DESIGN REVIEW 98-034

The Zoning Administrator of the City of Tustin does hereby resolve as follows:
The Zoning Administrator finds and determines as follows:
A. That a proper application, Design Review 98-034, was filed by Jeff Bergsma
requesting authorization to alter the exterior of two existing commercial
buildings, re-pave the parking lot and install landscaping on the property
located at 719 - 765 EI Camino Real.
B. Pursuant to City Code Section 9299(b)(3)(i), the Zoning Administrator has the
authority to approve Design Review applications for projects within the Town
Center Redevelopment Project Area.
C. Pursuant to Section 9272 of the Tustin Municipal Code, the Zoning
Administrator finds that the architectural features, materials and colors will not
impair the orderly and harmonious development of the area, the present or
future development therein, or the occupancy as a whole. In making such
findings, the Zoning Administrator has considered at least the following items:
1. Setbacks and site planning.
2. Exterior materials and colors.
3. Landscaping, parking area design and traffic circulation.
4. Location, height and standards of exterior illumination.
5. Physical relationship of proposed structures to existing structures in the
neighborhood.
6. Appearance and design relationship of proposed structures to existing
structures and possible future structures in the neighborhood and public
thoroughfares.
7. Development Guidelines and criteria as adopted by the City Council.
D. That the proposed project is categorically exempt (Class 1) pursuant to the
California Environmental Quality Act Section 15301.
The Zoning Administrator hereby approves Design Review 98-034 to authorize
exterior alteration of two existing commercial buildings, re-paving of the parking lot
and installation of landscaping at the property located at 719 - 765 EI Camino Real,
subject to the conditions contained in Exhibit A attached hereto.

CONDITIONS OF APPROVAL
DESIGN REVIEW 98-034
GENERAL
(1) 1.1 The proposed project shall substantially conform with the submitted plans for
the project date stamped August 12, 1999, on file with the Community
Development Department, as herein modified, or as modified by the Director
of Community Development Department in accordance with this Exhibit. The
Director of Community Development may also approve subsequent minor
modification to plans during plan check if such modifications are to be
consistent with provisions of the Tustin City Code.
(1) 1.2 Design Review approval shall become null and void unless building permits
are issued within eighteen (18) months of the date of this Exhibit.
(1) 1.3 The applicant shall sign and return an Agreement to Conditions Imposed form
prior to the issuance of any permits.
(1) 1.4 All conditions in this Exhibit shall be complied with prior to the issuance of any
building permits for this project, subject to review and approval of plans by the
Community Development Department.
(1) 1.5 The applicant shall hold and defend the City of Tustin from all claims and
liabilities arising out of a challenge of the City's approval for this project.
PLAN SUBMITTAL
(1) 2.1 Indicate on the title sheet the applicable codes, City Ordinances, and the State
and federal laws and regulations including:
. 1997 Uniform Building Code other related building codes with California
Amendments;
. 1996 National Electrical Code with California Amendments;
. T-24 California Disabled Access and Energy Conservation; and,
. City of Tustin Ordinances.

(3) 2.2 Complete plans and specifications shall be provided for architectural,
structural including the soils report, electrical, mechanical, plumbing to comply
with T-24 for energy conservation and disabled access regulations.
(5) 2.3 The plans shall comply with the City of Tustin's Security Ordinance.
(5) 2.4 In compliance with the City of Tustin's Construction Standards, alteration of
drainage, vegetation, circulation, street sections, curbs, gutters, sidewalks,
and storm drains shall comply with the on-site private improvement standards.
(5) 2.5 As may be applicable, prior to issuance of building permits, a separate 24" x
36" street improvement plan, as prepared by a California Registered Civil
Engineer, will be required for all construction within the public right-of-way.
Construction and/or replacement of any missing or damaged public
improvements will be required adjacent to this development. Said plan shall
include, but not be limited to the following:
. Curb and gutter;
· Sidewalk, including curb ramps for the physically disabled;
. Drive aprons;
· Signing/striping plan;
. Domestic water facilities;
. Sanitary sewer facilities;
· Underground utility connections; and,
In addition, a 24" x 36" reproducible construction area traffic control plan, as
prepared by a California Registered Traffic Engineer or Civil Engineer
experienced in this type of plan preparation will be required.
(5) 2.6 Prior to any work in the public right-of-way, an Encroachment Permit must be
obtained from and applicable fees paid to the Public Works Department.
(1) 2.7 A detailed signage plan shall be submitted to the Community Development
Department for review and approval prior to the issuance of permits for any
sign.
SITE PLAN
(1) 3.1 A total of 35 parking spaces shall be provided. The dimensions and location
of the proposed off-street parking spaces shall be illustrated and a parking
summary shall be provided on the site plan. The number of off-street parking
spaces for new uses shall comply with the parking requirements as stated in
the Ambrose Lane Planned Community regulations.

(4) 3.2 Prior to issuance of building permits, details of the proposed pavement and
asphalt specifications shall be provided to the Community Development
Department for approval.
(1) 3.3 The site plan shall indicate the size and location of all the off-street parking
spaces provided. The standard size of the parking spaces shall be nine (9)
feet wide and twenty (20) feet in length.
(3) 3.4 Indicate paths of travel from the street sidewalk and disabled access parking
spaces to the entrance of the building without passing through the driveway
and behind other parking spaces other than his or her own. Also, locate the
access aisle on the passenger side. The plans must comply with the
Americans with Disabilities Act (ADA).
(5) 3.5 Show the location of all exterior lighting on the site, including the lights located
in the parking lot and landscape areas. Location of lights shall be reviewed
and approved by the Community Development Department, prior to issuance
of building permits.
(5) 3.6 Consistent with existing conditions, the menu board shall be a minimum
distance of forty (40) feet from the pick-up window. The location and design of
the menu board and pick-up window shall be shown on the plans.
(5) 3.7 The existing phone kiosk in front of the existing restaurant adjacent to the
public right-of-way shall be removed prior to issuance of a Certificate of
Occupancy.
(3) 3.8 Current Federal Americans with Disabilities Act (ADA) requirements will need
to be met at the drive aprons and shown on the street improvement plans.
This may require construction of a minimum four (4) foot wide sidewalk behind
the drive apron, as determined by the Public Works Department. The
maximum cross slope of the sidewalk shall be two percent and the maximum
ramp slope of the drive apron shall be ten percent. This may require
dedication of additional right-of-way to accommodate the sidewalk
construction. Prior to issuance of building permits, a legal description and
sketch of the dedication area, as prepared by a CA Registered Civil Engineer
and/or CA Licensed Land Surveyor, shall be submitted to the Engineering
Division for review and approval.
FLOOR PLANS
(3) 4.1 Indicate the type of construction and group of occupancy for the building on
the plans.

ELEVATIONS
(4) 5.1 All colors and materials shall be reviewed and approved by the Community
Development Department prior to the issuance of building permits.
(4) 5.2 Show the location, design and material of all wall mounted lighting on the
elevations. The proposed lighting shall be reviewed and approved by the
Community Development Department, prior to issuance of a building permit.
(4) 5.3 Provide elevations and details depicting the exterior lighting type and location
on the site, including the parking lot and the landscape areas. The proposed
exterior lighting shall comply the City of Tustin Security Ordinance and shall
be reviewed and approved by the Community Development Department, prior
to issuance of building permits.
LANDSCAPING
(6) 6.1 A landscape and irrigation plan shall be submitted to the Community
Development Department for review and approval prior to the issuance of
building permits. The plan shall be consistent with the landscape plan dated
August 5, 1998, approved by the Redevelopment Agency pursuant to the
Disposition Development Agreement.
NOISE
(5) 7.1 All construction operations including engine warm up shall be subject to the
provisions of the City of Tustin Noise Ordinance, as amended, and may take
place only during the hours of 7:00 a.m. until 6:00 p.m., Monday through
Friday and 9:00 a.m. until 5:00 p.m. on Saturday unless the Building Official
determines that said activity will be in substantial conformance with the Noise
Ordinance and that public health and safety will not be impaired subject to
application being made at the time the permit for the work is awarded or
during progress of the work.
(5) 7.2 Construction hours shall be clearly posted on the project site to the
satisfaction of the Building Official.
FIRE
(5) 8.1 Prior to the issuance of any building permits, plans for the automatic fire
sprinkler system shall be submitted to and approved by the Fire Chief prior to
installation. This system shall be operational prior to the issuance of a
certificate of use and occupancy.
(5) 8.2 Prior to the issuance of any building permits, the applicant shall submit a
detailed letter of intended use for each building to the Fire Chief for review and
approval.

(5) 8.3 Prior to the issuance of any building permits, the applicant shall contact the
Orange County Fire Authority Hazardous Materials Disclosure Office at (714)
744-0463 to obtain a "Hazardous Materials Business Information and Chemical
Inventory Packet". This shall be completed and submitted to the Fire Chief
before the issuance of any building permits.
(5) 8.4 Prior to issuance of any building permits, the applicant shall submit plans for the
review and approval of the Fire Chief. The applicant shall include information
on the plans required by the Fire Chief. Contact the Orange County Fire
Authority Plans Review Section at (714) 744-0403 for the Fire Safety
Site/Architectural Notes to be placed on the plans.
(5) 8.5 Prior to installation, plans for an approved fire-suppression system for the
protection of commercial-type cooking equipment shall be submitted to the Fire
Chief for review and approval.
(5) 8.6 Prior to installation, plans for the fire alarm system shall be submitted to and
approved by the Fire Chief. This system shall be operational prior to the
issuance of a Certificate of Use and Occupancy.
FEES
(1) 9.1 Within forty-eight (48) hours of approval of the subject project, the applicant
shall deliver to the Community Development Department, a cashier's check
payable to the COUNTY CLERK in the amount of $38.00 (thirty eight dollars) to
enable the City to file the appropriate environmental documentation for the
project. If within such forty-eight (48) hour period that applicant has not
delivered to the Community Development Department the above-noted check,
the statute of limitations for any interested party to challenge the environmental
determination under the provisions of the California Environmental Quality Act
could be significantly lengthened.
