The Building Industry Association of Southern California—Orange County Chapter respectfully
requests Council action on Staff Recommendation 2 and/or 3 as a means of removing a
regulatory burden that limits housing production. California is in the midst of a housing crisis SECRETARY

brought about by a historic imbalance of supply and demand. Policies complicating a home TAYLOR MORRISON
builder's ability to produce supply require stern review.
By way of background, the Building Industry Association of Southern California, Orange TRADE CONTRACTOR VP

champion housing as the foundation of vibrant and sustainable communities.
Specifically,BIA/OC is asking the City of Tustin to prepare a draft moratorium or full repeal of ASSOCIATE MEMBER VP
the current inclusionary zoning ordinance so that such language can be debated and adopted at a MARK HIMMELSTEIN
future Council Hearing. As you may be aware, the City of Santa Ana enacted an extremely NEWMEYER&DILLION,LLP
burdensome Inclusionary Zoning Policy,known as the Housing Opportunity Ordinance(HOO)
in 2015. From 2016 to 2019, 2,900 units were approved by the city,but not a single unit was MEMBER AT LARGE
built, and zero dollars of affordable housing funds were generated. PETER VANEK

As soon as Santa Ana reduced their fee, hundreds of units applied for building permits and
construction again occurred. This is a direct and tangible example of how fees, especially

supply of housing in ways that contribute to the ever-escalating affordability crisis across the CDS CASTLE,8 NICHOLSON

spectrum in Southern California. We ask that you apply this understanding to Tustin and remove
the inclusionary hurdle.
