PUBLIC HEARING: Opened the Public Hearing at 10:11 a.m.
1. CONDITIONAL USE PERMIT(CUP) 2021-0026

ENVIRONMENTAL STATUS:
This project is Categorically Exempt (Class 1) pursuant to Section 15301 of the
California Environmental Quality Act.
REQUEST:
To permanently relocate and establish a Magnetic Resonance Imaging (MRI) facility
at an existing medical center located at 14662 Newport Avenue.
RECOMMENDATION:
That the Zoning Administrator adopt Zoning Administrator Action (ZAA) No. 22-001
approving CUP 2021-0026 to permanently relocate and establish an MRI facility at
14662 Newport Avenue.
The Zoning Administrator, Justina Willkom, asked City staff to identify
themselves for the record. Irma Huitron (Assistant Director), Scott Reekstin
(Principal Planner), Jorge Maldonado (Assistant Planner) and Vera Hurtado
(Recording Secretary) were all in attendance.

Maldonado provided a brief presentation of the item. Due to technical difficulties
Maldonado encountered, Huitron completed the presentation.
Willkom stated she had reviewed the staff report and did not have any questions
for staff.
10:11 a.m.: Willkom opened the Public Hearing.
Mr. John Garay asked if the permanent structure would incorporate any sound
abatement and if there would be any impacts to the noise level after 10:00 p.m.
He asked the applicant if he would assist with the upkeep of the applicant's
property along Sycamore Avenue (i.e. trash outside the fence of the parking lot
area, high impact area for graffiti, and with the food donation at the Tustin Youth
Center, trash tends to build up often). He also asked that the applicant update
the "employee only" parking signs.
In response to Mr. Garay's concern with the noise level, Reekstin stated the
proposed location of the facility is on the north side of the hospital building and
is surrounded by the building structure on three (3)sides, which is well shielded
from adjacent properties and not close to any sensitive uses. He added that staff
does not anticipate any noise issues due to the distance to sensitive uses and
they do not expect the facility to generate a high level of noise, specifically to the
properties to the south. Reekstin referred to the City's Noise Ordinance with
which the applicant must comply. Per Mr. Garay's concern regarding trash,
Reekstin will transmit the information to the applicant.
Michael Lerchen, the applicant, also responded to Mr. Garay's concern with the
noise level. He stated the MRI trailer will be more than 500 feet away from the
area of concern and that the unit makes very little to no sound. Mr. Lerchen
added that they will work on keeping the area free of debris.
Willkom asked the applicant if he had reviewed the staff report, specifically the
Conditions of Approval.
Mr. Lerchen stated he had read over the staff report and Conditions of Approval
and he did not have any questions.
10:17 a.m.: Willkom closed the public hearing.
Regarding noise, Willkom added Condition of Approval No. 2.7 to ZAA 22-001,
which will require the applicant to comply with the City's Noise Ordinance at all
times.
Willkom adopted ZAA 22-001 approving CUP 2021-0026 to permanently locate
and establish an MRI facility at 14662 Newport Avenue, as amended.

ENVIRONMENTAL STATUS:
This project is Categorically Exempt (Class 1) pursuant to Section 15301 of the
California Environmental Quality Act.
REQUEST:
To establish an adult day health care facility with a maximum of 150 participants in an
existing commercial office building.
RECOMMENDATION:
That the Zoning Administrator adopt Zoning Administrator Action (ZAA) No. 22-002
approving CUP 2021-0029 to establish an adult day health care (ADHC) center with a
maximum of 150 participants in an existing commercial office building at 14511 Franklin
Avenue, Suite 100.
Maldonado provided an audio presentation regarding the project.
Reekstin informed Willkom of the recommended modification to Condition of
Approval No. 2.6, to require signage for the loading spaces, to be approved by
the Community Development Department, and a minor typographical error
correction, which Huitron addressed during the presentation, to the applicant.
Willkom asked if the modified condition had been provided to the applicant.
She asked staff to read the modified condition as proposed. Read by Huitron.
Willkom asked for clarification on the location of the four (4) loading spaces in
correlation to the site plan.

Maldonado shared the site plan, and indicated that the four (4) loading spaces
will be located in the parking rows closest to the office building itself. The
improvements will be part of the building plan check submittal when the
applicant submits the minor tenant improvements within the tenant space and
will be reflected on the plans at that time. The parking spaces will be close to
the building in order to load/unload the participants.
10:29 a.m. Hurtado confirmed no public input received.
Boyu Liu, manager of Salida Del Sol, introduced himself and spoke briefly on the
project.
Willkom asked Boyu Liu if he had reviewed ZAA 22-002 and the modified
Condition of Approval and if he was in agreement with the modified condition
regarding signage for the loading and unloading area.
Mr. Boyu Liu stated he would work with City staff regarding the signage and he
will work with City staff and the property landlord regarding the loading and
unloading area.
Willkom asked Mr. Boyu Liu if this was the first facility he had established or if
there were other locations.
Mr. Boyu Liu stated there were other locations in Long Beach, Pomona and
Diamond Bar.
10:32 a.m.: Willkom closed the Public Hearing.
Willkom welcomed Salida Del Sol to the City of Tustin and adopted ZAA 22-002,
approving CUP 2021-0029 to establish an adult day health care center at 14511
Franklin Avenue, Suite 100, as amended.
