nosh House) for the property located at 678 EI
Camino Real.
B. The project site is within Development Area 6B of the Downtown Commercial Core
Specific Plan (DCCSP, DA-613). Pursuant to Tustin City Code (TCC) Section
9271(dd), the DCCSP, DA-613 permits on-site alcoholic beverage sales in
conjunction with a restaurant subject to the approval of a CUP. Pursuant to Section
9299b(3)(g) of the TCC, the Zoning Administrator has the authority to review and
approve CUPs for on-site alcoholic beverage sales licenses for restaurants.
C. The restaurant use was established in 2020 and has served food and non-alcoholic
beverages, but has not served alcoholic beverages.
D. That a public hearing was duly called, noticed, and held for CUP 2021-0023 on
September 30, 2021, by the Zoning Administrator.
E. That the establishment, maintenance, and operation of the proposed use will not,
under the circumstances of this case, be detrimental to the health, safety, morals,
comfort, or general welfare of the persons residing or working in the
neighborhood of such proposed use, nor be injurious or detrimental to the
property and improvements in the neighborhood of the subject property, or to the
general welfare; the location, size, architectural features and general
appearance of the proposed development will not impair the orderly and
harmonious development of the area, the present or future development therein,
the occupancy thereof, or the community as a whole of the City in that:
1) The proposed sale of on-site alcoholic beverages, in conjunction with an
existing restaurant use, is allowed within the DCCSP, DA-613 with the
approval of a CUP (TCC Section 9271(dd)).
Zoning Administrator Action 2021-008
CUP 2021-0023 (Type 41 ABC License)
Page 2
2) Pursuant to TCC Section 9271 (dd), bona fide restaurants with on-site
alcoholic beverage sales are exempt from distance separation
requirements to residential uses, sensitive uses, and other alcoholic
beverage sales establishments.
3) As conditioned, the proposed on-site consumption of beer and wine within
an existing restaurant establishment is consistent with the City's Alcoholic
Beverage Sales Establishment Guidelines as adopted by the Planning
Commission on March 13, 2018, TCC Section 9271 (dd), and Ordinance No.
1493, all of which support economic development opportunities to remove
hurdles and zoning obstacles that have prohibited the expansion and/or
attraction of alcoholic beverage establishments in the City.
4) No expansion of the existing tenant space is proposed; therefore, no
parking impacts are anticipated.
5) The existing and proposed on-site consumption of alcoholic beverages
would be in conjunction with a restaurant use where food will be served at
all times when alcoholic beverages are served.
6) The restaurant is located within a commercial center and a commercial
corridor along EI Camino Real where a variety of retail, office, and
restaurant uses are located. The restaurant requests to operate Sunday
through Thursday from 9:00 a.m. to 7:00 p.m. and Friday from 8:00 a.m. to
2:00 p.m. The restaurant will be closed on Saturdays. These hours are
consistent with the characteristics of restaurant uses and the hours of
operation of the restaurant would be similar to other restaurants in the
vicinity.
7) The City's Police Department has reviewed the application and has no
immediate concerns.
F. This project is Categorically Exempt pursuant to Section 15301 (Class 1) of the
California Code of Regulations (Guidelines for the California Environmental Quality
Act).
11. The Zoning Administrator hereby approves CUP 2021-0023 authorizing the on-site sale
of beer and wine (Type 41 ABC License) for on-site consumption in conjunction with
an existing restaurant (Nosh House) located at 678 EI Camino Real, subject to the
conditions contained within Exhibit A, attached hereto.

GENERAL
1.1 The proposed project shall substantially conform with the submitted plans
for the project on file with the Community Development Department, as
herein modified, or as modified by the Community Development Director

modifications are consistent with provisions of the Tustin City Code (TCC).
1.2 The conditions contained in this Exhibit shall be complied with as specified,
subject to review and approval by the Community Development
Department.
1.3 This approval shall become null and void unless the use is established
within twelve (12) months of the date of this Exhibit. Time extensions may
be granted if a written request is received by the Community Development
Department within thirty (30) days prior to expiration.
1.4 Approval of Conditional Use Permit (CUP) 2021-0023 is contingent upon the
applicant and property owner signing and returning to the Community
Development Department a notarized "Agreement to Conditions Imposed"
form and the property owner signing and recording with the County Clerk-
Recorder a notarized "Notice of Discretionary Permit Approval and
Conditions of Approval" form. The forms shall be established by the
Community Development Director, and evidence of recordation shall be
provided to the Community Development Department.
Failure to comply with the conditions of approval of the establishment
creates undue burden to City resources, or if the CUP is abandoned for a
twelve (12) month period, these circumstances shall be grounds for
revocation of the CUP.
1.5 Any transfer of ownership of the establishment and/or operator shall
require the new owner and/or operator to sign and return an "Agreement
to Conditions Imposed" form provided by the Community Development.
Failure to do so would be a basis for revocation proceeding.
1.6 Any violation of any of the conditions imposed is subject to the issuance of
an Administrative Citation pursuant to TCC Section 1162(a).

1.7 CUP 2021-0023 may be reviewed on an annual basis, or more often if
necessary, by the Community Development Director. The Community
Development Director shall review the use to ascertain compliance with
conditions of approval. If the use is not operated in accordance with CUP
2021-0023, or is found to be a nuisance or negative impacts are affecting
the surrounding tenants or neighborhood, the Community Development
Director shall impose additional conditions to eliminate the nuisance or
negative impacts, or may initiate proceedings to revoke the CUP.
1.8 As a condition of approval of CUP 2021-0023, the applicant shall agree, at
its sole cost and expense, to defend, indemnify, and hold harmless the City,
its officers, employees, agents, and consultants, from any claim, action, or
proceeding brought by a third party against the City, its officers, agents, and
employees, which seeks to attack, set aside, challenge, void, or annul an
approval of the City Council, the Planning Commission, or any other
decision-making body, including staff, concerning this project. The City
agrees to promptly notify the applicant of any such claim or action filed
against the City and to fully cooperate in the defense of any such action.
The City may, at its sole cost and expense, elect to participate in the defense
of any such action under this condition.
1.9 The applicant shall be responsible for costs associated with any necessary
code enforcement action, including attorney's fees, subject to the applicable
notice, hearing, and appeal process as established by the City Council by
ordinance.

regulations. Any violations of the regulations of the Department of Alcoholic
Beverage Control (ABC) as they pertain to the subject location, or of the
City of Tustin, as they relate to the sale of alcoholic beverages, may result
in the revocation of the subject CUP, as provided by the TCC.
