SUBJECT: APPROVE RESOLUTION 22-03 AUTHORIZING THE SUBMITTAL OF
APPLICATIONS FOR CALRECYCLE GRANT AND PAYMENT
PROGRAMS AND RELATED AUTHORIZATIONS
SUMMARY
The City applies for various grant and payment programs offered by the Department of
Resources Recycling and Recovery (CalRecycle). As part of the application process for these
- programs, CalRecycle requires a-resolution--authorizing -submittal-of the—application.-- The - -
attached resolution authorizes the City Manager to submit applications for CalRecycle grant and
payment programs for a period of five (5) years.
RECOMMENDATION
That the City Council approve Resolution 22-03 authorizing the submittal of grant and payment
program applications to CalRecycle.-
FISCAL
alRecycle.FISCAL IMPACT
The City receives approximately $20,000 each year for beverage container recycle and litter
abatement. Other grant opportunities are evaluated as they become available. One such
opportunity is the SB 1383 Local Assistance Formula Grants. Staff has prepared an application
requesting $200,000 for education and enforcement activities related to SB 1383
implementation.
CORRELATION TO THE STRATEGIC PLAN
This agreement contributes to the fulfillment of the City's Strategic Plan, Goal D: Strong
Community and Regional Relationships, Strategy #2, by working collaboratively with other
agencies to address issues of mutual interest and concern.
DISCUSSION/BACKGROUND
The City applies for various grant and payment programs offered by the Department of
Resources Recycling and Recovery (CalRecycle). As part of the application process for these
programs, CalRecycle requires a resolution of the City Council authorizing submittal of the
application. The attached Resolution 22-03 authorizes the City Manager to submit applications
for CalRecycle grant and payment programs for a period of five (5) years.
CalRecycle announced at the first of the year they are now accepting applications for the $60
million allocation of funding for SB 1383 local assistance grants. This funding is formula based,
so every City is entitled to at least $20,000. The City of Tustin is anticipated to receive
$106,000. However, staff prepared an application for $200,000 should other agencies fail to
submit required documentation or not have an organics ordinance in place thereby forfeiting

their full allocation. Any money left unallocated may be redistributed by CalRecycle to agencies
that fully comply with the grant requirements.

RESOLUTION NO. 22-03
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, AUTHORIZING SUBMITTAL OF APPLICATION FOR ALL
ELIGIBLE GRANT AND PAYMENT PROGRAMS AND RELATED
AUTHORIZATIONS
WHEREAS, Public Resources Code section 48000 et seq., 14581 . and
42023.1(g) authorize the Department of Resources Recycling and Recovery
(CalRecycle) to administer various grant and payment programs in furtherance of the
State of California's (state) efforts to reduce, recycle and reuse solid waste generated in
the state thereby preserving landfill capacity and protecting public health and safety and
the environment; and
WHEREAS, in furtherance of this authority, CalRecycle is required to establish
procedures governing the administration of the payment programs; and administration
of the application, awarding, and management of grant programs; and
WHEREAS, CalRecycle's procedures for administering grant and payment
programs require, among other things, an applicant's governing body to declare by
resolution certain authorizations related to the administration of the grant and payment
programs.
NOW, THEREFORE, BE IT RESOLVED that the City of Tustin is authorized to
submit an application to CalRecycle for any and all grant and payment programs
offered; and
BE IT FURTHER RESOLVED that the City Manager, or his/her designee, is
hereby authorized and empowered to execute in the name of the City of Tustin all
documents, including but not limited to, application, agreements, amendments and
requests for payment, necessary to secure funds and implement the approved grant or
payment program; and
BE IT FURTHER RESOLVED that this authorization is effective for five (5) years
from the date this Resolution is adopted.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 1 st day of February, 2022.
