HomeMy WebLinkAboutCC RES 85-081I · RESOLUTION NO. 85-81 A RESOLUTION OF THE CITY COUNCIL OF THE CALIFORNIA, WAIVING THE REQUIREMENT OF A TEN FOOT IRREVOCABLE OFFER OF DEDICATION ALONG REDHILL AVENUE FOR THE PROJECT APPROVED BY USE PERMIT 85-13 AT 13872 RED HILL The City Council does hereby resolve as follows; A That a proper application (Use Permit No. 85-13) has been filed by Mr. George Hillyard on behalf of Mobil Oil Corporation requesting authorization to install a cashier's booth and mini market in an existing 167 sq. ft. area in the service station located at 13872 Red Hill Avenue. That a public hearing was duly called, noticed and held by the Planning Commission of the City of Tustin, on June 24, 1985 on said application. C The Planning Commission approved Use Permit 85-13 by the adop ti on of Resol uti on No. 2228 whi ch authori zed the installation of a 167 square foot mini market and cashier's booth within the existing sales area at 13872 Red Hill Avenue as applied for, subject to the following conditions' 1. Any mi ssing or damaged public improvements shall be installed or replaced. · Annexation to Street Lighting District No. 1. 3. Installation of marbelite street lights shall be .provided wi th underground conduit as required. 4. Provide an irrevocable offer of dedication of ten (10') feet along Red Hill Avenue and an appropriate corner cut off to accomodate curb return radius. 0 Construction of a handicap ramp at the curb return per City Standard Drawing Number 124 A & B will be required. 6. Final development plans shall require the review and approval of the Community Development Department. 7. The provisions of the Use Permit do not cover the authorization for the sale of alcoholic beverages. 8. Prior to conversion to the mini-market, a sign plan shall be submitted to and approved by the Community Development Department. On June 14, 1985 the applicant filed an appeal of the Conditions of Approval for Use Permit 85-13 to the Tustin City Council. E. A public hearing before the City Council was duly called, noticed and held on said appeal. II. The City Council hereby upholds Planning Commission Permit 85-13 with the following amendment' approval of Use A. Condition No. II. A. 4 of Planning C. ommission Resolution Number 2246 pertaining to an irrevocable offer of dedication of ten (10') feet along Red Hill Avenue is hereby deleted.
