HomeMy WebLinkAboutAction Agenda ACTION AGENDA ZONING ADMINISTRATOR REGULAR MEETING MARCH 5, 2001 **** CALL TO ORDER: 10:33 a.m. Community Development Department Conference Room ROLL CALL: Elizabeth Binsack, Zoning Administrator Staff: Karen Peterson, Senior Planner Eloise Harris, Recording Secretary PUBLIC CONCERNS: (Limited to 3 minutes per person for items not on the agenda.) CONSENT CALENDAR: No Items on Consent Calendar PUBLIC HEARINGS: Conditional Use Permit 00-021 AND DESIGN REVIEW 00-026 a request for authorization to remodel the exterior of the commercial center, modify the existing parking lot, and establish outdoor seating and shared parking. This project is located at 301-307 EI Camino Real, and is within the Central Commercial/Parking Overlay (C-2P) zoning district. APPLlCANT/ PROPERTY OWNER: Charles Virzi RECOMMENDATION That the Zoning Administrator adopt Zoning Administrator Action 01-001 approving Conditional Use Permit 00-021 and Design Review 00-026. The Public Hearing opened at 10:34 a.m. The Zoning Administrator indicated there was no need for a staff report; stated Mr. Rick Boufford was in attendance on behalf of the owner, Charles Virzi; and, asked Mr. Boufford to state his concerns. Mr. Boufford responded that his only concern was Condition 2.3 and meeting the 1998 California Building Code requirement for restroom accessibility, but stated his willingness to make the necessary changes. Zoning Administrator Agenda March 5, 2001 Page 2 The Zoning Administrator stated that would be a condition of the building permit; there is some flexibility allowed in this area; and, the Building Official can decide if the present accessibility meets the intent of the Code. The Administrator referred to Condition 3.7 identifying time restrictions and suggested this condition be modified to allow applicant business hours from 11 :30 a.m. to 11 :00 p.m. The Administrator questioned the maximum number of seats allowed as 56 but the maximum number outside as 42. Karen Peterson indicated that number is based upon the square footage of the area; the number will probably be reduced with need of adequate spacing between chairs and tables. Mr. Boufford indicated that only a third of the patio will be used on a day-to-day basis, but the maximum would be needed for special occasions such as receptions. Karen Peterson suggested modifying the last sentence of Condition 3.2 to read: "A maximum of 42 seats may be located in the patio area in accordance with the Uniform Building Code and Title 24." The Administrator approved Zoning Administrator Action 01-001, as amended, and closed the Public Hearing at 10:40 a.m. The Administrator advised Mr. Boufford that there is a seven-day appeal period, encouraged him to make sure the owner signs and records the appropriate document which must be done prior to issuance of building permits, and stated a letter will be sent to the owner informing him of the modifications to the conditions. REGULAR BUSINESS: No Regular Business ADJOURNMENT: The meeting was adjourned at 10:41 a.m. The date of the next regular meeting of the Zoning Administrator will be scheduled when items are set for hearing.
