HomeMy WebLinkAbout05 PC REPORT - SENATE BILL 9 & 10 MEETING DATE: OCTOBER 12, 2021 TO: PLANNING COMMISSION FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: PRESENTATION - SENATE BILL NOS. 9 AND 10 OVERVIEW RECOMMENDATION: That the Planning Commission receive and file this item. DISCUSSION: On September 16, 2021, Governor Newsom signed into law Senate Bill 9 (SB 9) and Senate Bill 10 (SB10). Both bills are intended to help alleviate the affordable housing crisis by easing land use and California Environmental Quality Act (CEQA) barriers to increase density and streamline the production of multi-family housing development statewide. Staff will provide a presentation that summarizes the key bill provisions. SB 9 bill creates opportunities for greater infill housing density by requiring cities to ministerially approve certain housing development projects containing up to two (2) residential units (i.e., duplexes) on single-family zoned parcels, without discretionary review or a hearing. Additionally, SB 9 requires ministerial approval of a parcel map for an urban lot split creating two (2) new lots if certain criteria are met. SB 10 creates a voluntary process for cities to access a streamlined zoning process for new multi-unit housing. The bill authorizes cities to adopt an ordinance increasing density to allow up to ten (10) dwelling units on any parcel, at a height specified in the ordinance if the parcel is in a transit-rich area or an urban infill site as defined. Pursuant to SB 10, adoption of such an ordinance would be exempt from the California Environmental Quality Act (CEQA). AGENDA REPORT ITEM #5
