That a proper application for Design Review 99-042 was filed by Diversified
Arts on behalf of Alta Dena requesting authorization to remodel an existing
drive through store located at 1062 Irvine Boulevard, within the
Neighborhood Commercial (C-1) zoning district, "Community Commercial"
General Plan land use designation and the Town Center Redevelopment
Project Area.
B.
In accordance with Tustin City Code (TCC) Section 9299(b)(4)(c), the
Zoning Administrator is authorized to review Design Review applications
within Redevelopment Project Areas.
C.
That the Zoning Administrator reviewed the application on MAY 8, 2000.
D.
That pursuant to Section 9272(c) of the Tustin City Code, the Community
Development Department finds that the location, size, architectural
features and general appearance of the proposal will impair the orderly
and harmonious development of the area, the present and future
development therein, and the occupancy as a whole. In reviewing the
project, the Community Development Department has considered the
following items:

Height, Bulk, and Area of Structures/Buildings: The proposed
fascia band does not present an integrated appearance in that the
existing building is a small wood structure built in the 1950's simple
architecture with narrow fascia and small exposed metal structural
members. The bulk and area of the proposed fascia band would
impair the architectural integrity of the site and vicinity in that the
fascia band further decrease the clearance height of the canopy
area and appear massive in relation to the existing structure.
2.
Exterior Materials and Colors: The proposed fascia band would be
designed with a smooth finish and vibrant colors similar to a
modern service station. Addition of multiple vibrant colors does not
complement the design, colors and or materials of the existing
stru ctu re.
The multi-colored fascia band is not harmonious with development
in the area. The use of a variety of vibrant colors is inconsistent
with most of the developments along Irvine Boulevard, which
incorporate muted colors. The color band is excessive in relation to
the size of the building and appears as a form of advertising and

attraction. The disparity of the finish materials between the existing
building and the proposed fascia band detracts from the
harmonious and quality development of the site and vicinity and
would constitute disorderly development.
3. Physical Relationship of Buildings: The physical relationship of the
proposed fascia band is not sufficiently integrated into the
architecture in that the character defining features of the existing
building (I.e., narrow wood fascia, metal structural members) are
not replicated in the design of the fascia band. The fascia band
would be detracting from the quality of development on the site and
in the vicinity.
4. Appearance and Design Relationships: The appearance and
design of the fascia band is not sufficiently related and
complementary to existing structure and possible future structures
in the neighborhood and public thoroughfares. The proposed fascia
band would be visible from Irvine Boulevard and would detract from
the character defining features of the building and the
neighborhood.
5. Several non permitted signs are located on and around the facility.
Approval of the project would exacerbate the site's non-compliance
with the Sign Code.
That the proposed development conflicts with the following City of Tustin
General Plan Policies:
1. Policy 6.2: Encourage and promote high quality design and physical
appearance in all development projects. The proposed fascia band
does not promote high quality design and physical appearance in that
the existing building is a 1950's style wood structure with simple and
small design features. The new fascia band design and colors would
be massive and bold in relation to the existing architectural features.
The disparity of the finish materials between the existing building and
the proposed fascia band detracts from the harmonious and quality
development of the site and vicinity and does not present an
integrated appearance.
2. Policy 6.10: Reinforce Tustin's image and community identity within
the greater Orange County urban area. The design and colors and
location of the fascia band in relation to the existing building would
impair the architectural integrity of the site and vicinity in that the fascia
band would appear as an addition and not integrated with the existing
stru ctu re.

F. In accordance with the purpose of Tustin Signs Code Section 9401, the
proposed fascia mounted signs do not comply with the requirements of
Tustin Sign Code in that submitted plans indicate a twenty (20) square
foot fascia mounted sign on all three sides. The secondary signs on the
east and west sides, may not exceed eighteen (18) square feet in area
(five percent of the area of the wall area behind the canopy) nor be placed
on canopies. A Sign Code Exception and/or Variance would be required
for which an application has not been submitted.
G. The proposed canopy is excessive in relation to building. If denied, the
existing canopy size would not provide sufficient area for the proposed
primary sign.
That projects that are denied are statutorily exempt from the requirements of the
California Environmental Quality Act (CEQA), pursuant to Section 15270 of the
State CEQA Guidelines.
The Zoning Administrator hereby denies Design Review 99-042, a request to
remodel an existing drive-through store by installing a color fascia band and fascia
mounted signs.
15 PASSED AND ADOPTED by the Zoning Administrator of the City of Tustin at a regular
