HomeMy WebLinkAboutPC RES 3800l0 14 l? 20 2! ?.3 24 RESOLUTION NO. 3800 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN DETERMINING THAT THE LOCATION, PURPOSE, AND EXTENT OF THE PROPOSED EASEMENT FOR STREET AND HIGHWAY PURPOSES AT PETERS CANYON ROAD AND SILVERADO TERRACE CONFORMS WITH THE TUSTIN GENERAL PLAN. The Planning Commission does hereby resolve as follows' The Planning Commission finds and determines.as follows' A. That the County of Orange Public Facilities and Resources Department proposes to grant an easement to the City of Tustin for street and highway purposes to accommodate the entrance to Tentative Tract Map 15993. The easement is approximately sixty (60) feet in width and twenty-five (25) feet in length and extends over the County of Orange regional multi-use trail that extends along the west side of Peters Canyon Road. Bi That California Government Code Section 65402 (b) provides that a county shall not acquire or dispose of real property until the location, purpose, and extent of the project has been reported upon by the local planning agency as to the conformity with the applicable, adopted general plan. C, That the location of the entrance to Tentative Tract Map 15993 was approved by the Planning Commission and City Council in accordance with the Tustin General Plan and the East Tustin Specific Plan. D! That general plan conformity determinations required by Government Code Section 65402(b) are not "projects" requiring environmental review pursuant to the California Environmental Quality Act. II. The Planning Commission hereby determines that the location, purpose, and extent of the easement to be granted by the County of Orange Public Facilities and Resources Department to the City of Tustin for street and highway purposes conforms with the Tustin General Plan. 10 14 19 20 2! 22 23 24 26 2? 28 29 Resolution 3800 August 27,2001 Page 2 ELIZABETH A.
