CALLED TO ORDER: 10:01 a.m. (via Zoom) ROLL CALL: Justina Willkom, Zoning Administrator PUBLIC CONCERNS: No public input received. CONSENT CALENDAR: None PUBLIC HEARING: Opened the Public Hearing at 10:06 a.m. 1. CONDITIONAL USE PERMIT(CUP) 2021-0022 APPLICANT: DEVIN DUGAN IMPROVCITY 138 W. MAIN STREET TUSTI N, CA 92780 PROPERTY OWNER: JONATHAN M. POVEY ON BEHALF OF CELEST POVEY P.O. BOX 985 VERDI, NV 89439 LOCATION: 138 WEST MAIN STREET ENVIRONMENTAL STATUS: This project is Categorically Exempt (Class 1) pursuant to Section 15301 of the California Environmental Quality Act. REQUEST: A request to offer alcoholic beverage sales for on-site consumption in conjunction with accessory live entertainment performed by students and instructors of an existing improvisation instructional studio. RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action (ZAA) No. 21-007, approving Conditional Use Permit (CUP) 2021-0022 to allow the sale of beer for on- site consumption (Alcoholic Beverage Control License Type 40) in conjunction with Zoning Administrator Action Minutes September 16, 2021 Page 2 accessory live entertainment performed by students and instructors of an existing improvisation instructional studio. The Zoning Administrator, Justina Willkom, asked all Zoom attendees to identify themselves for the record. In attendance were: Irma Huitron (Assistant Director) Scott Reekstin (Principal Planner), Elaine Dove (Senior Planner), and Vera Hurtado (Executive Assistant)—City of Tustin. Meeting paused in order to allow the applicant, Devan Dugan, to enter into the webinar. Devan Dugan, applicant, entered the webinar and introduced himself, for the record. At 10:06 a.m. Hurtado confirmed there was no public input received. Willkom provided brief agenda item information for the attendees as well as for the record. Dove provided a brief presentation of the agenda item. Willkom opened the Public Hearing at 10:06 a.m. Willkom asked Mr. Dugan if he had any questions or concerns regarding the report and the Conditions of Approval. Mr. Dugan confirmed receipt of the report and Conditions of Approval and he did not have any questions of staff. Willkom then asked Mr. Dugan what his intent was in requesting a Type 40 alcohol license. In response to Willkom's question, Mr. Dugan stated that per the State Alcohol Beverage Control, if he requested a Type 40 license he could have all ages on the premises when beer is being served during the showcases, classes, etc. If Mr. Dugan requested a Type 41 license, only ages 21 and over would be allowed during the showcases, classes, etc. Willkom confirmed she had read the agenda report and she did not have any further questions. At 10:07 a.m. Hurtado confirmed there was no public input received. Willkom closed the Public Hearing at 10:07 a.m. Willkom adopted ZAA 21-007.
