AGENDA REPORT ITEM 43 MEETING DATE: NOVEMBER 23, 2021 TO: PLANNING COMMISSION FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: TEMPORARY OUTDOOR DINING AND SERVICES PROGRAM UPDATE SUMMARY: A status update on the Temporary Outdoor Dining and Services Program. RECOMMENDATION: That the Planning Commission receive and file this item. BACKGROUND/DISCUSSION: The City established the Temporary Outdoor Dining, Retail and Assembly Uses Program (Program)and application fee waiver on June 2, 2020, in response to the onset of the global COVID-19 pandemic. On May 18, 2021 , the City Council granted the first Program extension which was set to end on December 31, 2021. On November 16, 2021, the City Council extended the Program to September 30, 2022. The purpose of the Program is to facilitate outdoor dining and outdoor retail and assembly uses on private property and/or within the public right-of-way while protecting the public interest. Under the Program guidelines, the temporary outdoor dining and outdoor retail sales or assembly areas may be located adjacent to, or in the vicinity of, a permitted restaurant, cafe, or retail business on private property, public property, or within the public rig ht-of-way. The purpose of further extending this Program is to provide staff and Program participants with an appropriate period of transition for those who are interested in converting their temporary, outdoor expansions into permanent operation. In addition, on November 10, 2021 , the City launched an outdoor dining and services online survey to gather community input. The online survey provides patrons, residents, and businesses an opportunity to provide feedback on their preferences and experiences in using outdoor spaces during the COVID pandemic. The flyer with the online survey links is attached to this report. The online survey is available in English and Spanish.
